General rules for the implementation measures of pre-property management bidding in Jiangsu Province

Article 1 In order to standardize the bidding behavior in this province, protect the legitimate rights and interests of the parties, and promote fair competition in the property management market, these measures are formulated in accordance with the relevant provisions of the Bidding Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council, the Regulations on Property Management of Jiangsu Province, and the Interim Measures for the Management of Pre-tender Property Management of the Ministry of Construction, combined with the actual situation of this province.

Article 2 Pre-bidding for property management refers to the activity that the construction unit selects a property management enterprise with corresponding qualifications through bidding before the owners and the owners' meeting select the property management enterprise, and stipulates in the contract the maintenance, conservation and management of the houses, supporting facilities and related sites in the property management area, so as to maintain the regional environmental sanitation and order.

Article 3 Within the administrative region of this province, these Measures shall apply to the construction unit's selection of prophase property management enterprises through bidding, and the administrative department's supervision and management of property management bidding activities according to law.

Article 4 The residential and non-residential construction units (including phased construction and multi-company construction) within the same property management area shall employ property management enterprises with corresponding qualifications to be responsible for the preliminary property management through bidding.

Under any of the following circumstances, with the approval of the property management administrative department of the county (city, district) where the property project is located, the property management enterprise with corresponding qualifications can be selected by agreement:

(1) There are less than three bidders who invite public bidding or accept invitations twice in a row;

(2) The residential and non-residential buildings in the same property management area have a construction area of less than 30,000 square meters, or the construction area of detached houses (villas) in the property management area is less than 6,543,800 square meters.

Fifth preliminary property management bidding should follow the principles of openness, fairness, impartiality and good faith.

Sixth provincial construction administrative departments shall be responsible for the guidance, supervision and management of the preliminary property management bidding activities within the administrative area of this province.

The administrative departments of property management at or above the county (city, district) level shall be responsible for the guidance, supervision and management of the preliminary property management bidding activities within their respective administrative areas in accordance with the division of responsibilities.

Article 7 No unit or individual may violate laws and regulations to restrict or exclude potential bidders from participating in the preliminary property management bidding, illegally interfere in the bidding activities in any way, dismantle the property projects that must be tendered according to law or evade the bidding in other ways.
