Chapter I General Provisions Article 1 In order to strengthen elevator safety management, prevent and reduce accidents, and ensure the safety of people's lives and property, these measures are formulated in accordance with relevant laws and regulations and in light of the actual situation of this province. Article 2 These Measures shall be observed in elevator production (including manufacturing, installation, renovation and maintenance, the same below), sales, use, daily maintenance, inspection and testing and their supervision and management activities within the administrative region of this province. Article 3 People's governments at or above the county level shall strengthen their leadership over elevator safety management. The safety supervision and management department of special equipment at or above the county level shall be responsible for the supervision and management of elevator safety within their respective administrative areas. The relevant administrative departments of the people's governments at or above the county level shall do a good job in elevator safety management within the scope of their respective duties.

The township (town) people's government, neighborhood offices and village (neighborhood) committees (communities) shall assist the special equipment safety supervision and management departments in elevator safety management. Article 4 The elevator user is the main body responsible for elevator safety management, and shall strengthen safety management according to law, establish and improve the responsibility system for safety management, improve the conditions for safe use, and ensure the safe use of elevators. Fifth people's governments at or above the county level shall encourage and guide elevator users and daily maintenance units to participate in elevator liability insurance, and improve the ability of accident compensation.

Encourage the use of advanced scientific and technological means such as remote monitoring, improve the level of elevator safety management, and enhance the ability of accident prevention and emergency rescue. Article 6 The safety supervision and management department of special equipment at or above the county level and other relevant administrative departments, news media, schools and village (neighborhood) committees (communities) shall publicize and popularize elevator safety knowledge, advocate civilized use of elevators, and enhance public safety awareness. Seventh people's governments at or above the county level shall guide and support the elevator daily maintenance units to establish a regional elevator rescue network to achieve rapid professional rescue.

Encourage and support social organizations, enterprises and institutions to set up voluntary emergency rescue organizations to participate in elevator emergency rescue work, and the special equipment safety supervision and management department shall give guidance. Chapter II Production and Sales Article 8 An elevator production unit shall obtain the license qualification according to law before engaging in corresponding activities.

Operators of elevator installation, renovation, maintenance, daily maintenance and operation and their related safety management personnel shall, in accordance with the relevant provisions of the state, pass the examination by the safety supervision and management department of special equipment and obtain the certificate of special equipment operators in a unified national format before they can engage in corresponding operations or management. Article 9 If it is necessary to install elevators in construction projects, the construction unit shall purchase elevators manufactured by units that have obtained manufacturing licenses, and the selection and configuration shall be suitable for the structure and use requirements of buildings or structures, and entrust the units that have obtained installation licenses to install them. Article 10 Elevator sellers shall establish and implement a system of inspection and acceptance of incoming goods, verify the elevator manufacturing license, product quality certificate and other supporting documents, and shall not sell elevators manufactured by units that have not obtained the manufacturing license qualification.

The elevator seller shall sign an elevator sales contract with the construction unit or the elevator user, and specify the quality guarantee period and service content of the elevator. During the quality guarantee period, the elevator seller shall be responsible for free maintenance or replacement of elevator parts, safety accessories, safety protection devices, electrical components and other wearing parts listed in the catalogue of special equipment.

When selling imported elevators, the elevator seller shall hold the certification materials of the manufacturing unit entrusted to sell elevators and the certification materials registered in China, and file them with the special equipment safety supervision and management department of the provincial people's government. Eleventh elevator installation, renovation and major maintenance construction units shall, in accordance with the provisions before the construction, inform the special equipment safety supervision and management departments of the districts and cities, and apply to the special equipment inspection and testing institutions for elevator installation, renovation and major maintenance supervision and inspection; Those that fail to pass the supervision and inspection shall not be delivered for use.

In the process of elevator installation, renovation and major maintenance, the construction unit shall meet the safety production requirements of the construction site and implement on-site safety protection measures. Twelfth construction units shall, within 30 days after the completion of the elevator installation, renovation and major maintenance projects and the supervision and inspection, hand over the safety technical data to the construction unit or the elevator user, and handle the relevant handover procedures; The construction unit shall hand over the safety technical data at the same time when handing over the elevator to the elevator user. Thirteenth people's governments at or above the county level housing and urban and rural construction administrative departments of elevator construction projects without supervision and inspection, not for acceptance and filing procedures.

The fire control institutions of public security organs shall conduct spot checks on fire elevators in accordance with the requirements of the national technical standards for fire control in engineering construction when implementing fire control acceptance or completion acceptance for the record. Chapter III Use Article 14 If the construction unit fails to hand over the elevator ownership after the installation of the elevator, the construction unit shall be the elevator user.

Entrust the realty service enterprise to manage the elevator, and the entrusted realty service enterprise is the elevator user.

If the elevator not managed by the realty service enterprise belongs to a single property owner, the property owner is the elevator user; If it belongs to multiple property owners, it shall be clear through consultation that one of the property owners is the person responsible for the safe use and management of elevators, and the other property owners shall bear joint liability.

Where a place equipped with an elevator is rented, the user of the elevator shall be agreed in the lease contract; If there is no agreement, the owner of the elevator property is the elevator user.
