Measures of Nanning Municipality on Property Management
The departments responsible for real estate management of county and urban people's governments (hereinafter referred to as "county and district housing management departments") are specifically responsible for the guidance, supervision and management of property management activities within their respective jurisdictions.
Planning, construction and other relevant administrative departments shall, within the scope of their respective duties, be responsible for the guidance and supervision of related activities in the property management area. Fourth in the property management area, the establishment of county, district housing management departments, street offices, township people's governments, community residents' committees, owners' committees, property service enterprises to participate in the joint meeting system.
The joint meeting is convened and presided over by the county housing management department, which mainly coordinates and solves difficult problems in property management.
In any of the following circumstances, a joint meeting shall be held:
(a) involving the public interest in the property management area, but the owners' meeting can not make an effective decision;
(two) the owners' committee fails to perform its duties according to law;
(three) the realty service enterprise does not operate according to law, which damages the legitimate rights and interests of the owners, and the owners' committee requests coordination;
(four) other circumstances that affect the stability of the property management area. Fifth county and district housing management departments shall establish a complaint acceptance and dispute mediation system, and timely handle the complaints and disputes of owners, owners' committees, property users and property service enterprises in property management activities. Chapter II Owners and Owners' Congress Article 6 The owner recorded in the house ownership certificate is the owner.
If the legal buyer of the house has not registered the property right, but has actually occupied and used it, it shall be regarded as the owner.
The house that has not been delivered for use is regarded as the owner by the construction unit. Article 7 Owners shall enjoy rights and perform obligations in property management activities according to law. Article 8 The owners' meeting is composed of all owners in the property management area, and shall be established as of the date of the first owners' meeting.
The owners' congress represents and safeguards the legitimate rights and interests of all owners in the property management activities within the property management area. The first property management area in Kujou Hajime established the owners' meeting. However, if there is only one owner, or if the number of owners is small and all owners agree unanimously, it is decided not to set up the owners' meeting, and the owners will jointly perform the duties of the owners' meeting and the owners' committee. Tenth property management area is determined in principle according to the scope delineated in the general plan.
Where two or more adjacent property management areas are connected by roads, and main facilities and equipment are used, and unified management is convenient for property management and owners' use, with the consent of the owners' meeting in adjacent areas, and after soliciting the opinions of civil affairs, public security and other departments, the municipal real estate administrative department can delimit it as a property management area according to the facilities and equipment used by the property, construction scale, community construction and other factors.
A property management area with a total construction area of over 500,000 square meters and independent facilities and equipment functions, which is convenient for property management and owners to use separately, shall be applied by the construction unit before the property is sold, and the municipal real estate administrative department may delimit more than two property management areas after soliciting the opinions of civil affairs and public security departments. Eleventh the number of owners' voting rights shall be determined according to the construction area of the exclusive part of the property owned by the owners and the number of owners.
For the first owners' meeting, in principle, the property construction area shall be calculated as 1 m2, and the part less than 1 m2 shall be rounded off. Each industry presides over 1 vote, indicating the exclusive part of the property construction area. * * * If the owner or the same owner owns multiple property rights, it shall be counted as one owner. Article 12 In the property management area, if the construction area of the property delivered for use reaches more than 50% and more than 20% of the owners apply in writing for the establishment of the owners' meeting, the county and district housing management departments, sub-district offices and township people's governments shall guide the property management area to establish the owners' meeting. Thirteenth in line with the conditions for the establishment of the owners' congress, the county and district housing management departments where the property is located shall, within 20 working days after receiving the written application, guide the owners to set up a preparatory group for the owners' congress, with an odd number of 5- 15 members, responsible for the following preparatory work:
(a) to determine the time, place, form and content of the owners' meeting;
(two) with reference to the model text formulated by the municipal real estate administrative department, draft the rules of procedure and management statute of the owners' congress;
(three) to confirm the identity of the owner and the exclusive part of the property construction area;
(four) the method and list of the candidates for the members of the owners' committee;
(five) other preparations for the owners' meeting.
The matters specified in the preceding paragraph shall be announced in writing in the property management area before the first meeting of the owners' congress 15, and the announcement time shall not be less than 5 days.
No other organization or individual may carry out activities in the name of the preparatory group for the owners' meeting.
