Measures of Changsha Municipality on the Administration of Property Special Maintenance Funds
The term "special maintenance funds for property" as mentioned in these Measures refers to the funds earmarked for the maintenance, renewal and transformation of * * * parts and * * facilities and equipment of the property after the expiration of the warranty period. Article 3 The management of property special maintenance funds shall follow the principles of special account storage, earmarking, government supervision, openness and transparency. Article 6 Buyers who purchase pre-sold commercial housing shall deposit the first special property maintenance fund into the special property maintenance fund account before going through the check-in formalities. Real estate development enterprises shall not charge special maintenance funds for property.
Real estate development enterprises shall deposit the first special maintenance fund of unsold commercial houses into the special maintenance fund account before handling the initial registration of houses.
For self-built and agent-built houses, the owner of the house shall deposit the first special maintenance fund of the property into the special maintenance fund account of the property before handling the initial registration of the house. Article 7 The owner shall deposit the special maintenance fund for the property according to the construction area of the property he owns, and the amount of the first special maintenance fund for the property deposited per square meter of construction area shall be determined by the municipal administrative department of housing and urban and rural construction according to the classification of 5% to 8% of the construction and installation cost per square meter of this city, and shall be announced to the public and adjusted in a timely manner.
To adjust the deposit standard of the first-phase property special maintenance fund, public opinions shall be solicited and a hearing shall be organized. Article 8 The property special maintenance funds deposited by the owners belong to the owners. Ninth before the establishment of the owners' congress, the property special maintenance funds deposited by the owners shall be managed by the management organization.
After the establishment of the owners' congress, if the owners' congress decides to manage the property special maintenance funds by itself, the owners' committee shall apply to the management institution for the transfer of the property special maintenance funds deposited by the owners within the property management area. Without the decision of the owners' meeting to manage the special maintenance funds of the property, the management institution will continue to manage them. Article 10 The management institution shall, in accordance with the relevant provisions, determine a commercial bank as the special account management bank for special property maintenance funds, and open a special account for special property maintenance funds in the special account management bank. (four) other related matters related to the resolution of special maintenance funds for property.
The above matters shall be approved by the owners whose exclusive parts account for more than two-thirds of the total building area and more than two-thirds of the total number of people.
The district construction (real estate) departments, sub-district offices and township people's governments where the property is located shall guide the meetings of the owners' congress.
After the meeting of the owners' congress, the owners' committee shall publicize the matters resolved by the owners' congress and the owners' congress in the property management area for a period of not less than fifteen days. Thirteenth decided to manage the property special maintenance funds, the owners' congress shall open a special account in the property special maintenance fund account management bank.
If it decides to manage the special maintenance funds of the property by itself, the owners' committee shall notify the management institution in writing. Article 14 During the period when the owners' congress manages the property special maintenance funds by itself, the owners' congress may apply to the management agency for re-management of the property special maintenance funds with the consent of the owners whose exclusive parts account for more than two-thirds of the total construction area and more than two-thirds of the total number.
