According to the Property Law, the Supreme People's Court's Interpretation on Several Issues Concerning the Specific Application of Laws in the Trial of Disputes over the Ownership of Buildings, Shanghai's Provisions on the Administration of Residential Property, Shanghai's Interim Provisions on the Administration of Motor Vehicle Parking in Residential Property Management Areas and other laws, regulations and judicial interpretations, the planning of parking spaces and garages for parking cars should first meet the needs of community owners within the building division; Parking spaces shall not be transferred to units or individuals outside the property management area; Parking spaces that have not been sold by the construction unit shall be leased to the owners and users for parking; Parking spaces can be temporarily leased to units and individuals outside the property management area if conditions permit. If all motor vehicle parking spaces owned by the construction unit are leased to owners and users, the charging standard shall be implemented in accordance with the provisions of the competent price department.

Parking spaces in residential areas are mostly scarce, especially in many downtown residential areas in Shanghai. In order to alleviate the problem of parking difficulties, public areas in residential areas will be used to provide temporary parking for vehicles entering and leaving.

According to the above-mentioned laws and regulations, parking spaces or other parking spaces that occupy the owner's roads are owned by the owner. The parking, charging and management of all vehicles in the * * * area shall be decided by the owners' meeting of the community. If the owners' congress decides to charge for parking vehicles, the reference price shall be the charging standard stipulated and determined by the competent department. Before the establishment of the owners' congress, if vehicles are parked in the property management area, the charging standard shall be implemented in accordance with the provisions of the competent price department.

Using the public area owned by the owner as a temporary parking space belongs to "other major matters involving the management rights of * * * and * * *" as stipulated in the Property Law, which is decided by the owner. Therefore, before the first owners' meeting, the charging standard for temporary parking spaces should be implemented in accordance with the provisions of the competent price department. After the establishment of the owners' meeting, the temporary parking fee can be decided by all owners through convening the owners' meeting, and should be agreed by the owners whose exclusive parts account for more than half of the total construction area and more than half of the total number.

The meeting of the owners' congress may take the form of collective discussion or written comments. The meeting of the owners' congress shall be attended by the owners whose exclusive parts account for more than half of the total construction area in the property management area, and the owners who account for more than half of the total number. The owner may entrust an agent to attend the meeting of the owners' congress, and the agent shall hold a written power of attorney from the owner and vote according to the opinions of the client on the matters discussed.

The charging standard for temporary parking spaces decided by the owners' congress shall be stipulated in the owners' convention. Parking fees should be posted in the community, clearly marked. The fees charged by the owners of this residential area shall be unified, and the fees and price increases for vehicles temporarily parked outdoors shall also be decided by the owners' assembly of this residential area according to the above procedures.

Parking fees can't be set casually. At present, all kinds of parking charges, such as temporary parking spaces in residential areas, are basically set by the competent price departments of all districts and counties, and each district can set specific prices within the guidance price announced by the competent price department according to its own situation. In addition, according to the relevant regulations of the competent price departments of all districts and counties, the parking fees of residential areas should also be declared, reviewed or filed accordingly.
