Should developers pay property fees?

Legal analysis: A building reserved by the developer was developed and built by the developer during the construction of the community, and the developer uniformly handled the house ownership certificate including the building. At the same time, the building is located in a residential area, which forms a property management area together with other properties in the residential area. Therefore, the property under the developer's name should be in the same property management area as other properties, and a property management area should set up an owners' meeting. The decision of the owners' congress or the owners' committee is binding on all owners. The property service contract signed by Ding Sheng Property Company and the community owners' meeting is binding on the community owners. As the property owner of the building and the owner of the community, the developer should be bound by the Ding Sheng Property Service Contract. Therefore, developers should pay property fees.

Legal basis: Article 34 of the Regulations on Property Management in People's Republic of China (PRC), the owners' committee shall conclude a written property service contract with the property service enterprise selected by the owners' congress. Property service contracts shall stipulate property management matters, service quality, service fees, rights and obligations of both parties, management and use of special maintenance funds, property management premises, contract term, liability for breach of contract, etc.
