Regulations of Hohhot Municipality on Urban Greening (revised on 20 19)

Chapter I General Provisions Article 1 In order to strengthen the planning, construction, protection and management of urban green space, promote the development of greening, and improve the ecological environment and human settlement environment, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Regulations on Urban Greening of the State Council and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, protection, supervision and management activities of parks, protective greenbelts, scenic woodlands, road greenbelts, residential greenbelts, attached greenbelts, production greenbelts and other greenbelts that play an important role in urban ecology and landscape. Article 3 Urban greening shall adhere to the principles of government leading, public participation, scientific planning, local conditions, ecological priority and strict protection. Article 4 The municipal and district people's governments shall incorporate urban greening into the national economic and social development plan, optimize the layout of urban greening land, increase the area of green land, carry out voluntary tree planting activities for the whole people, and raise public awareness of greening and environment. The urban greening funds will be included in the fiscal budget at the same level, and will be gradually increased according to the financial growth.

Municipal and District People's governments encourage units and individuals to invest in urban greening in various ways, and commend and reward units and individuals who have made outstanding achievements in urban greening and have the right to name green spaces. Article 5 The municipal and district people's governments shall organize urban greening in accordance with the planning, improve the coverage rate of urban greening and the quality of green space, strictly protect urban green space and put an end to encroachment on urban green space. Article 6 The competent department of urban greening of the Municipal People's Government (hereinafter referred to as the competent department of urban greening) is responsible for the urban greening of the whole city.

The competent department of urban greening of the Municipal People's Government and the competent department of urban greening of the Development Zone shall be responsible for the greening work within their respective jurisdictions under the guidance of the competent department of urban greening.

The municipal administrative departments of natural resources, planning, water affairs, urban management and law enforcement, housing security and housing management shall do a good job in urban greening within their respective responsibilities.

The municipal competent department of urban greening shall supervise and guide the units and individuals responsible for the construction and management of green space.

In the urban planning area, the greening work managed by the administrative departments of forestry and grassland as stipulated by relevant laws and regulations shall be implemented in accordance with relevant laws and regulations. Seventh all units and individuals have the responsibility to protect urban green space and urban greening facilities, and have the right to stop and report the damage to urban green space and urban greening facilities.

Any unit or individual has the right to complain and report the administrative inaction and other illegal acts of the municipal competent department of urban greening and other administrative departments in greening management.

The municipal competent department of urban greening shall establish a complaint reporting acceptance system and announce a unified complaint reporting telephone number to the society. Chapter II Planning and Construction Article 8 The municipal competent department of urban greening shall, jointly with the municipal competent department of planning administration, formulate the urban green space system planning of this Municipality, which shall be incorporated into the overall urban planning of this Municipality after being approved by the Municipal People's Government.

Before the urban green space system planning is submitted for approval, the preparation department shall publicize the draft plan and solicit the opinions of relevant departments, the public and experts through argumentation meetings, hearings or other forms. Ninth urban green space system planning should be connected with the overall land use planning, forestry planning, water resources planning, environmental protection planning and so on. Article 10 The planning of urban green space system shall be made, the greening objectives and layout shall be determined according to the principle of balanced development, the protection principles of various types of green space shall be stipulated, the green space area shall be determined according to the prescribed standards, and the layout shall be reasonable at different levels, and a complete urban greening system shall be formed according to the requirements of combining universal greening with key greening. Eleventh city planning administrative departments shall, according to the requirements of the overall urban planning and the provisions of this Ordinance, put forward the boundaries of different types of land use in the detailed planning of the organization, and specify the specific coordinates and boundaries of the green space rate control standard.

Detailed planning should include the contents of green space system planning, and ensure the implementation of green space system planning. Twelfth city greening departments in accordance with the urban green space system planning, detailed planning, the preparation of urban greening construction annual plan, and organize the implementation. Thirteenth urban greening construction is responsible for the division of labor in accordance with the following provisions:

(a) park green space, protective green space, scenic woodland, road green space by the municipal department in charge of urban greening;

(two) the green space in residential areas is the responsibility of the development and construction units, and the green space needed to be built in old residential areas is the responsibility of the owners or their entrusted property companies;

(three) the unit is responsible for the attached green space;

(four) within the prescribed scope of the river, highway and railway green space, by the river, highway and railway management units responsible for.

The responsibility for green space construction other than that specified in the preceding paragraph is unknown, which shall be the responsibility of the municipal competent department of urban greening. Fourteenth in the urban planning area, the green rate of various construction projects shall meet the following standards:

(a) all kinds of green space attached to construction projects. No less than 30% of new projects within the Second Ring Road and no less than 25% of old district reconstruction projects; The new projects between the Second Ring Road and the Ring Expressway shall not be less than 35%, and the old district reconstruction projects shall not be less than 30%; Not less than 40% of new projects are built outside the expressway around the city, and not less than 35% of old district reconstruction projects;

(two) new roads in the city, the width of green space on each side of the main road is not less than fifteen meters, and the width of green space on each side of the secondary road is not less than ten meters;

(3) A protective green space with a width of not less than 50 meters should be built between the newly-built industrial zone and the living area;

(four) the urban production green space is not less than two percent of the total area of the urban built-up area;

(five) between the new industrial park and the city, the protective green space with a width of not less than 500 meters should be built;

(six) other green space in line with the "urban land classification and planning and construction land standards" and "park design code" and other national standards.
