Can property monitoring be retrieved at will?

Property monitoring owners can't just take it.

If the owner needs to check the monitoring of the residential property because of property losses or other reasons, then the owner can check it, but he needs to explain the situation with the residential property and get permission before checking it. Although the monitoring video data of the community belongs to all owners, some of the monitoring video data of * * * involve the legitimate interests of all other owners. Based on the requirement of privacy protection for all owners, individual owners have no right to request to extract surveillance video materials for viewing. Obligations that owners should perform in property management activities:

1, abide by the owners' convention and the rules of procedure of the owners' congress;

2. Abide by the rules and regulations on the use of * * * parts and facilities in the property management area, and maintain public order and environmental sanitation;

3. Implement the decisions of the owners' congress and the decisions of the owners' committee authorized by the owners' congress;

4, pay special maintenance funds in accordance with the relevant provisions of the state;

5. Pay the property service fee on time.

To sum up, the owners of residential property monitoring can't check casually. Although the surveillance video materials belong to all owners, some of them involve the interests of other owners. Based on the requirement of privacy protection for all owners, individual owners have no right to extract surveillance video materials for viewing.

Article 286 of the Civil Code of People's Republic of China (PRC)

Owners shall abide by laws, regulations and management regulations, and relevant behaviors shall meet the requirements of saving resources and protecting the ecological environment. For property service enterprises or other managers to implement emergency measures and other management measures implemented by the government according to law, the owners shall cooperate with them according to law.

The owners' assembly or the owners' committee has the right to ask the perpetrator to stop the infringement, remove the obstruction, eliminate the danger, restore to the original state and compensate for the loss of any act that damages the legitimate rights and interests of others, such as dumping garbage at will, discharging pollutants or noise, raising animals illegally, building illegally, occupying passages illegally, refusing to pay property fees.

If the owners or other actors refuse to perform relevant obligations, the parties concerned may report or complain to the relevant administrative departments, which shall deal with them according to law.

Article 1032

Natural persons have the right to privacy. No organization or individual may infringe upon the privacy rights of others by spying, harassing, exposing or making public.

Privacy is the private space, private activities and private information that natural people live in peace and don't want to be known by others.

Article 1033

Unless otherwise provided by law or expressly agreed by the obligee, no organization or individual may commit the following acts:

(a) by telephone, SMS, instant messaging tools, e-mail, leaflets, etc. Disturb the private life of others;

(2) Entering, taking photos or peeping into other people's private spaces such as houses and hotel rooms;

(3) Shooting, peeping, eavesdropping or revealing other people's private activities;

(4) Shooting or peeping at the private parts of others' bodies;

(5) handling other people's private information;

(6) Infringe upon the privacy of others in other ways.
