Regulations of Daqing Municipality on Property Management

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of all parties involved in property management, and improve the living and working environment of the people, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to property management and related supervision and management activities within the administrative area of this Municipality. Article 3 Property management shall adhere to the principles of honesty according to law, owner autonomy, professional service and government supervision. Article 4 The municipal administrative department of property management shall be responsible for the unified supervision and management of property management activities in this Municipality, and the county (district) administrative department of property management shall be responsible for the supervision and management of property management activities within its jurisdiction.

Other relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in property management.

Sub-district offices and Township People's governments shall, in accordance with the prescribed duties, do a good job in property management within their respective jurisdictions.

The residents' (villagers') committee shall assist the neighborhood offices and the Township People's governments in property management. Article 5 Property management industry associations shall strengthen the self-discipline management of the industry, standardize their practices, and promote the honest operation of property service enterprises according to law. Chapter II Owners, Owners' Congress and Owners' Committee Article 6 In case of any of the following circumstances within the property management area, the construction unit shall inform the neighborhood offices or township people's governments where the property is located in writing within 15 days, and submit the filing materials of property management area division, the list of houses and buildings, the list of owners, the general plan of building planning, the delivery certificate of facilities and equipment, the configuration certificate of property management houses and other documents:

(a) the area of the exclusive part of the house that has been sold and delivered for use has reached more than 50% of the total construction area;

(two) the number of houses that have been sold and delivered for use has reached more than 50% of the total number;

(three) the first set of housing has been sold and delivered for two years, and the number of housing sold and delivered for use has reached more than 25% of the total number. Seventh owners to prepare for the establishment of the owners' meeting, it shall inform the neighborhood offices or Township People's governments where the property is located in writing.

In accordance with the provisions of Article 6 of this Ordinance, the subdistrict office or the Township People's Government shall, jointly with the county (district) property management administrative department, guide and assist the establishment of the preparatory group for the first owners' meeting within 60 days from the date of receiving the written notice from the owners. Article 8 The preparatory group for the first meeting of the owners' congress consists of the owners' representatives, the construction unit, sub-district offices or township people's governments and residents' (villagers') committees. The number of members of the preparatory group shall be odd, and the proportion of owners' representatives shall not be less than 50% of the total number of members of the preparatory group. The head of the preparatory group shall be a representative of the sub-district office or the Township People's Government. The owner's representative is recommended by the sub-district office or the Township People's Government.

The preparatory group shall, within seven days from the date of its establishment, publicize the list of members in a prominent position in the property management area for not less than seven days. Owners have objections to the members of the preparatory group, which shall be handled by the sub-district office or the Township People's Government. Ninth the preparatory group for the first owners' meeting shall complete the preparatory work within 90 days from the date of its establishment and organize the first owners' meeting.

The first meeting of the owners' congress shall put the voting management statute, the rules of procedure of the owners' congress and the elected owners' committee on the agenda.

After the first owners' meeting, the preparatory group will be dissolved automatically. If the preparatory group fails to complete the preparatory work within 90 days, the subdistrict office or the Township People's Government shall announce the dissolution of the preparatory group in writing. Article 10 The owners' congress may adopt the form of collective discussion and written comments. However, there should be owners whose exclusive parts account for more than half of the total construction area and more than half of the total number of owners in the property management area.

Need to vote, the voting results and decisions of the owners' congress shall be publicized in a prominent position in the property management area for not less than seven days. Every owner's opinion should be filed. Article 11 The owners' committee is elected by the meeting of the owners' congress and consists of five to eleven members.

The owners' committee shall, within 30 days from the date of election, file with the neighborhood office where the property is located or the township people's government or the county (district) property management administrative department according to law. If the filing materials are complete, the relevant filing authorities shall file them within seven days from the date of receiving the filing materials.

Where the record items are changed, the owners' committee shall, within 30 days from the date of change, handle the change record with the original record-keeping organ. Twelfth members of the owners' committee shall be the owners of the property management area, and meet the following conditions:

(1) Having full capacity for civil conduct;

(2) Abide by the relevant laws and regulations of the state;

(three) abide by the rules of procedure and management regulations of the owners' congress, and perform the obligations of the owners according to law;

(four) enthusiastic about public welfare undertakings, strong sense of responsibility, fairness and decency;

(5) Having certain organizational ability;

(6) Having necessary working hours.

Encourage eligible residents (villagers) committee members to participate in the election of members of the owners' committee.
