Rights and obligations are two kinds of reciprocal relations, and either party should bear corresponding obligations while enjoying rights. If the owner has a harmonious relationship with the property service enterprise in the property management activities and fully enjoys the rights, he is also willing to undertake the corresponding obligations. (4) Dealing with the relationship between them is conducive to preventing and reducing disputes. The property service is very good and the relationship between the two parties is harmonious. Owners will naturally not make trouble without reason. If they have something to find, the property will not only do their duty, but also try their best to help, so there will be no property disputes. (5) Dealing with the relationship between the two is conducive to promoting the unity of both sides. The so-called one party is in trouble and all parties support it. When the owner is in trouble, the property owner makes timely efforts. On the other hand, enthusiastic owners of property service enterprises will not sit on the sidelines when they encounter any problems. Second, the main problems existing in the relationship between property service enterprises and owners. As a new type of industry, property service is gradually emerging in the tertiary industry. As a service industry, profit is naturally the primary goal of property service enterprises; However, around the respective interests of property service enterprises and owners, the two sides are bound to be contradictory. Relevant data show that among the 3,077 residential property services projects in Beijing, only 360 have established owners' meetings according to the Property Services Ordinance, accounting for only 1 1.7% of residential projects. The whole industry is mixed, and some property service companies have poor service concepts, charging first, blindly pursuing short-term interests and neglecting services to owners, which constantly cause owners' dissatisfaction with property services. Question 4: Property disputes are difficult to solve. The responsibilities and rights among owners, property service enterprises and developers are unclear. Some property services companies and developers have a mother-child relationship. Many property service companies charge a certain decoration deposit when the owners and decoration companies come to handle the decoration formalities, so as to limit and facilitate the management of the related behaviors of the decoration companies and owners. Owners and decoration companies refuse to pay because they think it is illegal, but enterprises think there are laws to follow according to their regulations. In fact, both sides have their own reasons. In order to standardize the behavior of decoration companies and better ensure the quality, property service companies charge a certain fee according to the provisions of relevant laws to achieve the role of restriction; The owner and the decoration company refused to pay because there is no legal provision to charge this fee. If China has a complete legal provision on property services, the above examples will be reduced a lot. Mutual benefit is the fundamental interest of both sides. As a property service enterprise, we should treat the interests of the owners correctly, put the interests of the owners first, and avoid short-term behavior of pursuing realistic interests. Efforts should be made to improve the service quality and management level, upgrade the service level and promote the "brand" effect. It is necessary to affirm and establish the idea of "the owner is supreme" in the staff's mind, and treat and deal with the owner's demands seriously. At the same time, we should make great efforts to improve the quality of front-line employees, use all the resources of enterprises as support, encourage employees to communicate effectively with owners, and leave a good impression on owners. To provide those services, what standard the service level reaches and what management service objectives are achieved, it should be compatible with the comprehensive ability of the enterprise, and must fully respect the services of the owner's wishes, build on the basis of equal consultation and approval by both parties, faithfully perform the contents of the entrustment contract, and maximize the recognition and trust of the owner. As owners, they should not pretend to be supervisors in property service activities. For the problems and differences in management services, we should take the role of "partners", seek unity in understanding, and give the property service enterprises the greatest support and assistance in action. Owners should correctly use the supervision mechanism and not simply and arbitrarily exercise the veto power. The supervision right of recognizing legitimate rights and interests is the fundamental guarantee of democratic autonomy. However, the exercise of this supervision right must be based on certain laws and regulations, in line with the provisions of the contract law, in line with the provisions of specific contracts or agreements, rather than the arbitrary behavior of individuals, let alone the supervision behavior for supervision. Abuse of supervisory power and veto power will inevitably lead to mutual prevention, mutual distrust and confrontation. As partners with the same interests, both parties must have a strong willingness to communicate. In the property service activities, both parties should maintain a good communication environment and create conditions for mutual communication, so as to coordinate their relations, increase mutual understanding, eliminate strangeness and misunderstanding, and gain mutual recognition and trust. Therefore, both property service enterprises and owners should attach importance to and strengthen communication with each other, so that the relationship between the two sides is harmonious, mutual trust and harmonious. As the property service is the product of market economy, it has not been implemented for a long time in China, and it is in the stage of growth and development. In order to ensure its healthy development, it is a prerequisite to improve laws and regulations as soon as possible. The government should combine the local conditions, do a good job in the construction of local laws and regulations, refine the terms, simplify the procedures, and increase operability. Because some problems and contradictions in property service activities can't be solved only through consultation and communication, they should be solved according to laws and regulations. In the period when the government gradually fades out of the market, only by strengthening the construction of trade associations, strengthening their guidance and mediation functions, and giving full play to their "bridge" role, can we ensure the healthy, orderly and standardized development of the property service market. As the executive body of the owners' congress, the owners' committee plays an extremely important role in dealing with the relationship between owners and property service enterprises. In view of the asymmetry between owners and property service enterprises in property service activities, it is necessary to establish a training system for members of owners' committees and implement a "job certificate" system for members of owners' committees in order to achieve a balance. Government functional departments and trade associations should shoulder this heavy responsibility.
