Regulations of Hangzhou Municipality on Property Management Chapter IV Property Use and Maintenance
The construction unit shall formulate a temporary management agreement before selling the property as an annex to the property sales contract. After the establishment of the owners' congress, the owners' congress shall formulate a management statute. The model text of the temporary management statute and the management statute shall be formulated by the municipal real estate department.
Forty-second the following acts are prohibited in the use of property:
(a) illegal demolition, change the load-bearing structure of the house;
(2) Changing rooms or balconies without waterproof requirements into bathrooms and kitchens, or changing bathrooms above bedrooms, living rooms (halls), study rooms and kitchens of lower-level households into bathrooms;
(three) illegal construction and renovation of buildings and structures; Illegal excavation of underground space of houses;
(four) unauthorized changes in the use of housing or the use of supporting facilities for other purposes;
(five) changing the facade of the house without authorization;
(six) mixing rainwater and sewage or taking over the drainage pipeline without authorization; Damage to pipeline gas facilities, occupation, blockage and plugging of pipeline facilities affect public safety;
(seven) unauthorized occupation of green space, damage to trees and green facilities;
(eight) damage to fire control facilities, occupation, blockage, closure of fire exits, fire climbing surfaces and other fire sites;
(nine) in violation of state and local regulations, discharge pollutants into the environment;
(10) occupies * * * parts and * * * facilities and equipment;
(eleven) other acts prohibited by laws and regulations.
In violation of relevant laws and regulations on the use of property, the property service enterprise shall promptly discourage and stop, and report to the relevant departments and the owners' committee, and the owners' committee shall promptly deal with it in accordance with the relevant provisions.
Forty-third owners or non-owners should inform the property service enterprises in advance, and go through the formalities in accordance with the relevant provisions of the property decoration. The realty service enterprise shall supervise the property decoration activities of the owners or non-owners, and the owners shall cooperate.
Forty-fourth before the establishment of the owners' congress, the charging standard for parking vehicles in the property management area shall be implemented in accordance with the provisions of the competent price department. After the establishment of the owners' congress, the management system of vehicle driving, parking and charging in the property management area shall be formulated by the owners' congress. If the owners' congress decides to charge for vehicle parking, it shall determine the charging standard. If the owner has custody requirements for the vehicle, the owner and the property service enterprise shall sign a custody contract separately.
Forty-fifth before the property is delivered for use, the construction unit shall hand over facilities and equipment such as water supply, power supply, gas supply, heating, communication and cable TV in accordance with regulations. After acceptance, it shall be managed by relevant professional units and handed over to relevant technical data. Relevant professional units should receive it in time. When the property is delivered for use, the construction unit shall publicize the transfer of relevant facilities and equipment to professional units for management.
Upon receipt, professional units shall timely repair, update and maintain relevant facilities and equipment to ensure the safe operation and normal use of relevant facilities and equipment in the property management area.
Professional units such as water supply, power supply, gas supply, heating, communication and cable TV in the property management area shall charge relevant fees to the end users. Where a professional unit entrusts a realty service enterprise to collect and remit related expenses and carry out routine maintenance on related facilities and equipment, both parties shall sign an entrustment agreement to clarify the main matters entrusted and the standards and methods of payment. If the entrustment agreement is not signed, the professional unit shall be responsible for the relevant work.
Forty-sixth property maintenance, renovation, renovation costs after the expiration of the warranty period, in accordance with the following provisions:
(a) special parts and special facilities and equipment, including property parts, facilities, equipment and sites that are independent in structure and use and are independently used and disposed of by a single owner, and the maintenance, renewal and transformation costs shall be borne by the owner or non-owner users;
(II) Parts and facilities used by * * (excluding water supply, power supply, gas supply, heat supply, communication, cable TV and other facilities and equipment), including property parts, facilities and sites used and managed by all owners * *, and the maintenance, renewal and renovation costs shall be borne by the relevant owners according to the proportion of their respective property construction areas. If the damage is man-made, the maintenance cost shall be borne by the responsible person.
Property maintenance, update, the relevant owners, non-owners should cooperate. Water supply, power supply, gas supply, sanitation, civil air defense and other professional units need to enter the property management area to carry out related operations, property service enterprises and related owners and non-owners should cooperate.
Article 47 When transferring or leasing the property, the owner shall inform the transferee or lessee of the temporary management agreement, management agreement, property service charging standard and other matters, and make a clear agreement on the settlement of property service fees. The transferee shall, within 30 days from the date of handling the property right transaction procedures, inform the property service enterprise and the owners' committee of the transfer of property rights, the name and contact information of the owners.
Owners can stipulate the number limit and per capita area standard for renting a single house in the property management area in the temporary management statute, management statute or the rules of procedure of the owners' meeting.
