Provisions of Shenyang Municipality on Urban Snow Removal

Article 1 In order to strengthen the management of urban snow removal, ensure smooth roads, traffic safety and clean environment, these Provisions are formulated in accordance with the Regulations of Shenyang Municipality on the Administration of Urban Environmental Sanitation and the Regulations of Liaoning Province on the Administration of Urban Appearance and Environmental Sanitation, combined with the actual situation of this Municipality. Article 2 Units and individuals within the administrative area of this Municipality shall abide by these Provisions. Article 3 The snow removal work in this Municipality shall be managed at different levels, and the regional responsibility system shall be implemented.

The municipal administrative department of urban construction is the competent department of snow removal in this municipality. City snow removal headquarters office is responsible for the organization, coordination, supervision and inspection.

District and county (city) people's governments and sub-district offices shall set up snow removal headquarters to be responsible for snow removal within their respective jurisdictions.

District, county (city) people's government and the relevant departments of the Municipal People's government should cooperate closely to do a good job in snow removal. Fourth city, district, county (city) snow removal costs required by the headquarters, as special funds, should be included in the fiscal budget at the same level. Fifth annual snow removal work before the start, the street offices to the district and county (city) people's government to pay the deposit; District, county (city) people's government to pay the deposit to the Municipal People's government, the deposit into the financial accounts management. After the snow removal work is completed, the deposit will be refunded in full if it meets the standard, and part or all of the deposit will be deducted if it does not meet the standard. Article 6 The responsibility system shall be implemented for snow removal in cities. City snow removal headquarters and district/county (city) people's governments, district/county (city) people's governments and sub-district offices, snow removal responsibility units and management departments that arrange snow removal tasks shall sign snow removal responsibility forms, clarify responsibilities and strengthen supervision and management.

City snow removal headquarters organized a professional team, responsible for the snow removal work of the main streets, bridges and squares stipulated by the Municipal People's government.

District, county (city) people's government is responsible for the snow removal work of other first, second and third grade streets and the three-package area in front of them. The responsibility for snow removal of cross streets between districts is divided according to the scope of responsibility for street cleaning in each district.

Sub-district offices are responsible for snow removal organization, coordination, supervision, inspection and management within the jurisdiction of Grade IV Street and the Three Guarantees area in front of the door, residential quarters, property quarters and market stalls. Seventh residential property management, snow removal work by the property management companies; The community is responsible for residential areas without property management; The management department is responsible for clearing the snow in the market stalls; The development and construction unit shall be responsible for the snow removal of the relocation site and the adjacent streets of the construction site. Article 8 The division of snow removal responsibility sections shall be based on the total number of registered employees in snow removal units, the number of employees in individual industrial and commercial households and the number of registered teaching and administrative staff in colleges and technical secondary schools, with the average per capita of 20 square meters to 45 square meters as the standard.

Units or individuals without snow removal capacity voluntarily pay for OEM, and the fee is changed to the standard fee of 3 yuan where the snow per square meter per field does not exceed. In addition, the fees charged are included in the management of financial accounts. Ninth urban snow removal mechanization operation should be timely snow removal, edge snow removal, leaving no snow. Main streets, primary and secondary streets, squares and bridges shall be cleared within 24 hours after the snow stops. Other streets and the three-package area in front of the door should be cleared within 48 hours after the snow stops. Article 10 After each snowfall, the quality of snow removal shall be guaranteed, so that there are no empty sections and no missing sections, and kerbs are exposed. Snow that does not need to be transported outside should be neatly stacked in the designated location. Eleventh any unit or individual shall not arbitrarily throw sand and ashes on the ice and snow road; Not in the electric bus station, transportation facilities, garbage containers, toilets and other public facilities around the accumulation of snow or piled up on trees, hedges; Don't dump garbage, dirt and sewage on the snowdrift. Twelfth for the outward transport of snow, in addition to secondary schools, the snow removal responsibility unit shall undertake the task of transporting snow and discharge snow at designated places. Due to special circumstances or really unable to transport snow, it can be transported with compensation, and the freight is charged at 0.5 yuan per square meter. Thirteenth invoices should be issued to the entrusting unit or individual, and their income should be included in the unified financial management of the unit. Fourteenth units and individuals that have made outstanding contributions to snow removal work shall be commended and rewarded by the people's governments at all levels. Fifteenth in addition to secondary schools, in violation of the provisions of the units or individuals, the municipal ice and snow management department shall order them to make corrections within a time limit, overdue correction, to the city of informed criticism, and give the following penalties:

(1) The responsible unit or individual who refuses to accept the snow removal task shall be fined 10 yuan per square meter of snow, and the person in charge of the unit shall be fined up to 500 yuan.

(two) units or individuals that fail to clear the snow in time or whose quality does not meet the standard, according to the snow area, impose a fine of 5 yuan per square meter of snow, and impose a fine of 300 yuan on the person in charge of the unit.

(three) units or individuals responsible for the road icing caused by the overflow of sewers or tap water and snowmelt water. Should be responsible for removing them within 24 hours. If it is not removed in time, it shall be fined in 5 yuan per square meter, and the person in charge of the unit shall be fined in 300 yuan. Article 16 Any unit or individual that, in violation of these regulations, dumps garbage, dirt and sewage on a snowdrift or scatters sand, gravel and ash on an icy road surface shall be fined 300 yuan. Article 17 Units or individuals that dump snow indiscriminately shall be ordered to make corrections and be fined between 65,438 yuan and 65,438 yuan and 0,000 yuan. Eighteenth hinder snow removal management personnel to perform official duties or beat snow removal personnel and snow removal management personnel, by the public security department in accordance with the relevant provisions of the "Regulations of the people's Republic of China on administrative penalties for public security" to give administrative punishment; If a crime is constituted, criminal responsibility shall be investigated according to law.
