Provisions of Shenzhen Municipality on the Administration of Installation and Use of Air Conditioning Equipment
In order to ensure public safety, maintain a clean and tidy city appearance and protect the environment, these Provisions are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality.
Article 2 (Definitions)
The air conditioning equipment mentioned in these Provisions refers to window air conditioners, split air conditioners, cabinet air conditioners, outdoor units of central air conditioning systems, cold (hot) water units and other auxiliary facilities and installation racks.
Article 3 (Scope of Application)
These Provisions shall apply to the installation, use, supervision and management activities of air-conditioning equipment within the scope of this Municipality.
Article 4 (Administrative Department)
The Municipal Construction and Transportation Commission and the district and county construction departments are responsible for the supervision and management of the installation and use of air-conditioning equipment in new houses.
Article 5 (Construction Requirements for Newly Built Houses)
Newly-built houses must be provided with seats specially used for installing air-conditioning equipment (hereinafter referred to as "air-conditioning equipment seats"), air-conditioning condensate pipes (including defrosting water, the same below) or balcony drainage systems for receiving air-conditioning condensate water (hereinafter referred to as "air-conditioning condensate water") in accordance with the requirements of the National Residential Design Code (GB50096- 1999) and Shanghai Residential Design Code. The number and size of air conditioning equipment seats should match the number and area of rooms.
In addition to the central air-conditioning system, commercial office buildings should be provided with air-conditioning equipment seats and air-conditioning condensate drainage pipes, and the specific standards shall be stipulated separately by the Municipal Construction and Transportation Commission.
When reviewing the construction drawings and design documents, the review institution shall also review the design of the seat plate of air conditioning equipment. After examination and approval, the competent department of construction may issue a construction permit.
When organizing the final acceptance, the construction unit shall also accept the seat plate of air conditioning equipment and the condensate drainage pipeline of air conditioning; Air-conditioning equipment seat plate and air-conditioning condensate drain pipe can be delivered only after they are qualified.
Article 6 (Requirements for Renovation of Old Houses)
When undertaking the comprehensive renovation of old houses and the renovation of houses, the construction unit shall uniformly set up air-conditioning condensate drainage pipes; Conditional, should be unified set air conditioning equipment seats.
Article 7 (Supplier's Installation Obligation)
Air-conditioning equipment suppliers shall assign professional air-conditioning equipment installers or entrust professional air-conditioning equipment installation enterprises to provide air-conditioning equipment installation services for users who purchase air-conditioning equipment, and provide air-conditioning equipment installation instructions to users.
The strength and corrosion resistance of air-conditioning equipment mounting brackets and fasteners provided by air-conditioning equipment suppliers shall meet the national standards, and the service life shall not be less than the design service life of air-conditioning equipment. The air conditioning equipment supplier shall be responsible for the safety of the installation brackets and fasteners provided.
Article 8 (Training of Installation Personnel)
Air-conditioning equipment suppliers and air-conditioning equipment professional installation enterprises should strengthen on-the-job training for installation personnel. Installation personnel must be trained and qualified before they can take up their posts.
Article 9 (Obligation of Users of Air Conditioning Equipment to Install by themselves)
Users of air-conditioning equipment shall hire professional installers to install air-conditioning equipment by themselves.
Article 10 (Requirements for Installation of Air Conditioning Equipment)
The installation of air conditioning equipment shall meet the requirements of the national standard "Code for Installation of Room Air Conditioners" (GB 17790- 1999).
If the air-conditioning equipment seat plate and air-conditioning condensate drainage pipeline have been set, the air-conditioning equipment should be installed on the air-conditioning equipment seat plate, and the discharge of air-conditioning condensate should be included in the air-conditioning condensate drainage pipeline.
There is no air-conditioning condensate drainage pipeline, and the discharge of air-conditioning condensate shall not interfere with the normal work and life of others. The air-conditioning condensate of buildings on both sides of the road (including both sides of public passages in neighborhoods and alleys) shall not be directly discharged to the external walls of buildings or outdoor ground on one side of the road.
When installing air conditioning equipment, effective measures should be taken to reduce the noise generated by installation.
Article 11 (Installation Height of Air Conditioning Equipment on Both Sides of Road)
Installation of air conditioning equipment shall not occupy the sidewalk.
When installing air-conditioning equipment on buildings on both sides of the road, safety protection measures must be taken, and the height of the bottom of the air-conditioning equipment installation rack from the outdoor ground shall not be less than 1.9 meters.
Article 12 (Distance between Air Conditioning Equipment and Adjacent Parties and Opposite Parties)
Air conditioning equipment should be installed as far away from adjacent square doors and windows as possible.
The nearest distance between the air outlet center of air conditioning equipment and the inherent doors and windows of the opposite house shall not be less than the following provisions:
(a) the rated electric power of refrigeration is less than 2 kilowatts, which is 3 meters;
(two) the rated cooling power is more than 2 kilowatts but less than 5 kilowatts for 4 meters;
(three) the rated refrigeration power is more than 5 kilowatts but less than 10 kilowatts for 5 meters;
(four) the rated cooling power 10 kW and less than 30 kW is 6 meters;
(5) If the rated refrigeration power is above 30 kW, it shall be calculated as an increase of 1 m for each increase of 20 kW.
If the distance specified in the preceding paragraph cannot be reached due to objective conditions, other measures shall be taken to protect the rights and interests of the other party, and installation can only be carried out after the consent of the other party.
Article 13 (Combined Calculation of Rated Refrigeration Electric Power)
If the same unit or individual installs multiple air-conditioning equipment on the same facade, and the spacing is less than 1 m, the rated cooling power shall be calculated together.
Article 14 (Restrictions on Installation of Air Conditioning Equipment in Buildings)
It is forbidden to install air conditioning equipment in walkways, stairs and exits of buildings.
Article 15 (Provisions on the Protection of Outstanding Historical Buildings and Cultural Relics Protection Units)
Installing air-conditioning equipment within the protection scope of outstanding historical buildings or cultural relics protection units in this Municipality must comply with the relevant provisions on the management of outstanding historical buildings and cultural relics protection units.
Article 16 (Obligation of Users of Air Conditioning Equipment to Use Safely)
Users of air-conditioning equipment shall not add other loads to air-conditioning equipment, and shall regularly check and maintain the safety of air-conditioning equipment.
In any of the following circumstances, users of air conditioning equipment shall take timely measures to eliminate potential safety hazards:
(a) air conditioning equipment exceeds the design service life;
(two) air conditioning equipment installation frame and fasteners appear loose or seriously corroded;
(3) The realty service unit informs the users of air-conditioning equipment that the installation frame and fasteners of air-conditioning equipment are loose or seriously corroded.
Article 17 (Obligation of Air Conditioning Equipment Users to Prevent Noise)
The noise generated by users of air-conditioning equipment using air-conditioning equipment shall conform to the relevant environmental noise standards of the state and this Municipality; If it exceeds the prescribed standard, it shall stop using it and take effective measures such as maintenance to reduce noise pollution.
Article 18 (Obligations of Property Service Units)
Newly-built houses shall be uniformly provided with air-conditioning equipment seats and air-conditioning condensate drain pipes, and the realty service unit shall urge the users of air-conditioning equipment to install air-conditioning equipment on the air-conditioning equipment seats and incorporate the discharge of air-conditioning condensate into the air-conditioning condensate drain pipes.
The realty service unit shall check the safe use of air-conditioning equipment in the realty service area at least once a year. The realty service unit shall inform the users of the inspection results in a timely manner, prompting the users to strengthen the safety inspection and eliminate potential safety hazards.
The realty service unit may accept the entrustment of the owner, and increase the service content to ensure the safe use of air-conditioning equipment in the realty service, and the service price shall be agreed by both parties.
Article 19 (Owners' Convention)
The preliminary realty service unit or the owners' committee may, according to the actual situation of the realty service area, make corresponding agreements on the installation of residential air-conditioning equipment in the owners' convention concluded or revised.
Article 20 (Settlement of Disputes)
Disputes arising from the installation and use of air-conditioning equipment may require the realty service unit to mediate; You can also apply to the neighborhood offices, township (town) people's governments or neighborhood (village) committees for mediation.
If it is found that the installation and use of air conditioning equipment violates these provisions or other relevant laws, regulations and rules, it may complain to the relevant administrative departments.
After receiving the complaint, the administrative department shall handle it in time and inform the complainant of the result.
Article 21 (Penalties for Users of Air-conditioning Equipment Violating the Obligation of Safe Use)
In violation of the provisions of the second paragraph of article tenth, fourteenth, sixteenth, air conditioning equipment users have one of the following acts, the city or district, county real estate department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than 5,000 yuan may be imposed on 500 yuan:
(1) Failing to install air-conditioning equipment on the uniformly arranged air-conditioning equipment seat board, or failing to incorporate the discharge of air-conditioning condensate into the air-conditioning condensate drainage pipeline;
(2) installing air-conditioning equipment in walkways, stairs, exits and other parts of buildings;
(3) Adding other loads to air-conditioning equipment, causing potential safety hazards;
(four) the air conditioning equipment exceeds the design life, or the installation frame and fasteners of air conditioning equipment are loose or seriously corroded. , did not take timely measures to eliminate potential safety hazards.
Article 22 (Penalties for Environmental Hazards of Air Conditioning Equipment Users)
In violation of the provisions of the third paragraph of Article 10, the second paragraph of Article 11, the second paragraph of Article 12, the third paragraph of Article 12, Article 17, air-conditioning equipment users have one of the following acts, the municipal or district/county environmental protection department shall order them to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than 5,000 yuan may be imposed on 500 yuan:
(a) air conditioning condensate discharge does not meet the requirements;
(two) the installation of air conditioning equipment in violation of the provisions of the installation height;
(three) in violation of the provisions of the installation distance of the other party and without the consent of the other party to install air conditioning equipment;
(four) in violation of the provisions on the prevention and control of noise pollution.
