Article 2 These Regulations shall apply to property management and related activities within the administrative area of the autonomous region. The construction administrative department of the people's government of the third autonomous region shall be responsible for the supervision and management of the property management activities in the whole region.

The real estate administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of property management activities within their respective administrative areas. Other relevant administrative departments shall, in accordance with their respective duties, do a good job in property management according to law. Fourth people's governments at all levels should strengthen the management of the property management industry, guide the establishment of a professional, socialized and market-oriented property management mechanism, and promote the healthy development of the property management industry. Chapter II Owners and Owners' Congress Article 5 The owner of a house is the owner.

The owners' rights and obligations in property management activities shall be implemented in accordance with the relevant provisions of the Regulations of the State Council Municipality on Property Management. Article 6 The rights and obligations of property users in property management activities shall be agreed by the owners and users, but they shall not violate the relevant provisions of laws, regulations and management regulations.

If the property user violates the provisions of these regulations and the management agreement, the relevant owners shall bear joint and several liability. Seventh a property management area to set up an owners' meeting.

The owners' meeting is composed of all owners in the property management area.

The owners' congress represents and safeguards the legitimate rights and interests of all owners in the property management activities within the property management area, and performs its duties in accordance with laws, regulations and the rules of procedure of the owners' congress. Article 8 The real estate administrative department of the people's government at the county level shall demarcate the property management area according to the facilities and equipment, building scale, community construction and other factors. The specific measures shall be formulated by the administrative department of construction of the people's Government of the autonomous region.

The local people's government should organize and manage the property areas with imperfect supporting facilities and no property management conditions, create conditions and gradually implement property management. Owners' representatives in the preparatory group are recommended by all owners in the property management area within the specified time.

Article 11 The preparatory group shall, within 30 days from the date of its establishment, organize the owners to hold the first owners' meeting under the guidance of the real estate administrative department of the people's government at the county level where the property is located or the sub-district office and the Sumu Township People's government, and elect the owners' committee through the management statute and the rules of procedure of the owners' meeting.

If there is only one owner, or the number of owners is small, and all the owners agree to decide not to set up the owners' meeting, the owners shall jointly perform the duties of the owners' meeting and the owners' committee. Twelfth owners' meeting can be in the form of collective discussion, but also in the form of written comments; However, there should be owners whose exclusive parts account for more than half of the total construction area and more than half of the total number of owners in the property management area.

The owners shall attend the owners' meeting. If he is unable to attend for some reason, he may entrust an agent to attend in writing. Thirteenth owners of the general assembly to make a decision, it should be approved by the owners whose exclusive parts account for more than half of the total area of the building and more than half of the total number of people. The decision of the owners' congress to raise and use special maintenance funds, and to rebuild and rebuild buildings and their ancillary facilities shall be approved by the owners whose exclusive parts account for more than two-thirds of the total building area and more than two-thirds of the total number.

The decision of the owners' meeting is binding on all owners in the property management area.

If the decision made by the owners' congress or the owners' committee infringes on the legitimate rights and interests of the owners, the infringed owners may request the people's court to revoke it. Fourteenth owners' meeting is divided into regular meetings and temporary meetings.

Regular meetings of the owners' congress shall be organized by the owners' committee in accordance with the rules of procedure of the owners' congress.

In any of the following circumstances, the owners' committee shall promptly organize an interim meeting of the owners' congress:

(a) more than twenty percent of the owners proposed;

(two) a major accident or emergency needs to be dealt with in time;

(three) other circumstances stipulated in the rules of procedure of the owners' congress or the management statute.

An interim meeting of the owners' congress shall be held. If the owners' committee fails to perform the duties of organizing the meeting, the real estate administrative department of the people's government at the county level shall order the owners' committee to hold the meeting within a time limit. Fifteenth owners' committee is the executive body of the owners' congress, and performs its duties according to law.

The number of owners' committees is determined by the owners' congress according to the actual situation, which is an odd number of three to nine.

The owners' committee shall elect one director and one to two deputy directors from among the members of the owners' committee.

Members of the owners' committee shall not work part-time in the realty service enterprise within the realty management area.

The owners' committee shall, within 30 days from the date of election, file with the real estate administrative department of the people's government at the county level where the property is located, the subdistrict office and the Sumu Township People's Government.
