This year, the Civil Code was formally implemented, which made it clear that "vacant houses need to pay property fees": as long as the property management company provides corresponding residential services in accordance with the property contract, the owners can't use "I didn't enjoy the service" as an excuse not to pay property fees.

However, "long-term vacant houses" can also be completely exempted from paying full property fees. The Property Law stipulates that vacant houses that are not qualified for occupancy because they have not been renovated, or vacant houses that have not been used for a long time after occupancy (house decoration), shall pay the property service fee according to 70% of the charging standard agreed in the property service contract from the date of acceptance or the owner's report to the property service enterprise.

In addition, according to the regulations, there are still three property fees that need not be paid: the fees set by the property itself need not be paid. As the name implies, unreasonable and compliant property fees of property companies can be exempted. As long as the property fee is paid in accordance with the property contract, the name of the fee formulated by the property company itself can be exempted, and the property company has no right not to provide normal property services. However, in some special circumstances, such as installing elevators in old communities, elevator management fees can be added as long as all owners agree. There is no need to pay property fees for delaying delivery. Buying an auction house will inevitably lead to a delay in the delivery time. In this case, it is unreasonable to ask the owner to pay the property fee again, because the owner can refuse to pay the property fee because he has not taken over the house and naturally has not started to enjoy the property service.

If the supporting facilities are not up to standard, some property fees can be reduced or exempted. According to the new regulations, the owner may have the right to ask for a part of the property fee reduction, and the part of the reduction shall be borne by the developer. Owners can wait for the facilities to reach the standard before paying the property fee. For example, the delivery standard of real estate is far from the publicity when buying a house. The owner judges the developer's breach of contract through reasonable channels and makes rectification within a time limit. During the rectification period, the developer should reduce the corresponding property fees. Then, the house is like this. What about the "vacant shops"? As we all know, if the location is not good, the vacant period of shops will be longer than that of houses, and the unit price of property fees of shops will be more expensive. If the store is not rented out, it is still necessary to pay the property fee, which is naturally a loss for the owner. In this case, you can actually negotiate with the property company and apply to the property company for a part of the property fee reduction. For example, pay 50%-70% of the property fee during the vacant period of the store.

Legal basis:

Article 42 of the Property Management Regulations stipulates that the owner shall pay the property service fee in accordance with the property service contract. If the owner and the user of the property agree that the user of the property shall pay the property service fee, the owner shall bear joint and several liability from the agreement.
