Chapter IV of Several Provisions of Hefei Municipality on Property Management

Thirty-fourth before the signing of the property service contract, the owners' committee shall publicize the property service contract to be signed in the property management area, fully listen to the opinions of the owners, and then submit it to the owners' meeting for adoption. If the contents of the realty service contract need to be changed, the owners' committee shall publicize the changed contents within the realty management area, and confirm the contract change according to the procedures stipulated by the owners' congress.

The publicity time specified in the preceding paragraph shall not be less than ten days.

The owners' committee shall refer to the model text of the realty service contract formulated by the municipal real estate administrative department and sign a written realty service contract with the realty service enterprise selected. When signing the contract, it shall issue the decision of the owners' meeting to hire or renew the realty service enterprise and the legal proof of the owners' committee.

The realty service enterprise shall, within fifteen days from the date of signing the contract, report the realty service contract to the county (city), the district real estate administrative department, the subdistrict office and the Township People's government for the record.

Article 35 The realty service enterprise shall clearly mark the price, and publicize the service contents, service standards, charging items, charging standards and other relevant information in a prominent position in the realty management area.

The realty service enterprise may, according to the entrustment of the owner, provide services other than those stipulated in the realty service contract, and the service remuneration shall be determined by both parties through consultation.

Article 36 A realty service enterprise shall provide realty service in accordance with the stipulations in the realty service contract and relevant provisions. If it is not provided in accordance with the agreement or regulations, the owner has the right to ask the property service enterprise to provide it, and may complain to the county (city), district real estate administrative department or subdistrict office or township people's government; County (city), district real estate administrative departments or neighborhood offices, Township People's governments shall promptly deal with them.

The owner shall pay the property service fee in full and on time. Failing to pay in full and on time, the realty service enterprise can publicize the list of owners in arrears and the arrears within the realty management area.

Article 37 Where the realty service contract is terminated in advance, the party proposing to terminate the contract shall notify the other party in writing 90 days before the termination of the contract, make an announcement within the realty management area, and notify the county (city), district real estate administrative department, subdistrict office, township people's government, residents' committee and villagers' committee in writing.

Article 38 If both parties fail to renew the contract or terminate the contract in advance due to the expiration of the property service contract, and the owners' meeting fails to select a new property service enterprise 30 days before the expiration or early termination of the contract, it shall do a good job in the handover of property services in accordance with the following procedures:

(a) the owners' committee or the realty service enterprise shall inform the county (city), the district real estate administrative department, the subdistrict office and the Township People's government in writing within two days.

(II) Sub-district offices and Township People's governments shall, within five days after receiving the written notice from the owners' committee or the realty service enterprise, listen to the opinions of the owners' committee, the owners' representatives and the realty service enterprise on the selection of a new realty service enterprise in conjunction with the county (city) and district real estate administrative departments, residents' committees and villagers' committees, and make good coordination and communication on the continued management of services.

(III) Sub-district offices, township people's governments, residents' committees and villagers' committees shall actively assist the owners' assembly in selecting new realty service enterprises, and guide the owners' committee to sign realty service contracts with the new realty service enterprises; County (city), district real estate administrative departments should take the initiative to provide relevant information to assist in the selection work.

If the realty service enterprise withdraws from the realty service, and the owners' meeting still fails to select a new realty service enterprise, the subdistrict office and the township people's government shall inform the county (city) and district real estate administrative departments in writing of the relevant situation, and designate qualified realty service enterprise organizations, select those with good credit records and good performance from the list of emergency realty service enterprises provided by the municipal real estate administrative departments to do basic services such as cleaning, garbage removal, security and greening maintenance, and continue to urge or organize the owners' meeting to select realty service enterprises.

Article 39 When the term of the realty service contract expires and the owners' meeting fails to make a decision on hiring or renewing employment, and the original realty service enterprise voluntarily continues to provide services in accordance with the original realty service contract, the realty service contract will be automatically renewed until the owners' meeting makes a decision on hiring or renewing employment.

Fortieth after the dissolution or termination of the realty service contract, the realty service enterprise shall perform the following handover obligations with the owners' committee in accordance with the provisions of laws and regulations and the contract:

(1) handing over the materials specified in Article 27 of these Provisions;

(two) the transfer of property services during the transformation, maintenance, operation and maintenance of facilities and equipment related information and property services files;

(three) the property service room and the location and facilities of the property;

(four) the liquidation expenses and the transfer of relevant account books and bills;

(five) the withdrawal of service personnel from the property management area;

(six) other matters that should be handed over as stipulated by laws and regulations.

Without going through the handover procedures, the realty service enterprise shall not leave the realty management area or stop the realty service.
