After the house has been delivered and the property rights have been registered, regardless of whether the owner actually lives, the property management company has provided property services, and the owner cannot refuse to pay the property fee for reasons such as not living in the house.
First, the newly purchased house is uninhabited. Whether to pay the property fee is handled in two cases:
1. If the house is not delivered to the owner, the owner does not need to pay the property fee, and the property fee is paid in full by the development and construction unit;
2. If the house has been delivered to the owner and the owner has not moved in, the owner still has to pay the property management fee.
Second, the way to deal with the property fees owed before buying a house:
1. First of all, a house purchase contract must be signed to reach a house sale, so if there is an agreement in the house purchase contract that the property fee is in arrears, it can be handled according to the agreement, and both the payment and the advance payment must be made.
Therefore, when buying a house, we need to pay attention to these problems. Although it can be solved in the future, it is a lot of trouble.
2. Secondly, if there is no such agreement in your house purchase contract, you can first negotiate with the original owner and ask him to pay the paid property fee, or you can deduct this part of the fee from the house purchase price and pay it on your behalf. If negotiation fails, the original owner can be required to pay off the debt and compensate for the losses caused by it through litigation.
3. Finally, if the property management company uses various means to force you to pay the property fees owed by the original owners, then you can collect information, file a lawsuit with the court, and ask the property management company to compensate for the losses caused.
Three, the property service fee or property service expenditure generally includes the following parts:
1, salary of management service personnel, social insurance and welfare expenses drawn according to regulations, etc. ;
2, the daily operation and maintenance costs of * * * parts of the property and * * * facilities and equipment;
3, property management area cleaning costs;
4, the property management area greening maintenance costs;
5, property management regional order maintenance costs;
6. Office expenses;
7. Depreciation of fixed assets of property management enterprises;
8. Part of the property, facilities, equipment and public liability insurance fees;
9. Other expenses agreed by the owner.
Legal basis:
Article 16 of the Notice of the National Development and Reform Commission and the Ministry of Construction on Printing and Distributing the Measures for the Administration of Property Service Charges has been completed but not yet sold, or the property has not been delivered to the property buyer on time due to the reasons of the development and construction unit, and the property service fee or property service fund shall be paid in full by the development and construction unit.
Fifteenth owners shall, in accordance with the provisions of the property service contract, pay the property service fee or property service fund in full and on time. If the owner fails to pay the service fee or property service fund within the time limit in violation of the property service contract, the owners' committee shall urge him to pay within a time limit; Overdue payment, property management companies can be recovered according to law.
If the owner and the user of the property agree that the user of the property shall pay the property service fee or the property service fund, the owner shall bear joint and several liability from the agreement.
When the property right is transferred, the owner or property user shall settle the property service fee or property service fund.
