Provisions of Hefei Tendering and Bidding Center on Transferring the Right to Use State-owned Land through Bidding, Auction and Listing:

Article 1 These Provisions are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on Urban Real Estate Management, the Law of the People's Republic of China on Land Management and the Regulations for the Implementation of the Law of the People's Republic of China on Land Management for the purpose of regulating the transfer of the right to use state-owned land, optimizing the allocation of land resources and establishing an open, fair and just land use system.

Article 2 These Provisions shall apply to the transfer of the right to use state-owned land within the territory of People's Republic of China (PRC) by means of bidding, auction and listing.

The term "transfer of the right to use state-owned land by tender" as mentioned in these Provisions refers to the land administrative departments of the people's governments of cities and counties (hereinafter referred to as the transferor) issuing a tender announcement, inviting specific or unspecified citizens, legal persons and other organizations to participate in the bidding for the right to use state-owned land, and determining the behavior of land users according to the bidding results.

The term "transferring the right to use state-owned land by auction" as mentioned in these Provisions refers to the behavior of letting people publish an auction announcement, bidders conduct public bidding at a specified time and place, and determine the land users according to the bidding results.

The term "listing transferring the right to the use of state-owned land" as mentioned in these Provisions refers to letting people issue a listing announcement, listing the trading conditions of the land to be transferred in the designated land trading place within the time limit specified in the announcement, accepting the bidder's quotation application and updating the listing price, and determining the behavior of land users according to the bidding results at the end of the listing period.

Article 3 The principles of openness, fairness, impartiality, honesty and credibility shall be followed in transferring the right to use state-owned land through bidding, auction and listing.

Fourth commercial, tourism, entertainment and commercial housing and other business land, must be sold by tender, auction or listing.

After the announcement of the land supply plan for purposes other than those specified in the preceding paragraph, if there are more than two intended land users on the same parcel, it shall also be sold by tender, auction or listing.

Article 5 The bidding, auction or listing of the right to use state-owned land shall be carried out in a planned way.

The land administrative department of the people's government of the city or county shall, according to the social and economic development planning, industrial policy, overall land use planning, annual land use plan, urban planning and land market conditions, prepare a plan for transferring the right to use state-owned land, and report it to the people's government at the same level for approval and announce it to the public in a timely manner.

Article 6 The land administrative departments of the people's governments of cities and counties shall, in accordance with the transfer plan, work out plans for the use, duration, transfer mode, time and other conditions of the land to be transferred by bidding, auction and hanging in conjunction with the relevant departments of city planning, and report them to the people's governments of cities and counties for approval, and then the land administrative departments of the people's governments of cities and counties shall organize their implementation.

Article 7 The transferor shall, according to the situation of transferring land by tender and auction, prepare the documents for transferring land by tender and auction. Bidding and auction listing transfer documents shall include the announcement of bidding and auction listing transfer, instructions for bidding and tendering, conditions for land use, application for bidding and tendering, quotation, confirmation of transaction, and the text of the contract for transferring the right to use state-owned land.

Article 8 The transferor shall announce the tender, auction or listing at least 20 days before the start date of tender, auction or listing, and announce the basic situation of the land to be transferred by tender and auction, and the time and place of tender and auction listing.

Article 9 The announcement for listing in bidding, auction and listing shall include the following contents:

(a) the name and address of the assignor;

(two) the location, present situation, area, service life, use and planning and design requirements of the land;

(three) the qualification requirements of bidders and bidders and the methods of applying for bidding and bidding qualifications;

(four) the time, place and method of obtaining the bidding, auction and listing transfer documents;

(five) the time and place of bidding and auction listing, the time limit for bidding and listing, and the methods of bidding and tendering;

(six) the criteria and methods for determining the winning bidder and the bidder;

(7) Bidding and bid bond;

(eight) other matters that need to be announced.

Article 10 The land administrative departments of the municipal and county people's governments shall comprehensively determine the pre-tender or reserve price according to the land evaluation results and the government's industrial policies.

When determining the pre-tender estimate, starting price, reserve price, pre-tender estimate and bid bond for auction listing, collective decision-making shall be implemented.

Article 11 The transferor shall examine the qualifications of the bid applicants and the bid applicants. Those who meet the requirements of bidding, auction and listing announcement shall be notified to participate in bidding, auction and listing activities.

(2) The transferor shall open the bid at the time and place specified in the tender announcement and invite all bidders to participate. The bidder or its elected representative shall check the sealing condition of the standard box, open the standard box in public, and announce the name of the bidder, the bid price and the main contents of the bid documents. If there are less than three bidders, the transferor shall re-invite tenders in accordance with these provisions.

(3) The bid evaluation team conducts bid evaluation. The bid evaluation team is composed of representatives of the transferor and relevant experts, with an odd number of more than 5 members.

The bid evaluation team may require bidders to make necessary clarifications or explanations on the bid documents, but the clarifications or explanations shall not go beyond the scope of the bid documents or change the substantive contents of the bid documents.

The bid evaluation team shall evaluate the bid documents in accordance with the bid evaluation standards and methods determined in the bidding documents.

(four) the tenderer shall determine the winning bidder according to the evaluation results.

Article 14 The bidder who can meet the comprehensive evaluation criteria stipulated in the tender documents to the greatest extent, or can meet the substantive requirements of the tender documents and has the highest price shall be determined as the winning bidder.

Fifteenth auction shall be conducted in accordance with the following procedures:

(1) The host counts the bidders;

(two) the host introduced the location, area, use, service life, planning requirements and other related matters of the auction parcel;

(three) the host announced the rules of bidding and fare increase and the rate of fare increase. If there is no reserve price, it shall be clearly stated;

(four) the bid price quoted by the host;

(five) the bidder shall bid or quote;

(8) The host announces that the highest bidder is the bidder.

Article 16 If the number of bidders is less than three, or the highest bidding price of bidders does not reach the reserved price, the host shall terminate the auction.

The auctioneer can adjust the auction price increase according to the bidders' bids in the auction.

Seventeenth listing in accordance with the following procedures:

(1) On the starting date of listing specified in the listing announcement, the transferor will list the location, area, purpose, service life, planning requirements, starting price, fare increase rules and fare increase range of the listed parcel in the land trading place specified in the listing announcement;

(two) qualified bidders to fill in the quotation;

(3) After the transferor confirms the quotation, the listed price will be updated and displayed;

(4) The transferor continues to accept the new offer;

(5) The transferor shall determine the bidders within the listing deadline specified in the listing announcement.

Article 18 The listing time shall not be less than 10 working days. During the listing period, the price increase can be adjusted according to the bidder's bidding situation.

Nineteenth listing period expires, in accordance with the following provisions to determine whether to trade:

(a) in the listing period, only one bidder offers, and the offer is higher than the reserve price, and other conditions are met, and the transaction is listed;

(two) during the listing period, there are more than two bidders bidding, and the highest bidder is the bidder; If the quotation is the same, the bidder shall make an offer first, except for those whose quotation is lower than the reserved price;

(3) If no bidder or bidder's quotation is lower than the reserve price or does not meet other conditions within the listing period, the listing will not be completed.

If there are still more than two bidders asking for quotations at the expiration of the listing period, the transferor shall conduct on-site bidding for the listed land, and the highest bidder shall be the bidder.

Twentieth through bidding, auction or listing to determine the winning bidder, the transferor shall sign a transaction confirmation with the winning bidder and the bidder.

The confirmation of the transaction shall include the names and addresses of the transferor, the winning bidder and the bidder, the transfer target, the time and place of the transaction, the price, and the time and place of signing the contract for transferring the right to use state-owned land.

The confirmation of the transaction has contractual effect on the transferor, the winning bidder and the bidder. After signing the transaction confirmation letter, if the transferor changes the bid-winning result, or the winning bidder or the bidder abandons the bid-winning parcel or the bid-winning parcel, it shall bear the responsibility according to law.

Twenty-first the winning bidder and the bidder shall sign a contract for the assignment of the right to use state-owned land with the transferor according to the time agreed in the transaction confirmation.

The bid winning gold and bid bond paid by the winning bidder and the bidder shall be used as the transfer gold of the right to use the state-owned land, and the bid winning gold and bid bond paid by other bidders and bidders shall be returned without interest within 5 working days after the end of the bidding, auction and listing activities.

Article 22 After the bidding, auction and listing activities are completed, the transferor shall announce the bidding, auction and listing results in the tangible land market or designated places and media within 10 working days.

When the transferor announces the transfer result, it shall not charge the transferee.

Twenty-third the transferee shall apply for land registration in accordance with the law and obtain the certificate of state-owned land use right after paying all the transfer money of state-owned land use right in accordance with the contract for the transfer of state-owned land use right.

Article 24 If the right to use state-owned land should be transferred by means of bidding, auction and listing, and the right to use state-owned land should be transferred by agreement without authorization, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law.

Twenty-fifth the winning bidder, the bidder has one of the following acts, the winning bid, the bid result is invalid; If losses are caused, the winning bidder and the bidder shall be liable for compensation according to law:

(a) bidders, bidders to provide false documents to conceal the facts;

(two) the winning bidder or the bidder adopts illegal means such as bribery and malicious collusion to win the bid.

Twenty-sixth land administrative departments staff in the tender, auction and listing transfer activities dereliction of duty, abuse of power, corruption, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.
