How long can I repossess my house if I default on my rent?
Legal analysis: a landlord who fails to pay the rent for one month has the right to take back the house. As long as the lessee delays the payment of rent without justifiable reasons or force majeure events, the lessor may claim to terminate the lease contract and recover the rented house according to the stipulations of the lease contract, or may require the lessee to pay liquidated damages in the amount or payment method agreed in the lease contract.
Legal basis: Article 730th of the Civil Code of People's Republic of China (PRC). If the term of the lease is not stipulated or clearly stipulated by the parties, and cannot be determined according to the provisions of Article 510 of this Law, it shall be regarded as an indefinite lease. The parties may terminate the contract at any time, but shall notify the other party before a reasonable period.
