Does security belong to a department of the property management company?

Article 1 of "Several Provisions of the Ministry of Public Security on the Standardized Management of Security Service Companies" stipulates that "security service companies are special enterprises that provide professional and paid security services for the society and are an important force to assist public security organs in maintaining social order and preventing and reducing crimes"; Article 3 stipulates that "security service companies can only be established by public security organs, and no other unit, department or individual may establish them". It can be seen that the security service industry is now restricted by the state. A property management company has set up a security department, which is not a security service enterprise established by public security organs, and its business scope does not include security services. According to Article 10 of the Supreme People's Court's Interpretation on Several Issues Concerning the Application of the People's Republic of China (PRC) Contract Law, "If the parties enter into a contract beyond their business scope, the people's court will not consider the contract invalid. However, unless it violates the provisions of state restrictions on business operation, franchising and laws and administrative regulations, two safety service management contracts signed by a property company and a department store shall be deemed invalid because it violates the provisions of state restrictions on business operation. Article 47 of the Property Management Regulations stipulates that "property service enterprises shall assist in the security work within the property management area" and "property service enterprises shall abide by the relevant provisions of the state when hiring security personnel". It can be seen that the property service company has the right to assist the security service, but has no right to form a security company. To sum up, security does not belong to the department of the property company.
