Measures of Wuxi Municipality on Property Management
Newly built residential areas and existing residential areas with complete supporting facilities shall be subject to property management; Property management should be implemented for properties with incomplete original residential areas and other supporting facilities. Article 3 Wuxi Real Estate Management Bureau is the administrative department in charge of property management in this Municipality, and is responsible for the supervision and management of property management activities in this Municipality.
City (county), the District People's government to determine the property management administrative departments in the city property management administrative departments under the guidance of the supervision and management of property management activities within their respective jurisdictions.
City, city (county), the District People's government and other relevant departments shall, in accordance with their respective responsibilities, coordinate the implementation of these measures. Article 4 Sub-district offices (town people's governments) shall assist relevant administrative departments to supervise property management activities and coordinate the relationship between property management and community construction. Chapter II Self-management of Owners Article 5 Owners shall conduct self-management of the property through the owners' assembly and the owners' committee. If the number of owners in the property management area is small, the owners can decide the organizational form of property management by themselves. Article 6 In property management activities, the rights and obligations of the owners and the duties that the owners' congress and the owners' committee shall perform shall be implemented in accordance with the relevant provisions of the Regulations on Property Management of the State Council and the Regulations on Property Management of Jiangsu Province. Seventh a property management area only set up a owners' meeting. The owners' meeting is composed of all owners in the property management area. In any of the following circumstances, the owners' meeting shall be established in the property management area:
(a) the sales delivery of housing construction area reached more than 50% of the total construction area of the property management area;
(2) The delivered construction area of the property has reached 30% but less than 50% of the total construction area of the property management area, but it has been used for more than one year.
Only one owner, or a few owners, with the consent of all owners, decides not to set up the owners' meeting, and the owners shall perform the duties of the owners' meeting and the owners' committee. Article 8 If the property management area meets one of the circumstances listed in the first paragraph of the preceding article, the construction unit shall submit a written report on the establishment of the owners' meeting to the local city (county) and district property management administrative department in time, and provide the list of owners, property construction area, property sale and delivery time and other documents. If the construction unit fails to report in time, the owner may also directly submit a written request for the establishment of the owners' meeting to the local city (county) and district property management administrative department.
City (county) and district property management administrative departments shall, after receiving the written report of the construction unit or the written request of the owners, guide the owners to recommend the members of the preparatory group for the first owners' meeting, and form the preparatory group for the first owners' meeting in conjunction with the subdistrict office (town people's government) (hereinafter referred to as the preparatory group).
The preparatory group consists of the owner's representative and the construction unit. After the members of the preparatory group are determined, they shall be publicized in the property management area for not less than 7 days. Article 9 The preparatory group shall do the following work:
(a) to determine the time, place, form and content of the first owners' meeting;
(2) Drawing up the draft rules of procedure of the owners' congress and the draft owners' convention with reference to the model text formulated by the property management administrative department;
(three) to confirm the identity of the owners and the number of voting rights of the owners at the first meeting of the owners' congress;
(four) to determine the candidates for the members of the owners' committee by direct nomination or by joint recommendation of more than 10% of the owners;
(5) Make other preparations for convening the first meeting of the owners' congress. Tenth the voting rights of the first owners' meeting shall be exercised by the owners, and the residential property shall be subject to one set of one vote; For non-residential houses, the construction area is 150 m2/ticket, and the ownership certificate of each house with less than 1 50 m2 is 1 ticket. The maximum voting right of a single owner cannot exceed 30% of the total voting rights.
The determination of the number of owners' voting rights at the second and subsequent owners' meetings shall be subject to the provisions of the rules of procedure of the owners' meeting; Where there are no explicit provisions, the provisions of the preceding paragraph shall prevail. Article 11 The preparatory group shall, within 30 days from the date of its establishment, hold the first meeting of the owners' congress under the guidance of the city (county) where the property is located, the district property management administrative department and the subdistrict office (town people's government), discuss and adopt the rules of procedure of the owners' congress and the owners' convention, and elect the owners' committee.
The preparatory expenses for the first owners' meeting shall be borne by the property construction unit. Twelfth meetings of the owners' congress are divided into regular meetings and temporary meetings.
Regular meetings of the owners' congress shall be held in accordance with the rules of procedure of the owners' congress. In any of the following circumstances, the owners' committee shall promptly organize an interim meeting of the owners' congress:
(a) more than 20% of the owners proposed;
(two) a major accident or emergency needs to be dealt with in time;
(three) other circumstances stipulated in the rules of procedure of the owners' congress or the owners' convention.
If the owners' committee fails to organize an interim meeting of the owners' congress in time in accordance with the above provisions, the city (county) or district property management administrative department where the property is located shall urge the owners' committee to convene an interim meeting of the owners' congress.
