On the basis of traditional fire protection design review and completion acceptance, the new fire protection law introduces the fire protection design and completion acceptance filing system. In this regard, the Ministry of Public Security has made detailed provisions in the "Regulations on Fire Supervision and Management of Building Projects".

The third and fourth chapters of the Regulations on Fire Supervision and Management of Construction Projects are as follows:

Chapter III Fire Protection Design Audit and Fire Protection Acceptance

Thirteenth in any of the following circumstances, the construction unit shall apply to the fire department of the public security organ for fire control design review, and after the completion of the construction project, apply to the fire department of the public security organ for fire control acceptance:

(a) stadiums, auditoriums, public exhibition halls and museum exhibition halls with a total construction area of more than 20,000 square meters;

(2) Civil airport terminals, passenger station waiting rooms and passenger station waiting rooms with a total construction area of 15000 square meters or more;

(3) Hotels, restaurants, shopping malls and markets with a total construction area of over 10,000 square meters;

(4) theaters, public library reading rooms, business indoor fitness and leisure places, hospital outpatient buildings, teaching buildings, university libraries and canteens, production and processing workshops of labor-intensive enterprises, temples and churches with a total construction area of more than 2,500 square meters;

(5) Children's rooms in nurseries and kindergartens with a total construction area of 1000 square meters or more, indoor places for children's activities such as children's playrooms, ward buildings in nursing homes, welfare homes, hospitals and sanatoriums, teaching buildings, libraries and canteens in primary and secondary schools, dormitories in schools and dormitories for workers in labor-intensive enterprises;

(6) Song and dance halls, video halls, projection halls, karaoke halls, nightclubs, amusement halls, saunas, Internet cafes, bars, restaurants, teahouses and cafes with entertainment functions with a total construction area of over 500 square meters.

Fourteenth special construction projects under any of the following circumstances, the construction unit shall apply to the fire control institution of the public security organ for fire control design review, and after the completion of the construction project, it shall apply to the fire control institution of the public security organ for fire control acceptance:

(1) Construction projects in crowded places listed in Article 13 of these Provisions;

(2) Office buildings, power dispatching buildings, telecommunication buildings, postal buildings, disaster prevention command and dispatching buildings, radio and television buildings and archives buildings of state organs;

(three) other public buildings with a single building area of more than forty thousand square meters or a building height of more than fifty meters other than those specified in the first and second paragraphs of this article;

(4) Urban rail transit, tunnel engineering, large-scale power generation and distribution engineering;

(5) Factories, warehouses, special stations and docks for producing, storing and loading and unloading inflammable and explosive dangerous goods, filling stations, supply stations and pressure regulating stations for inflammable and explosive gases and liquids.

Fifteenth the construction unit shall provide the following materials to apply for fire protection design audit:

(a) the construction project fire design audit declaration form;

(2) Legal identity documents such as the business license of the construction unit;

(three) the construction project planning permit documents for new construction and expansion projects;

(four) the qualification certificate of the design unit;

(5) Fire protection design documents.

Article 16 In case of any of the following circumstances, the construction unit shall, in addition to the materials listed in Article 15 of these Provisions, provide the technical scheme and description of special fire protection design, or the Chinese version of international standards and overseas fire protection technical standards adopted in the design, as well as other technical materials related to fire protection design, such as application examples and product descriptions:

(a) there is no provision in the national technical standards for fire control in engineering construction;

(two) the new technologies, new processes and new materials to be adopted in the fire protection design documents may affect the fire safety of construction projects and do not meet the requirements of national standards;

(three) the adoption of international standards or overseas fire technical standards.

Seventeenth fire control institutions of public security organs shall issue written audit opinions within twenty days from the date of accepting the application for fire control design audit. But in accordance with the provisions of the need to organize expert review, expert review time is not included in the audit time.

Eighteenth fire control institutions of public security organs shall, according to the mandatory requirements of fire laws and regulations and the national technical standards for fire control in engineering construction, review the declared fire control design documents. If the following conditions are met, the fire control institution of the public security organ shall issue a qualified opinion on fire control design audit; Do not meet the conditions, it shall issue a fire design audit unqualified opinions, and explain the reasons:

(a) the new construction and expansion projects have obtained the construction project planning permit;

(two) the design unit has the corresponding qualifications;

(3) The compilation of fire protection design documents meets the requirements for reporting fire protection design documents stipulated by the Ministry of Public Security;

(four) the general layout of the building, fire rating, building structure, safe evacuation, fire water supply, fire power supply, power distribution and fire control facilities design meet the mandatory requirements of the national technical standards for fire control in engineering construction;

(five) the selected fire protection products and building materials with fire protection performance requirements meet the national technical standards for fire protection in engineering construction and relevant management regulations.

Article 19 For a construction project under any of the circumstances listed in Article 16 of these Provisions, the fire control institution of the public security organ shall submit the application materials to the fire control institution of the public security organ of the provincial people's government for expert review within five days from the date of accepting the application for fire control design review.

The fire control institution of the public security organ of the provincial people's government shall, within 30 days from the date of receiving the application materials, hold an expert review meeting with the administrative department of housing and urban and rural construction at the same level to review the fire control technical scheme submitted by the construction unit. Experts participating in the review should have senior technical titles of relevant majors, with a total number of not less than 7 people, and issue expert review opinions. If the bid evaluation experts have different opinions, it shall be indicated.

The fire department of the public security organ of the provincial people's government shall notify the fire department of the public security organ that submitted the application materials in writing within five days after the expert review meeting, and report it to the fire department of the Ministry of Public Security for the record.

For the fire protection technical scheme agreed by more than 2/3 experts, the fire control institution of the public security organ that accepts the application for fire protection design audit shall issue a qualified opinion on fire protection design audit.

Twentieth construction, design, construction units shall not arbitrarily modify the fire protection design of construction projects that have passed the examination and approval of the fire control institutions of public security organs. If it is really necessary to modify, the construction unit shall re-apply for the fire protection design audit to the fire control institution of the public security organ that issued the fire protection design audit opinion.

Twenty-first construction units shall provide the following materials when applying for fire control acceptance:

(a) the construction project fire inspection declaration form;

(two) the project completion acceptance report;

(three) the quality certificate of fire protection products;

(four) the building components, building materials and interior decoration materials with fire performance requirements meet the national standards or industry standards and the factory certificate;

(five) fire facilities, electrical fire prevention technology inspection documents;

(six) the legal identity certificate and qualification certificate of the construction, project supervision and testing unit;

(seven) other materials that need to be provided according to law.

Twenty-second fire control institutions of public security organs shall organize fire control acceptance within twenty days from the date of accepting the application for fire control acceptance, and issue opinions on fire control acceptance.

Twenty-third fire control institutions of public security organs shall, in accordance with the evaluation standards for fire control acceptance of construction projects, organize fire control acceptance of the contents approved by fire control design.

The fire control institutions of public security organs shall issue fire control acceptance opinions for the construction projects that are qualified through comprehensive evaluation; If the comprehensive evaluation conclusion is unqualified, it shall issue unqualified opinions on fire control acceptance and explain the reasons.

Twenty-fourth of the high-rise buildings, underground projects and the use of new technologies, new processes, new materials construction projects, fire control institutions of public security organs should focus on supervision and inspection, and urge the construction unit to implement the fire safety and quality responsibility of the project construction.

Chapter IV Filing and Spot Checking of Fire Protection Design and Completion Acceptance

Article 25 For construction projects other than those specified in Articles 13 and 14 of these Provisions, the construction unit shall, within seven days from the date of obtaining the construction permit and passing the project completion acceptance, conduct fire protection design and completion acceptance filing through the fire protection design and completion acceptance filing system on the website of the fire control institution of the provincial public security organ, or submit a paper filing form to be entered into the fire protection design and completion acceptance filing and acceptance system by the fire control institution of the public security organ.

Twenty-sixth fire control institutions of public security organs shall, after receiving the fire protection design and completion acceptance record, issue a record certificate, and randomly determine the random inspection objects through the preset random inspection procedures in the fire protection design and completion acceptance record acceptance system; The construction unit that has been spot-checked shall, within five days from the date of receiving the filing certificate, provide the materials specified in Article 15 or Article 21 of these Provisions to the fire control institutions of public security organs according to the filing matters.

The fire control institution of the public security organ shall, within 30 days from the date of receiving the filing materials for fire control design and completion acceptance, complete the drawing review in accordance with the mandatory requirements of fire control laws and regulations and the national technical standards for fire control of engineering construction, or complete the project acceptance in accordance with the evaluation standards for fire control acceptance of construction projects and make acceptance records. The inspection results shall be published in the fire protection design and completion acceptance filing and acceptance system.

Twenty-seventh fire control institutions of public security organs shall, within five days, notify the construction unit in writing to correct the unqualified fire control design; If construction has started, it shall be ordered to stop at the same time.

After receiving the notice, the construction unit shall stop the construction, modify the fire protection design organization, and send it to the fire control institution of the public security organ for review. After examination, if the fire protection design meets the mandatory requirements of the national technical standards for fire protection in engineering construction, the fire control institution of the public security organ shall issue a written examination opinion and notify the construction unit to resume construction.

Twenty-eighth fire control institutions of public security organs find that the construction unit violates the mandatory requirements of fire control laws and regulations and the national technical standards for fire control in engineering construction or reduces the quality of fire control construction, and shall notify the construction unit in writing to make corrections within five days.

After receiving the notice, the construction unit shall stop using it and apply to the fire control institution of the public security organ for review after rectification. If it meets the requirements after examination, the fire department of the public security organ shall issue a written examination opinion and notify the construction unit to resume its use.

Twenty-ninth fire design and completion acceptance of construction projects are not reported to the fire control institutions of public security organs for the record according to law, and the fire control institutions of public security organs shall be punished according to law, and the construction unit shall be ordered to put on record within five days and be included in the scope of spot checks; If the record is not filed within the time limit, the fire control institution of the public security organ shall notify the construction unit within five days from the date of expiration of the record period and order it to stop construction and use.

According to this regulation, if your company's nature conforms to the scope stipulated in Article 13 or Article 14 of Chapter III of the Regulations on Supervision and Management of Fire Protection in Construction Projects, it belongs to the scope of compulsory examination and inspection, that is, the employer (your company) must declare the fire protection design audit and fire protection completion acceptance to the local fire department.

In addition, according to Article 15 of the Fire Protection Law, before the public gathering place is put into use or business, the construction unit or the user unit shall apply to the fire department of the public security organ of the local people's government at or above the county level for fire safety inspection. According to this regulation, if your company belongs to the nature of public gathering place, you need to apply for fire safety inspection to the fire department of the public security organ of the local people's government at or above the county level before putting it into use and business.

Whether to declare fire-related examination and approval procedures, I suggest you consult the local fire department first.

In addition, by the way, if the fire department finds out that it is necessary to go through fire control procedures in accordance with relevant regulations, your company will bear the following legal responsibilities (see the liability clause of the Fire Protection Law for details):

Chapter VI Legal Liability

Article 58 Whoever, in violation of the provisions of this Law, commits any of the following acts shall be ordered to stop construction, stop using or stop production and business, and be fined between 30,000 yuan and 300,000 yuan:

(a) the construction project that should be audited by the fire control institution of the public security organ according to law, and the construction is carried out without approval according to law or unqualified;

(two) the fire protection design has not been accepted by the fire department of the public security organ according to law, and the construction has not stopped;

(three) the construction project that should be subject to fire inspection according to law has not been put into use without fire inspection or fire inspection is unqualified;

(four) after the construction project is put into use, the fire department of the public security organ fails to pass the spot check according to law and does not stop using it;

(five) the public gathering place without fire safety inspection or inspection does not meet the requirements of fire safety, unauthorized use, business.

If the construction unit fails to report the fire control design documents to the fire control institutions of public security organs for the record according to the provisions of this law, or fails to report them to the fire control institutions of public security organs for the record according to the provisions of this law after completion, it shall be ordered to make corrections within a time limit and be fined not more than 5,000 yuan.
