Regulations of Urumqi Municipality on Urban Greening Management (revised in 2002)

Chapter I General Provisions Article 1 In order to strengthen the management of urban greening in this Municipality, promote greening construction, maintain and improve the ecological environment, improve the level of urban greening and beautification, and improve people's physical and mental health, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on Urban Greening and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, protection and management of urban greening within the urban planning area of this Municipality. Article 3 The term "green space" as mentioned in these Regulations includes public green space, residential green space, unit attached green space, protective green space, production green space, scenic forest land, urban road green space and other green land.

Greening facilities include garden buildings, sculptures, guardrails, signs and other facilities used for urban greening. Fourth Municipal Greening Committee unified organization and leadership of the city's greening work. District (county) Greening Committee organizes and leads the greening work in this area.

City and district (county) garden department is responsible for the management of landscaping in this area. Except as provided for by laws and regulations and managed by the forestry administrative department. Fifth, vigorously carry out voluntary tree planting activities for all. Units stationed in this city and citizens who have the ability to work shall perform tree planting and other greening obligations in accordance with the regulations. Sixth urban greening construction should be incorporated into the national economic and social development plan, encourage and strengthen the scientific research of urban greening, popularize advanced technology, and improve the scientific and artistic level of urban greening. Seventh city greening work, should implement the principle of combining professional management with mass management.

All units and individuals should take good care of urban flowers, trees and greening facilities. Stop and report acts that damage urban flowers, trees and greening facilities. Eighth city construction and transformation, should increase the area of urban green space at the same time, it is strictly prohibited to reduce the area of urban green space.

Encourage the greening development and construction of barren hills, beaches, ditches and wasteland. Article 9 Units and individuals under any of the following circumstances shall be commended and rewarded by the municipal and district (county) people's governments:

(a) have made remarkable achievements in urban greening work;

(two) made outstanding contributions in the construction of key greening projects;

(three) have made remarkable achievements in scientific research and technology promotion of landscaping;

(four) other awards that should be commended. Chapter II Planning and Construction Article 10 The urban green space system planning of this Municipality shall be compiled by the municipal planning administrative department in conjunction with the municipal garden department, and shall be organized and implemented by the municipal garden department after being approved by the Municipal People's Government. The greening of railways, highways, coal mines, reservoirs, main canals and other places shall be undertaken by subordinate units in accordance with the requirements of the unified planning of the whole city.

Units and residents with courtyards are responsible for the greening of land use and surrounding greening management areas.

The greening of residential areas is the responsibility of the housing construction unit or the property management unit. Twelfth urban green space system planning to determine the green land index, shall not be less than 35% of the total area of urban land. Thirteenth the proportion of the following green space in the total area shall meet the following standards:

(a) the proportion of urban main road green space in the total land for roads shall not be less than 25%; The proportion of the green area of secondary roads to the total land for roads shall not be less than15%;

(two) the green land area in public green space shall not be less than 70% of the total land area:

(three) the total width of the green belt around the reservoir and on both sides of the railway shall not be less than 30 meters; The width of the green belt on both sides of the main canal should reach 5- 10 meter;

(four) the green rate of new construction, expansion and reconstruction of residential areas and units shall not be less than 35%.

According to the provisions of item (4) of the preceding paragraph, if it is indeed difficult for the green rate of the construction unit to reach the prescribed standard, with the approval of the Municipal People's Government, part of the greening can be carried out, and the area of ex situ greening shall not exceed half of the prescribed green area. Fourteenth new construction, expansion, renovation of residential areas, office areas, production areas, the planning and design of the green area does not meet the provisions of Article 13, paragraph 1 (4) of the standard (including the approved expansion, renovation project green area), the city planning department shall not issue a construction project planning permit.

Ex situ greening shall be completed by the construction unit according to regulations. The construction unit that cannot complete the ex situ greening by itself may pay the compensation for the greening construction required for ex situ greening according to the regulations, and the competent garden department shall carry out ex situ greening according to the greening plan. Fifteenth new construction, expansion and reconstruction projects should be included in the budget of greening construction costs, accounting for 3% of the total infrastructure investment (excluding equipment purchase costs). The requisition and relocation of green land and construction land are carried out simultaneously. Sixteenth in the second year after the completion of the infrastructure project, the municipal competent department of landscape architecture shall accept the greening construction. Seventeenth city greening project design should be entrusted with the corresponding qualification certificate of the design unit.

The design scheme of the greening project attached to the construction project shall be examined and approved in accordance with the basic construction procedures, and the municipal competent department of landscape architecture shall participate in the examination.

The design scheme of urban public green space, residential green space, scenic woodland, trunk road green belt and other greening projects shall be reported to the municipal competent department of landscape architecture for approval in accordance with the regulations.

The construction unit must carry out the construction according to the approved design scheme. When the design scheme really needs to be changed, it must be approved by the municipal competent department of landscape architecture.
