Where there are other provisions in laws and regulations on the use and safety management of houses for production, military facilities, places for religious activities, cultural relics protection units and scenic spots, those provisions shall prevail.
Fire protection, earthquake resistance, lightning protection and safety management of facilities and equipment such as elevators, power supply, water supply and gas supply shall be implemented in accordance with the provisions of relevant laws and regulations. Article 3 The management of house use safety shall follow the principles of territorial management, giving priority to prevention, combining prevention with control, and ensuring safety. Article 4 The people's governments at or above the county level shall lead the housing use safety management in their respective jurisdictions, establish a housing use safety management system with overall management, graded responsibility, comprehensive coordination and social participation, strengthen the publicity and education on housing use safety and the capacity building of law enforcement management, and incorporate the management funds into the fiscal budget at the same level.
The competent department of housing and urban construction is responsible for the safety management of housing use in this area, and its subordinate housing use safety management institutions are specifically responsible for daily management.
Natural resources and planning, comprehensive administrative law enforcement, public security, market supervision, emergency management, education, health, culture and tourism, sports, transportation, commerce, state-owned assets, civil affairs, finance and other relevant competent departments and township (town) people's governments and sub-district offices shall, in accordance with their respective duties and the provisions of these regulations, do a good job in the safety management of housing use.
Development Zone (Park) management institutions shall, in accordance with the responsibilities stipulated by the people's governments at or above the county level, do a good job in the safety management of housing use in the region. Fifth housing and urban construction departments should strengthen the publicity of housing safety knowledge, establish and improve the reporting and complaint mechanism, open the way of acceptance, and promptly inform the informants and complainants of the results. Chapter II Safety Management of House Use Article 6 The owner of a house is the person responsible for the safety of house use. If the house belongs to the state or the collective, the manager shall be the person in charge of house safety. The owner and manager of the house can make an agreement with the user on matters related to the safety of the use of the house.
The owner of the house is missing and the ownership is unclear, and the user is the person responsible for the safety of the house; If there is no user, the manager is the person responsible for the safety of housing use. Article 7 The person in charge of housing use safety shall bear the following responsibilities for housing use safety:
(a) the rational use of housing in accordance with the planning purposes and design requirements, to ensure the integrity and safety of housing;
(two) inspection, maintenance and repair of houses, timely eliminate potential safety hazards;
(three) in accordance with the provisions of these regulations, entrust the housing safety appraisal;
(four) the building curtain wall is built in the house, and the safety maintenance is carried out in accordance with the provisions of the state;
(five) to cooperate with the government and relevant departments to organize the implementation of housing safety hazards investigation, dangerous housing management and emergency disposal;
(six) take other necessary measures to ensure the safety of the house.
Part of the daily safety inspection, maintenance and other management responsibilities of the house shall be borne by the person responsible for the safety of the house; The implementation of entrusted management of property services shall be undertaken by the property service enterprise in accordance with the contract. Article 8 When the house is delivered for use, the construction unit shall submit the house quality guarantee and the house use instruction to the buyer, and inform the buyer of the performance index, warranty unit, warranty scope and duration of the house.
The construction unit shall, in accordance with the provisions of laws and regulations and the contract, assume the responsibility for the warranty and governance of housing quality defects during the warranty period. If losses are caused to the buyer due to housing quality problems, compensation shall be made according to law.
The warranty of the basic project and the main structure project of the housing reform house shall be implemented by the housing construction unit with reference to the provisions of the second paragraph of this article. Ninth prohibit the following acts endangering the safety of housing use:
(a) damage or unauthorized changes to the bearing structure and main structure of the house;
(two) illegal construction of buildings and structures on the roof or side of the house;
(3) Changing other rooms or balconies into bathrooms and kitchens, or changing the bedrooms, living rooms (halls) and kitchens of lower-level households into bathrooms;
(4) lowering the elevation of the ground floor or excavating the basement;
(five) in the floor, balcony, terrace, roof overload laying materials or stacked items, adding overloaded partition walls indoors;
(six) the decoration affects the use of some parts of the house and endangers the safety of the use of the house and its adjacent houses;
(seven) other acts that endanger the safety of housing use as stipulated by laws and regulations. Article 10 The house use safety management institutions, township (town) people's governments, subdistrict offices and realty service enterprises shall, in accordance with their duties or contractual agreements, be responsible for the daily inspection of the house use safety in their respective jurisdictions or realty service areas, implement the normalization and grid management system of the house use safety, and expressly prohibit the behavior norms and precautions.
Housing use safety management institutions, township (town) people's governments, street offices, property service enterprises and responsible persons for housing use safety shall report to the competent department of housing and urban construction in a timely manner when they find that there are potential safety hazards or behaviors that endanger the safety of housing use. After receiving the report, the competent department of housing and urban and rural construction shall investigate potential safety hazards and stop acts that endanger the safety of housing use. If administrative punishment is needed, it shall be transferred to the comprehensive administrative law enforcement department for investigation and punishment according to law.
