Regulations of Hunan Province on Property Management

These Regulations shall apply to the property management and related activities in relatively concentrated residential areas within the urban planning area of this province.

The term "property management" as mentioned in these Measures refers to the activities of property management enterprises entrusted by the owners to repair, conserve, manage and provide related services. According to the contract, the shared equipment and corresponding supporting facilities in the property management area. The real estate management area shall be designated by the real estate administrative department of the people's government at or above the county level in conjunction with the relevant units according to the use of public facilities in residential areas.

The owners' meeting is composed of all owners in the property management area; If there are a large number of owners, the owners' representatives may be elected in proportion to form the owners' meeting. The owners' committee is elected by the owners' congress or the owners' congress (hereinafter referred to as the owners' congress).

Owners' Association is an organization that represents and protects the legitimate rights and interests of owners in property management activities. The owners' committee is the office of the owners' association. The Owner will perform the following duties:

(a) to formulate the articles of association of the owners' congress;

(two) to elect or recall members of the owners' committee and supervise the work of the owners' committee;

(three) to review the draft property management service contract;

(four) authorize the owners' committee to sign, modify or terminate the property management service contract with the property management enterprise;

(five) to examine and approve the budget and final accounts of the property maintenance fund and its updating methods;

(six) to decide on other major issues related to property management. In the property management area, if the total construction area of the buildings delivered to the owners reaches more than 60%, the first owners' meeting shall be held and the owners' committee shall be elected.

The list of owners' committee and its members shall be reported to the local real estate administrative department of the people's government at the county level for the record within 30 days from the date of election. The owners' committee shall perform the following duties:

(1) Organizing the owners' meeting;

(two) through the written authorization of the owners' association, the property management enterprise is selected, and the property management service contract is signed, modified or terminated with the property management enterprise;

(three) to supervise the use of property maintenance funds;

(four) to listen to and reflect the opinions and suggestions of the owners and users on property management services;

(five) to urge the owners and users to abide by the owners' convention and perform the property management service contract;

(six) other work assigned by the owner.

Article 1 Owners shall exercise their rights and perform their obligations in property management activities in accordance with the provisions of the owners' convention and the property management service contract.

The user is authorized by the owner in writing to exercise rights and perform corresponding obligations on behalf of the owner within the scope of authorization.

Two, the property management system formulated by the property management enterprise shall be approved by the owners' association. Real estate management enterprises shall perform the following obligations:

(three) accept the supervision and management of the relevant administrative departments of the people's governments at or above the county level where the business activities are located;

(4) Other obligations stipulated by laws and regulations.
