Who owns the residential property in Shenzhen?

The property right of the residential area belongs to the local real estate administrative department responsible for the property management within its administrative area.

1. According to Article 5 of the Regulations on Property Management, the construction administrative department of the State Council is responsible for the supervision and management of property management activities throughout the country. The real estate administrative departments of local people's governments at or above the county level shall be responsible for the supervision and management of property management activities within their respective administrative areas.

2. Article 82 of People's Republic of China (PRC) Property Law also has relevant provisions. The realty service enterprise or other managers shall manage the buildings and their ancillary facilities within the building division according to the entrustment of the owners, and accept the supervision of the owners.

3. The residential property right belongs to the housing and urban-rural construction department of the people's government at or above the county level or the real estate administrative department. The owner is responsible for supervision. The Property Law and the Property Management Regulations give all owners the initiative and supervision over property selection. The relevant units only guide the work of the property and community, and have no direct management right.
