Shanghai property fee charging standard

Legal analysis: Shanghai's residential property fees are charged according to different grades. According to the location and facilities of each community, the charging standards are different, and the property fees paid by different units in each community are also different. Under normal circumstances, the housing management department and the property management association will advocate that property companies and developers set the charging standard of property management fees according to the grade and specific service facilities of the community. The country divides residential areas into four grades, with the highest charging standard being 1 yuan/square meter and the lowest charging standard being 0.35 yuan/square meter per month. However, according to the difference of facilities, the charging standards of the same level residential areas are still different. Even in the same community, according to the differences in infrastructure conditions, property management fees vary greatly. For example, some residential areas have a very large construction area, a very good environment and comprehensive facilities, so the property management fee may be relatively high; Moreover, some residential hardware facilities are relatively poor, and some are relatively old, so property management fees may be less.

Legal basis: Article 942 of the Civil Law of People's Republic of China (PRC) stipulates that the property service provider shall, in accordance with the agreement and the nature of the use of the property, properly repair, maintain, clean, afforest and manage some owners in the property service area, maintain the basic order of the property service area, and take reasonable measures to protect the personal and property safety of the owners.

Property service providers shall take timely and reasonable measures to stop acts that violate laws and regulations such as public security, environmental protection and fire protection in the property service area, report to the relevant administrative departments and assist in handling them.
