Can I refuse to pay the property fee if the property is not ready?

Property omission can be exempted from paying property fees for the following specific reasons:

1. Property services shall be carried out in accordance with the contract. If the property management does not conform to the contract, it is a breach of contract, and the property fee can be refused.

2. However, there must be evidence of the inaction of the property management, and only the property fees for the inaction of the property management can be rejected, and all the property fees cannot be rejected;

3. When the owner has evidence to prove that the property service provided by the property service enterprise is in breach of contract, such as the service is not in place, or even the property management enterprise does not provide the corresponding service at all, in view of the gap between the property service provided by the property management enterprise and the service quality and agreed standards, then, according to the principle of consistency of rights and obligations, the corresponding property service fee should be deducted as appropriate.

The solutions to property inaction are as follows:

1. Complain to the owners' committee and record the inaction of the property, so that members can urge the property to solve the owners' problems in time. If the property is invalid for many times, the owners' committee can change the property company through the process;

2 to complain to the street housing management department or the government street office, the property management department of the housing management bureau and other departments. Because the owners' committee has been established for a long time, some new residential buildings have not been established in time. In order to urge the property to solve problems for the owners, it is necessary to complain to the relevant departments.

Legal basis: Article 34 of the Regulations on Property Management.

The owners' committee shall conclude a written realty service contract with the realty service enterprise selected by the owners' congress.

Property service contracts shall stipulate property management matters, service quality, service fees, rights and obligations of both parties, management and use of special maintenance funds, property management premises, contract term, liability for breach of contract, etc.
