Regulations of Urumqi Municipality on Property Management (20 1 1 Revision)

Chapter I General Provisions Article 1 In order to standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, and create a good living and working environment, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Regulations on Property Management of the State Council and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the management, use, maintenance, service and supervision of property within the administrative area of this Municipality. Article 3 The term "property management" as mentioned in these Regulations refers to the activities in which the owner selects a property service enterprise, and the owner and the property service enterprise carry out maintenance, conservation and management of the house, supporting facilities, equipment and related sites in accordance with the provisions of the property service contract, so as to maintain the environmental sanitation and related order in the property management area. Fourth city real estate administrative departments responsible for the unified supervision and management of the city's property management activities.

The district (county) real estate administrative department is responsible for the supervision and management of property management activities within its jurisdiction, and accepts the supervision and guidance of the municipal real estate administrative department in business.

Development and reform, finance, construction, land and resources, planning, municipal appearance, industry and commerce, public security, civil affairs, gardens, environmental protection, administrative comprehensive law enforcement and other departments shall, according to their respective responsibilities, cooperate in the supervision and management of property management. Article 5 Sub-district offices and township people's governments shall be responsible for organizing and guiding the establishment of the owners' congress and the general election of the owners' committee within their respective jurisdictions, and supervising the owners' congress and the owners' committee to perform their duties according to law. Article 6 The community residents' committee shall participate in the preparatory work for the first owners' meeting, guide and supervise the work of the owners' committee, and mediate property management disputes in the community according to law.

If the owners' committee is not elected due to objective reasons or the number of members of the owners' committee is less than half of the total number, before the election of the new owners' committee, the community residents' committee where the property is located can act as the owners' committee under the guidance of the subdistrict office and the township people's government. Chapter II Owners, Owners' Congress and Owners' Committee Article 7 The owner of a house is the owner.

Owners enjoy the following rights in property management activities:

(a) in accordance with the provisions of the realty service contract, accept the services provided by the realty service enterprise;

(two) proposed to convene a meeting of the owners' congress, and put forward suggestions on matters related to property management;

(three) put forward suggestions on formulating and amending the management statute and the rules of procedure of the owners' congress;

(four) to participate in the owners' meeting and exercise the right to vote;

(five) to elect members of the owners' committee and enjoy the right to be elected;

(six) to supervise the work of the owners' committee;

(seven) to supervise the realty service enterprise to perform the realty service contract;

(eight) the right to know and supervise the use of * * * parts of the property, * * facilities and equipment and related sites;

(nine) to supervise the management and use of special maintenance funds for * * * parts of the property and * * * facilities and equipment;

(ten) other rights stipulated by laws and regulations. Eighth owners in the property management activities, fulfill the following obligations:

(a) abide by the management regulations and the rules of procedure of the owners' congress;

(two) abide by the rules and regulations of the use of * * * parts and facilities, the maintenance of public order and environmental sanitation in the property management area;

(three) to implement the decisions of the owners' congress and the decisions of the owners' committee authorized by the owners' congress;

(four) in accordance with the relevant provisions of the state to pay special maintenance funds;

(five) to pay the property service fee on time;

(six) other obligations stipulated by laws and regulations. Article 9 All owners in the property management area form the owners' meeting.

The division of property management areas shall be determined by the municipal real estate administrative department according to the scope of state-owned land use rights, taking into account the factors such as property facilities and equipment, building scale, community construction and urban road planning.

Owners in the same property management area shall set up owners' meetings and elect owners' committees under the guidance of the neighborhood offices or township people's governments where the property is located. If there is only one owner, or the number of owners is small, and all the owners agree to decide not to set up the owners' meeting, the owners shall jointly perform the duties of the owners' meeting and the owners' committee. Tenth property management area, the new property has been delivered for use in any of the following circumstances, the first owners' meeting shall be held:

(a) the exclusive part of the delivery of the construction area reached more than 50% of the total construction area and the owner occupancy rate reached more than 50%;

(two) two years from the date of the first owner's occupancy and the occupancy rate of the owner has reached more than 25%. Eleventh property management area in accordance with the provisions of article tenth of this Ordinance, the development and construction unit shall promptly submit a written application to the neighborhood offices or Township People's governments where the property is located, and make an announcement in the property management area. If the development and construction unit fails to submit a written application for the preparation of the owners' meeting in time, the owners may submit a written application for the preparation of the owners' meeting to the neighborhood office or the township people's government where the property is located. Twelfth street offices or Township People's governments shall, within 60 days from the date of receiving the written application for the preparation of the owners' meeting, be responsible for organizing and guiding the establishment of the preparatory group for the first owners' meeting. The preparatory group shall complete the preparatory work within 90 days from the date of composition, and organize the first owners' meeting.
