The elevator seller shall sign an elevator sales contract with the construction unit or the elevator user, and specify the quality guarantee period and service content of the elevator. During the quality guarantee period, the elevator seller shall be responsible for free maintenance or replacement of elevator parts, safety accessories, safety protection devices, electrical components and other wearing parts listed in the catalogue of special equipment.
When selling imported elevators, the elevator seller shall hold the certification materials of the manufacturing unit entrusted to sell elevators and the certification materials registered in China, and file them with the special equipment safety supervision and management department of the provincial people's government. Eleventh elevator installation, renovation and major maintenance construction units shall, in accordance with the provisions before the construction, inform the special equipment safety supervision and management departments of the districts and cities, and apply to the special equipment inspection and testing institutions for elevator installation, renovation and major maintenance supervision and inspection; Those that fail to pass the supervision and inspection shall not be delivered for use.
In the process of elevator installation, renovation and major maintenance, the construction unit shall meet the safety production requirements of the construction site and implement on-site safety protection measures. Twelfth construction units shall, within 30 days after the completion of the elevator installation, renovation and major maintenance projects and the supervision and inspection, hand over the safety technical data to the construction unit or the elevator user, and handle the relevant handover procedures; The construction unit shall hand over the safety technical data at the same time when handing over the elevator to the elevator user. Thirteenth people's governments at or above the county level housing and urban and rural construction administrative departments of elevator construction projects without supervision and inspection, not for acceptance and filing procedures.
The fire control institutions of public security organs shall conduct spot checks on fire elevators in accordance with the requirements of the national technical standards for fire control in engineering construction when implementing fire control acceptance or completion acceptance for the record. Entrust the realty service enterprise to manage the elevator, and the entrusted realty service enterprise is the elevator user.
If the elevator not managed by the realty service enterprise belongs to a single property owner, the property owner is the elevator user; If it belongs to multiple property owners, it shall be clear through consultation that one of the property owners is the person responsible for the safe use and management of elevators, and the other property owners shall bear joint liability.
Where a place equipped with an elevator is rented, the user of the elevator shall be agreed in the lease contract; If there is no agreement, the owner of the elevator property is the elevator user.
