Regulations of Huainan Municipality on the Administration of City Appearance and Environmental Sanitation (revised 20 12)

Chapter I General Provisions Article 1 In order to strengthen the management of city appearance and environmental sanitation, create a clean, beautiful, civilized and orderly modern city, and promote social and economic development and spiritual civilization construction, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the urban areas, towns, independent industrial and mining areas, economic and technological development zones and other urbanization management areas of this Municipality. Article 3 The work of city appearance and environmental sanitation shall follow the principles of unified leadership, hierarchical management, division of responsibilities, and the combination of professional management and mass management. Fourth city appearance and environmental sanitation management department (hereinafter referred to as the city appearance management department) is in charge of the city appearance and environmental sanitation work.

County and district administrative departments of city appearance, under the leadership of the people's government at the same level, are responsible for the supervision and management of city appearance and environmental sanitation within their respective administrative areas.

The city appearance and environmental sanitation management institution of the Economic and Technological Development Zone is responsible for the city appearance and environmental sanitation management of the Development Zone.

Sub-district offices and town (township) people's governments shall be responsible for the supervision and management of city appearance and environmental sanitation within their respective jurisdictions in accordance with the division of responsibilities.

Urban management administrative law enforcement agencies (hereinafter referred to as urban management law enforcement agencies) are responsible for investigating and dealing with violations of city appearance and environmental sanitation management according to law. Fifth people's governments at all levels should strengthen the publicity of laws, regulations and scientific knowledge of city appearance and environmental sanitation, educate citizens to improve their awareness of city appearance and environmental sanitation, and develop good public health habits.

Units and individuals that have made outstanding achievements in the management of city appearance and environmental sanitation shall be commended and rewarded by the people's governments of cities, counties and districts. Sixth urban planning, industry and commerce, public security, transportation, real estate, public utilities, health, environmental protection and other departments. Should be in accordance with their respective responsibilities, cooperate with the administrative department of city appearance to do a good job in the management of city appearance and environmental sanitation.

Relevant matters that should be examined by the competent administrative department of city appearance according to law shall not be approved by the relevant departments without examination or unqualified examination. Seventh all units and individuals have the obligation to maintain a clean, beautiful and civilized city, and have the right to discourage and report violations of city appearance and environmental sanitation management.

Urban management administrative departments and urban management law enforcement agencies shall promptly investigate and deal with the reported matters, and inform the informants of the handling situation or publicize it at the scene within 5 working days. Article 8 For acts that violate the provisions of these Regulations and hinder the city appearance and environmental sanitation, the urban management law enforcement department may temporarily detain the illegally operated articles and tools for carrying out illegal acts, and require the violator to accept punishment at the designated place. Article 9 In violation of the provisions of these Regulations, it is necessary to immediately remove spills, obstacles or pollutants from roads, rivers or public places. If the parties concerned are unable to do so, the urban management law enforcement organ may decide to perform them immediately, and the expenses required shall be borne by the violator. If the violator refuses to bear the performance fee, the urban management law enforcement organ may apply to the people's court for compulsory execution according to law. Article 10 Municipal administrative departments, urban management law enforcement agencies and their staff shall actively perform their management and supervision duties according to law, and shall not neglect their duties, abuse their powers, engage in malpractices for selfish ends, or damage the legitimate rights and interests of citizens, legal persons or other organizations.

In violation of the provisions, the unit or the competent department at a higher level shall give administrative sanctions to the directly responsible person in charge and other responsible personnel according to law; If losses are caused to the counterpart, compensation shall be made according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Chapter II Responsibility for City Appearance and Environmental Sanitation Article 11 The responsibility system shall be implemented in the management of city appearance and environmental sanitation. Responsible units and individuals shall do a good job in the city appearance and environmental sanitation work in the responsible area.

The specific content of the responsibility system for city appearance and environmental sanitation shall be formulated by the Municipal People's government. Twelfth city appearance and environmental sanitation responsibility area responsibility standard is:

(a) to keep the city clean and tidy, and shall not set up stalls, set up, post, scribble, hang and pile up items without authorization;

(two) keep the environment clean and tidy, no exposed garbage, feces, sewage and muck;

(three) keep the environmental sanitation facilities clean and in good condition.

Responsible units and individuals have the right to dissuade and stop the damage to the city appearance and environmental sanitation in the area of responsibility, and notify the urban management law enforcement department to investigate and deal with it in time. Thirteenth units and individuals in the city appearance and environmental sanitation responsibility area shall be determined in accordance with the following provisions:

(a) roads, bridges, public squares, footbridges and their ancillary facilities shall be the responsibility of the property owners or their managers;

(two) residential property management, the property management unit is responsible for; Small streets and residential areas that have not implemented property management shall be in charge of sub-district offices, town (township) people's governments or original property units;

(three) buildings, structures or other facilities and places shall be the responsibility of the property owner or its manager or user;

(four) public toilets, garbage transfer stations and other public health facilities, by the environmental health professional management department or property owners and managers;

(five) the urban-rural fringe is the area of responsibility under the administrative jurisdiction of the local area;

(six) stations, docks, highways, railways and other transportation facilities and their business scope, the management unit or business unit is responsible for;

(seven) exhibitions, commercial activities, hotels and other places, by the property owner or its managers, users responsible;

(eight) individual shops, stalls and other places are operated by operators;

(nine) the competent unit is responsible for the bazaars and commercial stalls;

(ten) the construction site is the responsibility of the construction unit and the construction unit, and the land to be built is the responsibility of the owner or its management unit;

(eleven) culture, sports, entertainment, sightseeing, parks, public green spaces and other public places, by the management unit or business unit;

(twelve) river waters and river embankment management areas, by the managers or users;

(thirteen) the area of responsibility for city appearance and environmental sanitation of organs, organizations, military units, enterprises and institutions shall be designated by the administrative department of city appearance according to the provisions of the Municipal People's government, and the responsible units and persons shall be clearly defined;

(fourteen) in areas with overlapping responsibilities or unclear responsibilities, the responsible person shall be determined by the administrative department of city appearance.

In violation of regulations, failing to perform the cleaning obligations in the health responsibility area or failing to clear and dispose of garbage and feces according to regulations, it shall be ordered to make corrections within a time limit, and a fine of 1000 yuan or more may be imposed on the responsible unit or individual.
