Question 1. Can I refuse to pay the property fee because of the problems left by the developer?

You can't. The problem left by the developer is the legal problem between the owner and the construction unit, while the property fee is the legal problem between the owner and the property management company, and the two cannot be confused.

Question 2: Do you have to pay property fees if you don't live for a long time after buying a house?

Property management fees shall be paid for houses that the owners do not live in for a long time or vacant houses that the construction party has not sold. The reason for this is the following：

The service provided by the property management company is a kind of public service, that is, cleaning, security, greening, daily management of houses and communities in public areas. This kind of public service will not reduce the management cost because one or several people don't live here.

Question 3. Property companies neglect management, how should owners protect their rights?

If the service quality of the property management company is low and the basic living conditions of the residents in the community cannot be guaranteed, resulting in the infringement of the legitimate rights and interests of the owners, the owners can safeguard their rights and interests through the owners' meeting.

According to the provisions of Article 76 of the Property Law of People's Republic of China (PRC), with the consent of the owners whose exclusive parts account for more than half of the total building area and more than half of the total number, the realty service enterprise can be dismissed, and the management regulations of the building and its ancillary facilities can be formulated and revised.

Question 4. Can the owner claim compensation for the loss of his house being stolen?

This problem should be determined according to the provisions of the property contract. The realty service enterprise fails to provide security services in accordance with the stipulations of the realty service contract, such as insufficient number of security guards, fewer inspections, inadequate inspection scope, poor monitoring, unregistered entry and exit of foreign personnel, and large items moving out of the community. In short, only when the realty service enterprise fails to fully fulfill the security obligations stipulated in the contract can it bear the corresponding responsibility for the owner's theft.
