Provisions of Chengdu Municipality on the Administration of Greening in Residential Areas
In order to strengthen and standardize the greening management of residential quarters, these provisions are formulated in accordance with the provisions of the Property Management Regulations, the Sichuan Urban Landscaping Regulations, the Sichuan Provincial Property Management Regulations, the Chengdu Landscaping Regulations, the Chengdu Property Management Regulations and other relevant laws and regulations, combined with the actual situation in Chengdu. Article 2 (Scope of Application)
These Provisions shall apply to the greening management of non-exclusive parts of residential areas within the administrative area of this Municipality after delivery. Article 3 (Meaning of Terms)
The term "greening management" as mentioned in these Provisions refers to the management and maintenance of green space and green vegetation in residential quarters, including the behavior of plant pruning, transplanting and cutting, which is conducive to the growth of green plants in residential quarters or solves the problems that the growth of green plants in residential quarters affects the ventilation, lighting and safety of residents' rooms.
The term "residential green space" as mentioned in these Provisions refers to the green space with natural vegetation and artificial vegetation as the main forms within the scope of residential construction land. Article 4 (Responsible Subject)
All owners are responsible for the greening management of non-exclusive parts of residential areas, and the owners can entrust the relevant management work to property service agencies.
For residential quarters that have not entrusted property service agencies, the owners' committee shall perform the corresponding duties of the property service agencies.
The greening management of residential areas without owners' committees shall be guided and coordinated by the local neighborhood offices (township and town people's governments), and the corresponding responsibilities shall be supervised and implemented. Article 5 (Supervisory Bodies)
City Landscaping Department is responsible for the supervision and guidance of the city's residential area greening management; District (city) and county landscaping departments shall be responsible for the supervision and guidance of the greening management of residential quarters within their respective administrative areas. Street offices (township and town people's governments) shall supervise, guide and coordinate the greening management of residential areas within their respective jurisdictions in accordance with their duties.
The real estate administrative department is responsible for guiding and urging the property service agencies to do a good job in the relevant greening management in accordance with the provisions of the property service contract. Article 6 (Technical Specifications)
The greening management of residential quarters shall be implemented in accordance with the Technical Regulations for Urban Greening and Maintenance in Chengdu. When the owners' committee signs a realty service contract with the realty service agency, it shall refer to the technical specification for urban greening maintenance in Chengdu to stipulate the responsibility for greening management. Article 7 (Greening Protection)
The greening of residential quarters should ensure the safety of buildings, adhere to the principle of unified coordination of landscape, ecology and safety, and comprehensively consider factors such as sunshine, lighting, ventilation and traffic. If it can be trimmed, it will not be transplanted; Don't cut what can be transplanted.
No unit or individual may transplant or cut down trees in the residential area without authorization, occupy the green space in the residential area without authorization, or destroy the topography, water body and vegetation of the green space in the residential area. Article 8 (Pruning Management)
The realty service institution shall carry out greening and maintenance in accordance with the stipulations of the realty service contract, and regularly organize plant pruning to ensure that the greening landscape is clean and beautiful.
In addition to the conventional pruning agreed in the realty service contract, if it is really necessary to prune the plants in accordance with the relevant technical specifications and affect the lighting, ventilation and residential safety of residents, the realty service institution shall obtain the consent of the owners' committee, announce the pruning scheme at the pruning site, and accept the supervision of the owners and the public. Article 9 (Consent of Transplanting and Cutting)
Transplanting and cutting down trees in residential areas shall be organized and implemented by the owners' committee in accordance with the provisions of the Regulations on Property Management, with the consent of the owners whose exclusive parts account for more than half of the total construction area and more than half of the total number. Article 10 (Transplanting and Cutting License)
Transplanting trees above 6 cm in diameter at breast height to the outside of residential areas shall be carried out in accordance with the provisions of the Regulations of Chengdu Municipality on Landscaping and reported to the competent department of Landscaping and Greening for approval before transplanting.
If it is necessary to cut down trees because of the death of trees, endangering public safety, quarantine pests or other serious pests and diseases, it shall be reported to the competent department of landscaping for approval in accordance with the provisions of the Chengdu Landscaping Regulations. Article 11 (Implementation Requirements)
Pruning, transplanting and cutting of greening plants in residential quarters shall be organized and implemented by the property service agencies, and the construction may also be entrusted to the professional team of landscaping. The pruning and transplanting of greening plants shall implement the technical specifications for tree pruning and tree transplanting.
The construction unit shall make an announcement on the spot and accept the supervision of the owner and the public. Article 12 (Emergency Disposal)
The realty service agency and the owners' committee shall take the emergency preventive measures of greening management as one of the contents of the emergency plan of this community. Due to force majeure such as natural disasters, car accidents, man-made destruction and other man-made reasons, in the greening of residential quarters, trees fall and branches break, which endanger the safety of others' houses or public safety, the property service agency shall take preventive measures to eliminate the danger in accordance with the provisions of the emergency plan, notify the owners' committee or all owners in time, and report to the local community, neighborhood offices (township people's governments) and district (city) and county landscaping departments.
The expenses for eliminating dangerous situations shall be borne by the relevant responsible persons according to law. Article 13 (Reporting System)
The realty service institution shall strictly implement the reporting system for major events of realty service, promptly dissuade, stop and report illegal acts such as transplanting, cutting down trees, changing the nature of green space and destroying green space in residential areas, and assist in investigation and handling.
