Regulations of Shenyang Municipality on Property Management
District and county (city) real estate departments are responsible for the supervision and management of property service activities within their respective jurisdictions.
Construction, planning, urban construction, finance, civil affairs, public security, industry and commerce, price, environmental protection, urban management administrative law enforcement and other relevant departments shall be responsible for the relevant supervision and management work within the property management area according to their respective responsibilities. Article 4 Sub-district offices and Township People's governments shall assist the real estate departments in supervising and managing the property service activities, guide the establishment of the owners' congress and the change of the owners' committee within their respective jurisdictions, supervise the owners' congress and the owners' committee to perform their duties according to law, and mediate property management disputes.
Residents' committees and villagers' committees shall perform their duties according to law, and support and guide the daily work of the owners' committee. Fifth city property service industry associations should strengthen industry guidance and industry self-discipline, standardize industry business practices, improve the service quality and service level of property service enterprises, and promote the healthy development of the industry. Chapter II Owners, Owners' Congress and Owners' Committee Article 6 Owners shall enjoy rights and perform obligations in property management activities according to law.
Owners can set up owners' meetings and elect owners' committees according to law.
If there is only one owner or a small number of owners, and the owners' meeting is not established with the consent of all owners, the owners shall perform the duties of the owners' meeting and the owners' committee. Article 7 In the property management area where the owners' assembly and the elected owners' committee have not been established, the neighborhood offices and township people's governments may designate the residents' committee or villagers' committee where the property is located as the owners' committee, but they shall obtain the written consent of the owners whose exclusive parts account for more than half of the total construction area and more than half of the total number. Eighth members of the owners' committee shall be elected among the owners who meet the following conditions:
(1) Having full capacity for civil conduct;
(two) law-abiding, enthusiastic about public welfare undertakings, strong sense of responsibility, with a certain degree of credibility and organizational ability;
(three) to pay the property service fee on time and perform the obligations of the owners in an exemplary manner;
(four) I and my close relatives are not in the same property management area to provide property services for enterprises or subordinate units;
(5) Having necessary working hours. Article 9 In the property management area, when the delivered exclusive part area exceeds 50% of the total construction area, the construction unit shall submit the following documents and materials to the district, county (city) real estate administrative department or subdistrict office or township people's government where the property is located:
(a) opinions on the division of property management areas;
(2) A list of the area of houses and buildings;
(3) List of owners;
(four) the general plan of building planning;
(five) the certificate of delivery of public facilities and equipment;
(six) the property management room configuration certificate;
(7) Other relevant documents. Tenth property management area has the conditions for the establishment of the owners' meeting, the owners can submit a written application for the establishment of the owners' meeting to the district, county (city) real estate department or subdistrict office or township people's government where the property is located; If the owner fails to apply within the time limit, the sub-district office and the Township People's Government shall organize and guide the establishment of the preparatory group for the owners' meeting.
The preparatory group consists of owners' representatives, street offices, representatives of township people's governments, district/county (city) real estate departments, residents' committees or villagers' committees, construction units, pre-realty service enterprises and representatives of original housing management units. The number of members of the preparatory group is more than seven and less than fifteen, of which the number of owners' representatives shall not be less than two thirds of the total number of the preparatory group, and the leader of the preparatory group shall be the representative of the sub-district office and the Township People's Government. The owners' representatives in the preparatory group are recommended by the sub-district offices and township people's governments. After the list of members of the preparatory group is determined, it shall be published in writing within the property management area.
After the owners' committee is established and put on record according to law, the preparatory group will terminate itself. Eleventh owners' committee to implement the decisions of the owners' congress, perform the following duties:
(a) to convene a meeting of the owners' congress and report on the implementation of property management;
(two) to implement the decisions and resolutions of the owners' congress;
(3) Signing a realty service contract with the realty service enterprise selected by the owners' congress;
(four) timely understand the opinions and suggestions of the owners and property users, and supervise and assist the property service enterprises to perform the property service contract;
(five) the implementation of supervision and management regulations;
(six) to urge the owners to pay property service fees and other related expenses;
(seven) to organize and supervise the collection and use of special maintenance funds;
(eight) to mediate disputes between owners due to the use, maintenance and service of the property;
(nine) other duties entrusted by the owners' congress. Twelfth owners' committee shall, within thirty days from the date of election, go through the filing formalities with the following documents to the district and county (city) real estate departments, sub-district offices and Township People's governments where the property is located:
(a) the establishment of the owners' meeting, the election of the owners' committee;
(2) Management regulations;
(three) the rules of procedure of the owners' congress;
(four) other major matters decided by the owners' congress.
With the consent of the owners' meeting, if the residents' committee or villagers' committee serves as the owners' committee, it shall also go through the filing formalities.
The owners' committee shall engrave and use seals according to law.
