Measures of Taiyuan Municipality on the Administration of Elevator Safety

Chapter I General Provisions Article 1 In order to strengthen elevator safety management, prevent and reduce elevator accidents, ensure personal and property safety, and promote economic and social development, these measures are formulated in accordance with the provisions of the Law of the People's Republic of China on Safety of Special Equipment and other laws and regulations, combined with the actual situation of this Municipality. Article 2 The term "elevators" as mentioned in these Measures includes traction and forced-driven elevators, hydraulic-driven elevators, escalators, moving sidewalks and other types of elevators. The specific type is determined according to the national special equipment catalogue. Article 3 These Measures shall apply to the production, operation, use, inspection and safety management of elevators within the administrative area of this Municipality.

If the elevator used for self-use or single-family use is changed to public use, these measures shall be followed. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over elevator safety management, support and urge relevant departments to perform their management duties according to law, establish a coordination mechanism, coordinate and solve existing problems in a timely manner, include elevator safety management in the assessment of the responsibility system for production safety, and include working funds in the fiscal budget at the corresponding level.

Township (town) people's governments and sub-district offices shall, within the scope of their duties, bring elevator safety into the scope of safety production inspection and assist in elevator safety management. Fifth city and county (city, district) special equipment safety supervision and management departments are responsible for the elevator safety supervision and management within their respective administrative areas, perform their duties according to law, implement information means, and implement safety supervision, technical inspection and administrative law enforcement on elevator production, operation and use management units and inspection and testing institutions.

The construction administrative department is responsible for the supervision and management of the construction quality of the elevator shaft, machine room and pit of the new building.

The property management administrative department is responsible for supervising the property service enterprises to perform elevator management duties, and supervising the residential special maintenance funds for elevator renewal, renovation and maintenance.

The communication management department is responsible for coordinating the establishment of communication network coverage in elevators.

City, county (city, district) and other relevant departments shall do a good job in elevator safety supervision and management according to their respective responsibilities. Article 6 Elevator industry associations shall strengthen industry self-discipline, promote the construction of industry credit system, provide training, publicity, technical exchange, industry evaluation, consultation and other services, guide elevator production, operation and use management units to strengthen safety management, and participate in relevant inspections and the formulation of relevant standards.

The supervision and administration department of special equipment can guide trade associations to participate in elevator safety management by purchasing services from trade associations. Seventh elevator production, operation and use management units, inspection and testing institutions, industry associations, etc. Elevator information closely related to the public shall be disclosed in a timely manner in accordance with regulations.

Special equipment safety supervision and management departments should take various forms to ensure public participation in supervision and timely handle reports involving elevator safety. Article 8 This Municipality encourages the adoption of advanced technologies and methods to improve the safety performance and risk management level of elevators, and enhance the ability of accident prevention and emergency rescue.

Encourage qualified units to provide elevator safety and energy-saving professional services in the form of contract management. Article 9 State organs, social organizations and elevator production, operation and use management units shall take various forms to strengthen elevator safety publicity and education and popularize knowledge, advocate safe and civilized use of elevators, and enhance public awareness of elevator safety.

News, publishing, radio, television, newspapers, internet and other units should carry out publicity and education on elevator safety for public welfare, and strengthen public opinion guidance and supervision on elevator safety. Chapter II Use Management Article 10 The use management unit refers to the unit or individual that has the power and obligation of elevator management and undertakes the responsibility of use management. The use of management units is determined as follows:

(a) self-management, the owner or user is the elevator use management unit;

(2) Where the management is entrusted to a realty service enterprise or other unit, the entrusted party is the elevator use management unit;

(three) the newly installed elevator has not been handed over to the owner or user, and the project construction unit is the elevator use management unit;

(4) If the elevator place is leased or lent, the owner of the elevator is the elevator use management unit; If there is an agreement, the elevator management unit shall be determined according to the agreement;

(five) if there are multiple owners or users of the elevator, the elevator use management unit shall be determined through consultation; If negotiation cannot be determined, the people's government of the township (town) where the elevator is located and the street office shall be responsible for coordinating and determining the elevator use management unit.

The elevator that has not determined the elevator use management unit shall not be put into use. Eleventh elevator management units shall be responsible for the safety of elevator use, and take the following elevator safety management measures:

(a) establish and improve the elevator safety operation management system;

(two) the establishment of elevator safety technical files;

(three) set up emergency alarm device or emergency rescue telephone in the elevator car to ensure its normal use, and designate a special person to be on duty 24 hours a day;

(4) Post safety precautions, elevator use signs and signs in the elevator car or at the obvious position of the entrance and exit, and set emergency stop signs at the obvious position of the escalator (moving sidewalk);

(five) to formulate emergency rescue plans for elevator safety accidents;

(six) other provisions of the state and province on the use and management of elevators.
