Provisions of Jiangsu Province on Fire Safety Management of Residential Property

Chapter I General Provisions Article 1 In order to prevent fires and reduce fire hazards, protect personal and property safety, and standardize and strengthen the fire safety management of residential properties, these Provisions are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC), the Regulations on Property Management and other laws and regulations, combined with the actual situation of this province. Article 2 These Provisions shall apply to the fire safety management activities of residential properties within the administrative area of this province. Where laws, regulations and the state provide otherwise, such provisions shall prevail. Article 3 The fire safety management of residential property shall follow the principle of putting people first and putting prevention first, and adhere to the combination of government leading and social participation, and the combination of owner autonomy and collaborative governance. Article 4 The local people's governments at or above the county level shall strengthen their leadership over the fire safety management of residential properties within their respective administrative areas, incorporate the fire safety content of residential properties into fire planning, establish and improve relevant services and guarantee mechanisms, coordinate and solve major problems, and urge the people's governments at lower levels and relevant departments to perform their duties of fire safety management of residential properties.

Township people's governments and sub-district offices shall incorporate the fire safety management of residential properties into the scope of grassroots social governance and urban and rural grid service management. Fifth owners are responsible for the fire safety of residential property. The owner shall entrust or designate a unified manager to be responsible for the fire safety management of residential property. Sixth radio and television, newspapers, Internet and other media should carry out publicity and education on fire safety knowledge of public welfare residential properties in accordance with the provisions.

Encourage social forces to support and participate in the fire safety work of residential property. Seventh local people's governments at or above the county level and the relevant departments and units of the province may, in accordance with the relevant provisions of the state and the province, commend and reward the units and individuals that have made remarkable achievements in the fire safety work of residential properties. Chapter II Fire Safety Responsibilities Article 8 Fire rescue agencies shall perform the following fire safety responsibilities for residential properties according to law:

(a) to guide and supervise the fire safety work of residential property;

(two) the organization of fire safety publicity, education and training;

(three) to provide technical guidance for emergency plan drills, fire fighting and life-saving skills training;

(4) Organizing or participating in the investigation and handling of fire accidents;

(five) to organize and direct on-site fire fighting and emergency rescue work;

(six) other duties as prescribed by laws, regulations and rules. Article 9 Public security police stations shall, in accordance with state regulations, conduct daily supervision over the fire safety of residential properties within their jurisdiction and carry out publicity and education on fire safety. Tenth property management departments are responsible for the supervision and management of residential property management activities, and support the special maintenance funds for residential buildings for the maintenance, renewal and transformation of fire-fighting facilities. Eleventh gas and electric power administrative departments shall urge gas and electric power supply enterprises to strengthen the safety inspection of residential property gas and electricity, and guide users to eliminate potential safety hazards in time. Twelfth other departments or institutions responsible for fire supervision and management according to law shall, in accordance with their respective responsibilities, do a good job in the supervision and management of fire safety in residential properties. Thirteenth Township People's governments and sub-district offices shall perform the following fire safety duties of residential properties according to law:

(a) to establish and improve the fire safety organization and formulate the fire safety system;

(two) to guide and supervise the fire safety management activities of residential property, and urge the owners, property users, owners' congress, owners' committee and unified manager to fulfill their fire safety responsibilities;

(3) Measures and requirements for implementing grid management of fire safety;

(four) to guide the village (neighborhood) committees to carry out fire safety work in residential properties;

(five) other duties as prescribed by laws, regulations and rules.

Township people's governments and sub-district offices shall, according to the needs of local economic development and fire safety work, establish full-time fire brigades and voluntary fire brigades. Fourteenth owners and property users shall abide by the following provisions:

(a) to perform the statutory fire safety responsibilities, abide by the fire safety matters agreed in the management statute, and implement the decisions of the owners' congress and the owners' committee on fire safety management;

(two) to cooperate with the unified manager to do a good job in the fire safety of residential properties;

(three) in accordance with the provisions of the corresponding fire hazards rectification, fire control facilities, equipment maintenance, testing and updating, purchase related expenses;

(4) Do a good job in fire safety prevention of proprietary parts of buildings and self-use equipment, clean up evacuation passages, safety exits, kitchens, balconies and other parts in time, use electrical equipment and gas appliances safely, and investigate, rectify and eliminate fire hazards;

(five) comply with the relevant provisions of the fire safety of residential decoration;

(six) other fire safety duties as prescribed by laws, regulations and rules. Fifteenth owners' congress and owners' committee shall bear the following responsibilities for the fire safety management of residential property:

(a) the management rules formulated by the organization shall include the contents of fire safety management;

(two) agree with the unified manager's opinions on fire safety responsibilities and preventive services;

(three) urge owners and property users to abide by fire laws and regulations, and supervise the implementation of fire safety matters agreed in the management statute;

(four) to cooperate with the village (neighborhood) committees to perform their duties of fire safety work according to law, support the village (neighborhood) committees to carry out fire control work, and accept their guidance and supervision;

(five) to supervise and assist the unified manager to implement fire safety services;

(six) the use of residential special maintenance funds in accordance with the law, maintenance and updating of fire control facilities and equipment;

(seven) to cooperate with the government and relevant departments to do a good job in fire safety publicity;

(eight) other fire safety duties as prescribed by laws, regulations and rules.

If there is no owners' meeting or owners' committee, all the owners or the property management committee established according to law shall perform the duties of fire safety management specified in the preceding paragraph.
