In order to improve the quality of the city and improve the appearance of the Huaihe River coastline, this scheme is formulated in accordance with the spirit of Regulations on Expropriation and Compensation of Houses on State-owned Land (the State Council Order No.590) and Notice of Huainan Municipal People's Government on Printing and Distributing Measures for Expropriation and Compensation of Houses on State-owned Land (Huai Fu [2021] No.80) and in combination with the actual situation of this project.

Article 1 The scope of the project collection: Longhu Park in the east, Caozui section of Donghua flood intercepting ditch in the west, Huaihe levee in the north and planned Huxing Road in the south (see the construction land planning for details).

Article 2 Tianjiaan District People's Government is the house expropriation organ of this project, and Tianjiaan District Housing Security and Real Estate Administration is the house expropriation department of this project, responsible for organizing and supervising the house expropriation and compensation work of this project, and entrusting Tianjiaan District Gong Yuan Sub-district Office to implement it.

Article 3 The object of compensation collection: the owner of the house who has obtained the property right certificate according to law and meets the compensation conditions recognized by the organization according to law.

The identification and treatment of houses without property right certificates shall be carried out in accordance with the provisions of Article 9 of the Notice of Huainan Municipal People's Government on Printing and Distributing Measures for Expropriation and Compensation of Houses on State-owned Land in Huainan City (Huai Fu [2021] No.80).

Article 4 No compensation will be given to illegal buildings, temporary buildings and commercial stalls that exceed the approved period, and the owners will dismantle them themselves within 30 days from the time specified in the house expropriation decision of this project. If it is not removed within the time limit, it shall be removed by the collector according to law.

Fifth housing expropriation compensation within the scope of the project is implemented in two ways: monetary compensation and property right exchange.

Article 6 Monetary compensation

(1) All temporary buildings that have not exceeded the approval period and houses that have been recognized by the District People's Government as meeting the compensation conditions shall be given monetary compensation. The compensation standards are: frame 1000 yuan/square meter, brick-concrete 880 yuan/square meter, brick-wood 780 yuan/square meter, and simple house 390 yuan/square meter. If the use period of the approved temporary building is not clear, the use period shall not exceed 2 years.

(two) the expropriation of houses for production, office, storage, all in accordance with the assessed value of the legitimate property area of the expropriated houses for monetary compensation.

(three) the expropriation of residential and commercial housing to choose monetary compensation, monetary compensation in accordance with the assessed price of the legitimate property area of the expropriated house.

(four) the house decoration and accessories shall be compensated according to the evaluation value, and the decoration after the house investigation and registration announcement shall not be evaluated and compensated.

Article 7 Property right transaction

(1) residential category

For residential houses that have obtained property rights certificates according to law, the expropriated person may choose to exchange property rights.

1. In case of expropriation and property right exchange of residential houses within the scope of expropriation, the expropriated houses and resettlement houses shall be subject to property right exchange according to the ratio of interior construction area 1: 1, and the difference will not be settled.

2, the implementation of off-site property rights exchange, according to the collection area and the property rights exchange area of housing market assessment price settlement price difference.

3. On the basis of the property right exchange construction area, the expropriated person can purchase an additional 15 square meter construction area per household, and the additional purchase price is calculated at 70% of the market evaluation price; The part exceeding the construction area 15 square meter shall be purchased by the expropriated person at the market evaluation price.

4. If the construction area of the resettlement house is still less than 60 square meters after purchasing 15 square meters according to the provisions of the preceding paragraph, it can be purchased to 60 square meters according to 70% of the market evaluation price.

5. The decoration and accessories of the expropriated house shall be compensated according to the assessed value. After the announcement of house survey and registration is issued, the decoration shall not be assessed and compensated.

6. If the expropriated person meets the housing security conditions, priority should be given to housing security.

(2) Business management

According to the structure, area and actual use of the house, one sign and one refund are implemented. Property area is equal to the resettlement area. The expropriated person and the expropriated person shall settle the price difference of property right exchange according to the assessed price of the expropriated house and resettlement house. The difference paid by the expropriated person to the expropriated person shall be paid according to the actual difference, and the difference paid by the expropriated person shall be paid according to the actual difference.

Interior decoration and accessories are compensated according to the evaluation price.

(three) the unit, area and selected order of resettlement houses

The collection area shall take the form of local reduction and resettlement in different places. The location and apartment type of the specific resettlement building will be announced separately by the office of the Leading Group for Land Acquisition and Demolition in Yaojiawan Village, Tianjiaan District. The order in which the relocated households choose resettlement houses is determined by the order in which they sign the agreement and hand over the house.

Article 8 Awards and subsidies

1, relocation allowance

(1) For residential houses and non-residential houses, the relocation subsidy shall be paid twice according to the standard of 8 yuan/m2/time of the property right area or actual surveying and mapping area of the expropriated house; If the relocation subsidy is insufficient in 500 yuan, it shall be paid in 500 yuan.

(two) the expropriation of non-residential houses such as production and storage (frozen or with processing equipment) built according to the approved planning, and the relocation fee shall be settled by the expropriated person and the expropriated person through consultation; If negotiation fails, the collector shall organize the relocation, and the expropriated person shall provide assistance, and the required expenses shall be paid by the expropriated person; Can also be selected by the project evaluation agencies to evaluate the relocation costs, according to the evaluation price of compensation for the expropriated person.

(3) For non-residential houses with legal property rights certificates and meeting the following conditions, the expropriated person shall be compensated for the loss of production or business suspension.

1 Hold a legal and valid industrial and commercial business license and tax payment certificate six months before the announcement date of the house expropriation decision.

2. If renting a house, a house lease certificate or lease agreement shall be provided.

Compensation method for loss of production and business suspension: the expropriated person shall be compensated for loss of production and business suspension for 6 months. The monthly compensation standard is: the unit price of monetary compensation determined by assessment ×5‰× the legal construction area of the expropriated house.

2. Award for early signing: 200 yuan per household × days of early signing.

3, temporary resettlement compensation:

(1) If the auction house is selected for resettlement, the expropriated person shall be given a temporary resettlement subsidy according to the legal construction area of the expropriated house. The standard is: house per month 12 yuan/square meter. If the monthly temporary resettlement fee is insufficient in 600 yuan, it will be paid in 600 yuan; 30 yuan/m2 per month for commercial buildings. The temporary resettlement period is 36 months. If the repaired house cannot be delivered to the expropriated person after 36 months, the expropriated person will provide the existing house with a value not lower than the resettlement house to the expropriated person for proper placement. When the resettlement house is delivered, a temporary resettlement fee of 4 months shall be paid separately according to the original standard.

(2) If the existing house is selected for resettlement, the collector shall give the expropriated person a temporary resettlement subsidy of 4 months according to the above standards.

4. Business premises, where the resettlement house selected by the expropriated person exceeds the area of the expropriated house within 15 square meters (including 15 square meters), shall be purchased by the expropriated person at a discount of 10% of the market evaluation price; The part exceeding 15 square meter shall be purchased by the expropriated person at the market evaluation price.

Article 9 This project is implemented by pre-expropriation. After the expropriated person and the expropriated person have signed a certain proportion of expropriation and resettlement compensation agreement, the expropriated person shall announce the expropriation decision according to law, and the signed expropriation and resettlement compensation agreement shall take effect from the date of announcement of the expropriation decision.

The collector shall calculate and pay the temporary resettlement fee to the expropriated person from the date when the expropriated person delivers the house (receiving the delivery confirmation form).

Tenth assessment agencies by the housing levy department to organize the collection of people selected according to law, and notarized by a notary public. All real estate price assessment agencies registered in Huainan real estate management department are eligible to be selected.

Article 11 Within 45 days (including 15) after the release of this scheme, the expropriated person and the expropriated person shall sign a house expropriation compensation agreement. After the release of the expropriation decision, if no agreement can be reached on the expropriation compensation, the expropriated person shall make a decision on the expropriation compensation. If the expropriated person does not apply for administrative reconsideration or bring an administrative lawsuit within the statutory time limit, and does not move within the time limit stipulated in the compensation decision, the District People's Government shall apply to the people's court for compulsory execution according to law.

Twelfth matters not covered in this plan shall be decided by the leading group of land acquisition and demolition in Yaojiawan Village, Tianjiaan District according to relevant laws, regulations and policies.
