Measures for the administration of affordable housing in Hangzhou urban area

In order to ensure the basic housing needs of low-income families in Hangzhou, standardize the construction and management of affordable housing, and speed up the construction of housing security system, according to the State Council's Opinions on Solving the Housing Difficulties of Urban Low-income Families (Guo Fa [2007] No.24), the Ministry of Construction, the National Development and Reform Commission, the Ministry of Land and Resources, and the People's Bank of China's Notice on Printing and Distributing the Administrative Measures for Economically Applicable Housing (F.J. [2004]77

First, the term "affordable housing" as mentioned in these Measures refers to the policy housing that the government provides preferential policies, limits the construction standards, supply targets and sales prices, has the nature of security, and the buyers have limited property rights.

Article 2 These Measures shall apply to the construction, trading and management of affordable housing in Shangcheng District, Xiacheng District, Jianggan District, Gongshu District, Xihu District, Hangzhou High-tech Development Zone (Binjiang), Hangzhou Economic Development Zone and Hangzhou Zhijiang Resort.

Xiaoshan District, Yuhang District and counties (cities) can refer to these measures, and can also formulate implementation measures in light of local conditions.

Three, the municipal construction administrative department is responsible for the construction and management of affordable housing. City real estate administrative departments responsible for the management and implementation of affordable housing sales transactions. Municipal development and reform, planning, land and resources, price, finance, public security and other administrative departments and the District People's Government shall be responsible for the work related to affordable housing in accordance with their respective responsibilities.

The specific measures for the listing and trading of affordable housing shall be formulated separately by the municipal real estate administrative department in conjunction with the municipal price and finance departments.

Thirty-two, families have purchased affordable housing, such as the purchase of other housing, the original affordable housing by the government in accordance with the provisions of the repurchase. If the purchase of affordable housing is less than 5 years and needs to be transferred for various reasons, you can apply to the government for repurchase of affordable housing after approval. The repurchase price is determined by the municipal price department in accordance with the original affordable housing price and combined with factors such as depreciation and price level. The affordable housing repurchased by the government will continue to be sold to families who meet the conditions for purchasing affordable housing.

The specific measures for the government to buy back affordable housing shall be formulated separately by the municipal real estate administrative department in conjunction with the municipal price and financial administrative department.

Thirty-three, in the restricted trading period, property transfer due to inheritance and divorce, after approval by the municipal real estate administrative department, can handle the transaction transfer procedures. After handling the transaction transfer procedures, the property is still affordable, and the time limit for listing transactions is calculated from the date of obtaining the original property ownership certificate. The housing ownership registration department shall indicate "inheritance of affordable housing" or "divorce analysis of affordable housing", occupied area, approval date of listing and other related contents in the "postscript" column of the housing ownership certificate.

Due to court rulings, judgments, mediation, etc. , it is necessary to transfer housing ownership. After submitting relevant legal documents to the municipal real estate administrative department, you can go through the transfer formalities in advance, but the nature of affordable housing remains unchanged, and it shall be implemented in accordance with Articles 31, 32 and 33 of these Measures.

Thirty-four, affordable housing shall not be rented, and the nature of its use shall not be changed. Citizens, legal persons or other organizations will be affordable housing as a business or office space, the administrative department for Industry and Commerce shall not issue a business license.

In addition to the purchase mortgage, affordable housing shall not be mortgaged.

Thirty-five, municipal construction, real estate, land and resources, price and other relevant administrative departments shall strengthen the investigation and punishment of illegal acts in the construction and trading of affordable housing, and punish or deal with the following acts according to their respective duties:

(a) without approval to change the land use of affordable housing, the municipal administrative department of land and resources shall be punished according to law.

(two) to raise the sales price of affordable housing without authorization, shall be punished by the municipal administrative department of price according to law.

(three) failing to obtain the pre-sale certificate of commercial housing according to law, the municipal administrative department of construction and price shall be punished according to law.

(four) unauthorized sale of affordable housing to unqualified families, the municipal real estate administrative department shall order the construction unit to recover the housing within a time limit.

(five) unauthorized change of affordable housing into ordinary commercial housing construction and sales, shall be punished by the municipal construction administrative department in accordance with the relevant provisions.

(six) unauthorized rental of affordable housing, shall be punished according to the relevant provisions. If the circumstances are serious, the municipal real estate administrative department may recover its housing.

36, to resort to deceit, conceal family income, housing and other related information, defrauding the purchase of affordable housing, in addition to the city real estate and other administrative departments in accordance with the "Zhejiang Province affordable housing management approach" for punishment, you can take the following measures to recover the purchased housing:

(a) the municipal real estate administrative department shall order the purchaser to return the purchased house within the prescribed time limit. If the purchaser refuses to return, the municipal real estate administrative department may apply to the people's court for compulsory execution.

(two) by the construction unit according to the opinions of the municipal administrative department of real estate, and according to the relevant contents of the purchase contract to terminate the contract, the purchaser returned the purchased housing.

Forty, before the implementation of these measures, affordable housing projects have been tendered, and construction is still carried out in accordance with the provisions of the tender documents and land development compensation agreements and construction project contracts.
