Measures for the administration of fire safety in residential areas of Xiangtan City

Chapter I General Provisions Article 1 In order to strengthen the fire safety management in residential areas, prevent and reduce fire hazards, and protect personal and property safety, these measures are formulated in accordance with the Fire Protection Law of People's Republic of China (PRC), the Measures for the Implementation of the Fire Protection Law of People's Republic of China (PRC) in Hunan Province and the actual situation in Xiangtan. Article 2 These Measures shall apply to the fire safety management of residential areas within the administrative area of this Municipality. Article 3 Fire safety management in residential areas shall implement the policy of putting prevention first and combining prevention with elimination, and realize the modernization of fire safety management system and management capacity in accordance with the principles of government leadership, departmental supervision, subject responsibility, multi-party participation and scientific and technological support. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over fire safety work in residential areas, take the lead in implementing the responsibility system for fire safety, promote the construction of public fire control facilities as a whole, establish a linkage mechanism for fire control law enforcement, actively explore the power of relatively centralized administrative punishment for fire control administrative law enforcement matters in residential areas, and coordinate and solve major problems in fire control work.

Township People's governments and sub-district offices shall incorporate fire safety management in residential areas into the scope of grassroots social governance, implement the responsibility system for fire safety, establish and improve the leading institutions for fire control work, determine fire safety management personnel, guide and support neighborhood committees and resident units to carry out mass fire control work, and organize and coordinate fire safety management affairs in residential areas within their respective jurisdictions. Article 5 The emergency departments of the people's governments of cities and counties (cities, districts) shall supervise and manage the fire control work in residential areas within their respective administrative areas, and the fire rescue agencies of the people's governments at the same level shall be responsible for the implementation.

City, county (city, district) people's government housing and urban construction, public security, urban management and law enforcement, agriculture and rural areas, education, human resources and social security, market supervision and other departments shall, according to their respective responsibilities, do a good job in the management and supervision of fire safety in residential areas. Sixth units and individuals are encouraged to carry out public welfare activities such as fire service, fire knowledge dissemination and fire rescue in residential areas.

Encourage property service enterprises, owners and property users to take out fire public liability insurance or family property insurance; Insurance companies are encouraged to take out fire public liability insurance and family property insurance. Article 7 All units and individuals have the obligation to maintain fire safety in residential areas, protect fire control facilities, prevent fires and report fire accidents. All units and adults have the obligation to participate in organized fire fighting.

Units and individuals that have made outstanding contributions to the fire safety work in residential areas shall be commended and rewarded in accordance with relevant regulations. Eighth organs, organizations, enterprises, institutions and other units, should be combined with their own responsibilities and work characteristics, actively carry out fire prevention publicity and education, improve fire safety awareness.

Radio, television, newspapers, internet and other media should carry out fire safety publicity free of charge.

Neighborhood (village) committees shall assist the people's governments and relevant departments to strengthen fire prevention publicity and education in residential areas. Chapter II Subjects and Responsibilities of Fire Safety Article 9 Owners, property users, owners' congresses, owners' committees and other relevant subjects shall perform their respective fire safety responsibilities or obligations according to law.

If the residential area is managed by a realty service enterprise, the realty service enterprise shall perform the responsibility or obligation of fire safety within the management area in accordance with the provisions of the state and the realty contract, and provide fire safety services.

The residential area is managed by the owners themselves, and the owners' autonomous management institutions do a good job in fire safety in residential areas with reference to the fire safety responsibilities of property service enterprises.

In residential areas where there is no property service enterprise or owner's self-management organization and management, neighborhood (village) committees shall organize and urge owners and property users to do a good job in fire safety in residential areas. Tenth owners and property users shall perform the following fire safety responsibilities or obligations:

(a) comply with the fire safety provisions of the fire safety convention and the property management agreement, and implement the decisions of the owners' congress and the owners' committee authorized by the owners' congress on fire safety management;

(two) do a good job in the fire safety of self-occupied houses, self-occupied facilities, equipment and venues, and timely investigate and eliminate potential safety hazards;

(three) to cooperate with and support the fire safety management work of neighborhood (village) committees, property service enterprises or owners' autonomous management institutions, and to take good care of fire control facilities and equipment in residential areas;

(four) to support the owners' congress, the owners' committee or the owners' autonomous management organization to use part of the owners' operating income or special maintenance funds for the maintenance of fire control facilities and equipment in residential areas according to law;

(five) other fire safety responsibilities or obligations stipulated by laws and regulations. Eleventh owners' congress and owners' committee shall perform the following fire safety responsibilities or obligations:

(a) to organize and urge the owners and property users to fulfill the responsibilities or obligations stipulated in Article 10 of these Measures;

(two) to supervise the property service enterprises to fulfill their obligations of fire safety service;

(three) to support the neighborhood (village) committees to carry out fire safety work and accept their fire safety inspection;

(four) according to the use of part of the operating income of the owner, apply for special maintenance funds or raise maintenance funds for the maintenance and transformation of fire control facilities and equipment;

(five) other fire safety responsibilities or obligations stipulated by laws and regulations.
