Standard and basis of property fee
The collection standard of property fees is determined by the management business scope and service quality of the property company. Payment standards shall follow the principles of reasonableness, openness, and adaptability of fees and service levels, which shall be determined through consultation between the owners and the property management company, and shall be implemented in accordance with the measures for charging property services formulated by the the State Council price department in conjunction with the the State Council construction administrative department. The main basis is: the price law, the property management regulations, and the provisions on clearly priced goods and services. When a property management enterprise provides services to the owners (including providing the property services agreed in the property service contract and providing services other than those agreed in the property service contract entrusted by the owners), it shall clearly mark the price in accordance with these Provisions, and indicate the service items, charging standards and other relevant information. The property management company shall clearly mark the price, follow the principles of openness, fairness, honesty and credit, and abide by the national price laws, regulations, rules and policies.
The constituent elements of property fees are as follows:
1, labor cost. Manage the salary, social insurance and welfare expenses of service personnel as required;
2, the daily operation and maintenance costs of * * * parts of the property and * * * facilities and equipment;
3, the property management area greening maintenance costs;
4, property management area cleaning costs;
5, property management regional order maintenance costs;
6. Office expenses;
7. Depreciation expenses of fixed assets of property management enterprises;
8. Part of the property, facilities, equipment and public liability insurance fees;
9. Other expenses agreed by the owner.
Property service fee is the operating cost of property enterprises, which has included the corresponding residential sanitation and cleaning costs. Property service charges should follow the principles of rationality, openness and adaptability between fees and service levels, and distinguish the nature and characteristics of different properties. The owners and the realty service enterprise shall, according to the charging standards for realty service formulated by the competent price department of the State Council in conjunction with the administrative department of construction of the State Council, stipulate in the realty service contract.
Article 42
The owner shall pay the property service fee in accordance with the provisions of the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement.
Property that has been completed but has not been sold or handed over to the property buyer shall be paid by the construction unit.
