Regulations of Chongqing Municipality on River Management (revised on 20 18)

Chapter I General Provisions Article 1 In order to strengthen the management of river courses, ensure the safety of flood discharge and drainage, protect the ecological environment of river courses and give full play to the comprehensive benefits of river courses, these Regulations are formulated in accordance with the People's Republic of China (PRC) Water Law, the People's Republic of China (PRC) Flood Control Law, the People's Republic of China (PRC) River Management Regulations and other laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, protection, management and utilization of rivers (including lakes, artificial waterways and flood discharge areas) within the administrative area of this Municipality, except for matters within the jurisdiction of the state. Third river management should adhere to the principles of scientific planning, strict protection, comprehensive management and rational utilization. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall incorporate the planning, protection, management and utilization of river courses into the plans for national economic and social development, and implement the required funds. Article 5 The municipal water administrative department shall be responsible for the guidance and supervision of river management within the administrative area of this Municipality, and its river management institution shall undertake specific work.

The water administrative departments of counties (autonomous counties) shall be responsible for the unified management of rivers within their respective administrative areas.

Other departments of the people's governments of cities, districts and counties (autonomous counties) shall, according to their respective responsibilities, do a good job in river management. Sixth township (town) people's governments and sub-district offices shall strengthen the daily management and protection of rivers within their respective jurisdictions.

Village (neighborhood) committees may formulate village rules and regulations or residents' conventions, guide village (neighborhood) residents to protect rivers, and report and accuse violations of laws and regulations on river management. Chapter II River Planning Article 7 The water administrative departments of cities, districts and counties (autonomous counties) shall organize the investigation and evaluation of river protection, management and utilization, establish the river registration system and management information system, publish the river list, and improve the basic information related to river planning. Article 8 The scope of river management with dikes includes waters, sandbanks, beaches (including cultivated land), flood discharge areas, dikes and berms on both sides.

The scope of river management without dikes shall be stipulated by the Municipal People's Government according to the national flood control standards. Article 9 The specific scope of river management shall be delineated by the water administrative department of a county (autonomous county) jointly with the departments of land and planning, and reported to the people's government at the same level for approval and promulgation, and reported to the municipal water administrative department for the record.

The water administrative departments of counties (autonomous counties) shall set up boundary markers and bulletin boards within the scope of river management. The bulletin board shall specify the name of the river, the scope of management, the management unit and the prohibited acts within the scope of river management. Tenth city, county (Autonomous County) water administrative department shall organize the preparation of river protection and utilization planning, after consulting the relevant departments, reported to the people's government at the same level for approval before implementation.

River protection and utilization planning should be subject to comprehensive river basin planning, regional comprehensive planning and flood control planning. The planning of waterway, port, fishery, urban and rural construction involving rivers should be connected with the planning of river protection and utilization. The relevant departments shall solicit the opinions of the water administrative department when preparing the above-mentioned plans.

River protection and utilization planning includes river protection, management and utilization. Among them, the content of river sand mining (including quarrying, hereinafter referred to as sand mining) planning should include exploitable areas, forbidden areas, exploitable periods, forbidden periods, mining methods and total sand mining. Chapter III Protection of River Channels Article 11 The management units of projects built and buried pipelines, cables and other facilities within the scope of river channel management shall strengthen safety inspection and maintenance, ensure the safe operation of engineering facilities, and prevent the damage of engineering facilities from impeding flood discharge in river channels.

Water retaining and storage projects within the scope of river management shall be operated in accordance with the approved dispatching scheme to ensure the reasonable ecological flow of the river and protect the ecological environment of the river. Article 12 The water administrative departments of counties (autonomous counties) shall organize the construction of dikes and revetment forests, reduce the erosion of dikes and revetments, protect the safety of dikes and revetments, prevent soil erosion on bank slopes, and beautify the river water environment. Thirteenth cities, districts and counties (autonomous counties) municipal departments should do a good job in cleaning up urban river garbage in accordance with the regulations, and keep the river clean and tidy. Article 14 The following acts are prohibited within the scope of river management:

(a) the construction of buildings and structures that hinder flood discharge;

(2) Building dikes, water blocking channels and water blocking roads;

(three) to fill and seal the rivers with a catchment area of more than two square kilometers;

(4) Abandoning or dumping wastes such as slag, stone slag, coal ash, soil and garbage;

(five) stacking materials that hinder flood discharge or affect the safety of dike revetment;

(six) planting trees or tall crops that hinder flood discharge (except dike shelterbelts);

(seven) set up aquaculture cages and fishing gear that hinder flood discharge;

(eight) occupation, damage to dikes, revetments, dams and other water engineering buildings;

(nine) occupy, damage or move the historical flood signs, boundary markers, bulletin boards, flood control, hydrological monitoring, communication lighting and other facilities that indicate the scope of river management;

(ten) engaged in building houses, grazing, digging ditches, drilling wells, digging pits, burying graves, drying grain, storing materials, exploiting underground resources, archaeological excavations and conducting market trade activities in dikes and berms;

(eleven) other acts that affect the stability of river regime, endanger the safety of bank protection of river embankments and hinder the flood discharge of river courses.
