Measures for the implementation of the management of residential property service charges in Jinan City
Article 1 In order to regulate the charging behavior of residential property services and safeguard the legitimate rights and interests of owners, property users and property service enterprises, in accordance with the People's Republic of China (PRC) Price Law, the Regulations on Property Management in Shandong Province and the Measures for the Administration of Residential Property Services in Shandong Province (No.201185) and other laws and regulations,
Article 2 These Measures shall apply to residential property service charges and their supervision and management within the administrative area of this Municipality.
Article 3 The term "residential property service charges" as mentioned in these Measures refers to the fees charged by property service enterprises to the owners or property users for the maintenance, conservation and management of houses, supporting facilities, equipment and related sites in residential areas, and for maintaining the environmental sanitation and related order in the property management area.
Article 4 Advocate owners to choose property service enterprises through an open, fair and just market competition mechanism, encourage property service enterprises to conduct legitimate price competition, prohibit price fraud, and promote the formation of property service charges through market competition.
Fifth residential property service charges should follow the principles of rationality, openness and the adaptation of charges to service levels.
Article 6 The municipal price administrative department shall, jointly with the municipal property administrative department, formulate the city's residential property service charge policy according to the relevant provisions of the state and the province, and be responsible for the supervision and management of the city's residential property service charge.
Counties (cities), district price departments in conjunction with the property departments at the same level shall be responsible for the supervision and management of property service charges within their respective administrative areas in accordance with the price management authority.
Seventh residential property services charges according to the types, characteristics and stages of property services, respectively, the implementation of government-guided prices and market-regulated prices.
Article 8 Owners and property service enterprises may agree on property service fees in the form of contract system or gratuity system.
The contract responsibility system refers to the way that owners and property users pay a fixed property service fee to the property service enterprise, and the profits or losses are enjoyed or borne by the property service enterprise.
The contract gratuity system refers to the method of paying the contract gratuity to the property service enterprise in advance according to the agreed proportion or amount, and the rest is used for the expenses agreed in the property service contract, and the balance or deficiency is enjoyed or borne by the owner and the property user.
Ninth ordinary residential property service fees, parking service fees to take the contract system, the implementation of government guidance. The benchmark price and floating range of Lixia District, Shizhong District, tianqiao district, Huaiyin District, Licheng District and High-tech Zone shall be formulated by the municipal price department jointly with the municipal property department, and announced to the public every year after being approved by the Municipal People's Government. The benchmark price and floating range of counties (cities) and Changqing District shall be formulated by the price department in conjunction with the real estate department at the same level, reported to the people's government at the same level for approval and announced to the public every year. The specific charging standard shall be within the specified benchmark price and floating range, and shall be agreed by the construction unit and the property service enterprise in the contract.
After the establishment of the owners' committee, the property service fees and parking service fees of non-ordinary houses and ordinary houses shall be subject to market adjustment prices, which shall be agreed by both parties in the contract.
Tenth ordinary residential property service fees according to the level of property service, service quality, service cost and other factors, the implementation of hierarchical pricing. Parking service fees are priced according to parking service standards, service quality and other factors.
Ordinary residential property service level standards and parking service standards shall be formulated and promulgated by the municipal property department in conjunction with the municipal price department. Counties (cities) and Changqing District refer to the implementation.
Eleventh ordinary residential property service fees or property service expenditures generally include:
(1) Managing the salaries, social insurance and welfare benefits of service personnel. ;
(two) the daily operation, maintenance and testing costs of the parts and facilities used by the property;
(three) the cost of cleaning the property management area;
(four) the cost of greening and maintenance in the property management area;
(5) Maintenance fee for regional order of property management;
(6) office expenses;
(seven) the depreciation of fixed assets of property service enterprises;

(nine) other expenses agreed by the owner.

The cost of maintenance, renovation and transformation of the parts and facilities used by the property shall be charged by special maintenance funds and shall not be included in the expenditure or cost of property services.
The property rights of professional operating facilities and equipment belong to professional operating units, and their operation, maintenance, conservation and renewal costs shall be borne by professional operating units, and shall not be included in the expenditure or cost of property services.
Article 12 The prophase realty service contract signed by the construction unit and the realty service enterprise shall stipulate the following contents: realty service level, realty service content, service standard, charging standard, charging method and charging start time, contract termination, etc. Where the interests of property buyers are involved, the agreement shall be consistent.
The housing sales contract signed by the construction unit and the property buyer shall include the above-mentioned property service contract.
The realty service enterprise shall, within 30 days from the date of signing the preliminary realty service contract with the construction unit, file the business license, qualification certificate, realty service contract and realty service fee with the price department of the city, county (city) and Changqing District where the property is located.
Thirteenth owners or property users shall pay monthly property service fees from the date of delivery of the property. Property that has been included in the scope of property services but has not been delivered to the owners or property users, the property service fee shall be paid by the development and construction unit.
If the owner or the user of the property delays the delivery formalities without justifiable reasons, the property service fee will be charged monthly from the date when the construction unit notifies the owner or the user of the property in writing to handle the delivery formalities.
If there is an agreement in the property service contract, the property service fee can be collected in advance, and the time of collection in advance is generally not more than half a year.
Fourteenth property service fees are charged according to the legal property area of the house (excluding the supporting storage area of the house).
Property service charges designed for business premises, garages and warehouses shall be subject to market adjustment prices, which may be higher than residential property service charges, and shall be determined by both parties through consultation.
Article 15 If the supporting facilities and green environment in the property management area fail to meet the agreed standards in the purchase contract due to the staged development and delivery by the development and construction unit, the property service fee paid by the owner shall be appropriately reduced or exempted within 30% of the agreed charging standard, and the development and construction unit shall negotiate with the property service enterprise, and the construction unit shall compensate the property service enterprise for the difference.
Article 16 If the house is vacant for more than half a year after delivery, the property service fee shall be paid according to 70% of the property service fee standard after confirmation by the owner or property user and the property service enterprise, unless otherwise agreed in the contract.
Article 17 Where the remuneration system for property service fees is implemented, the property service fees received in advance belong to the escrow nature and belong to the paid owners, and the property service enterprise shall not use them for expenses other than those stipulated in the property service contract.
The realty service enterprise shall announce the annual budget and final accounts of realty service funds to the owners' assembly or all owners, and announce the income and expenditure of realty service funds at least once a year.
