Is it illegal to collect community information?

Legal analysis: if it is for the needs of social management, it is legal for the corresponding social management organs to collect it, such as public security organs, social insurance organs and judicial administrative organs (the collection of prisoners). Non-social administrative organs collect information without the permission of the parties, which is an infringement. Some information is public information, such as property fees, parking fees, parking spaces in residential areas, and it is no problem to collect this information. It is not illegal to photograph residential roads and corridors, but it is no problem for residential property managers and security guards to stop their behavior.

Legal basis: People's Republic of China (PRC) Criminal Law Amendment (VII). One article is added after Article 253 of the Criminal Law as one of Article 253: "Staff of state organs and financial, telecommunications, transportation, education, medical and other units. In violation of state regulations, selling or illegally providing citizens' personal information obtained in the course of performing their duties or providing services to others, if the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not more than three years. " Whoever steals or illegally obtains the above information by other means, if the circumstances are serious, shall be punished in accordance with the provisions of the preceding paragraph. Where a unit commits the crimes mentioned in the preceding two paragraphs, it shall be fined, and the persons who are directly in charge and other persons who are directly responsible shall be punished in accordance with the provisions of each paragraph.
