The Regulations on the Management of Domestic Waste in Shandong Province was promulgated and will be formally implemented on March 1 day next year.

On the afternoon of September 30th, the 30th meeting of the Standing Committee of the 13th Provincial People's Congress deliberated and passed the Regulations on Domestic Waste Management in Shandong Province (hereinafter referred to as the Regulations), which will be implemented on March 1 day, 2022. Subsequently, the General Office of the Standing Committee of the Provincial People's Congress held a press conference, inviting responsible comrades of the Legislative Affairs Committee of the Standing Committee of the Provincial People's Congress, the Provincial Department of Justice, the Provincial Department of Housing and Urban-Rural Development and other units to introduce the necessity, drafting process, main systems and characteristics of the Regulations. Xu Qifeng, member of the Party Committee and Deputy Director of the Provincial Department of Housing and Urban-Rural Development, focused on the implementation of the next work arrangement.

The "Regulations" * * 8 chapter 45, the main contents include:

Firstly, the management system of domestic waste is determined. The "Regulations" clarify the responsibilities of people's governments at or above the county level, township people's governments and sub-district offices; Clarify the supervision and guidance responsibilities of residents' committees and villagers' committees; The responsibilities of the competent departments of domestic waste of people's governments at all levels are stipulated. At the same time, it is clear that relevant functional departments should do a good job in domestic waste management according to the division of responsibilities.

The second is to stipulate source reduction measures. Source reduction is of great significance to domestic waste management. The "Regulations" define the reduction measures in production, circulation and consumption, focusing on reducing the use of packaging materials, restricting disposable consumer goods, opposing food waste, green office and listing clean vegetables.

The third is to clarify the requirements for classified delivery. 1. According to the latest national standards, the classification category of domestic waste is determined; 2. It is clear that units, families and individuals should fulfill the obligation of domestic waste classification and delivery according to law, and stipulate that managers of organs, institutions, state-owned enterprises and public places should play a leading role in domestic waste classification; 3. Highlight the leading role of community and village party organizations, and improve the working mechanism of domestic waste management with the participation of residents' committees or villagers' committees, owners' committees, property service providers and owners. It is stipulated that property service providers should implement the requirements of classified management of domestic waste in the property service area. At the same time, the people's governments of cities and counties (cities, districts) that stipulate districts may, in light of local conditions, implement the system of classifying garbage into responsible areas and clarify the relevant responsible persons and their responsibilities.

The fourth is to strengthen the collection and transportation measures. The "Regulations" clarify the main body responsible for the collection and transportation of domestic waste in urban and rural areas of our province, stipulate the responsibilities of the units engaged in the collection and transportation of domestic waste, and regulate the problems that people pay attention to, such as the recovery of large-sized waste, the treatment of leachate generated by domestic waste transfer stations, and the collection and transportation of kitchen waste.

The fifth is to clarify the classification and resource utilization requirements. The "Regulations" standardize the way of classified treatment and resource utilization of domestic waste, clarify the responsibilities of waste disposal units, and put forward clear requirements for the treatment and resource utilization of kitchen waste and rural domestic waste.

The sixth is to clarify the main contents of safeguard measures. According to the development of domestic waste management in our province, the regulations focus on the planning and construction of domestic waste facilities, the construction of cross-regional domestic waste treatment facilities and ecological compensation mechanism, the charging system for domestic waste treatment, the emergency management of domestic waste treatment, and the purchase of services.

Seventh, the relevant legal responsibilities are stipulated. In order to implement the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, regarding the legal liability of individuals who fail to put domestic garbage at designated places, Article 42 of the Regulations sets administrative penalties for individuals who fail to put domestic garbage at designated places. At the same time, article 44 of the regulations supplements the administrative punishment for the unclassified collection and transportation of domestic garbage by the collection and transportation units.
