Procedures for property management enterprises to quit the enterprise community
In order to promote the healthy and orderly development of the property management industry, these Provisions are formulated in accordance with the Regulations of Guiyang Municipality on Property Management and the Regulations of Guiyang Municipality, combined with the actual situation of our city.
A, property management activities, under any of the following circumstances, the owners can legally terminate the property service contract, dismissal of property management companies; (a) the expiration of the property service period; (two) due to force majeure, the property service contract can not be performed normally; (three) the property management enterprise fails to fulfill the obligations stipulated in the property service contract;
Two, the owners to terminate the property service contract, according to the relevant provisions of the state, province and city.
Three, in the property management activities, under any of the following circumstances, the property management enterprise may make provisions to terminate the property service contract and stop the property management activities: (a) the property service contract expires; (two) due to force majeure, the property service contract can not be performed normally; (three) the owner violates the service contract, which makes the property management enterprise unable to perform the property service contract normally.
Four, the property management enterprise to make a decision to withdraw from the property service area, it shall notify the owners' committee or the owners' representative in writing, and shall inform the office where the property is located and the property management department; If the dismissed party has any objection, it can be settled through consultation or bring a lawsuit to the people's court according to law.
5. Before the property management enterprise withdraws from the residential area under its management to terminate the property service contract, it shall make an announcement in the residential area and make the following publicity: (1) Announcement and reasons for withdrawing from the residential area under its management; (two) the property management fee revenue and expenditure publicity; (three) the time to withdraw and the time and place to hand over the relevant materials; (four) other matters that need to be informed; The above publicity materials should be publicized 20 days in advance.
Six, the property management enterprise shall, within 20 days from the effective date of the decision to terminate the property service contract, complete the transfer and withdrawal to the owners' committee (or the owner's authorized representative). If the handover fails to be completed as scheduled, both parties shall agree on another handover time before leaving first;
7. The property management enterprise shall hand over the following contents before withdrawing from the residential area it manages to terminate the property service contract: (1) If the property maintenance fund is entrusted, it shall hand over the list of owners and accounts; (2) Property management places; (three) the owner's floor, area, name and other files; (four) the property management fee and decoration deposit paid by the owner after the date of withdrawal; (five) fire, water, electricity, gas, elevators and other acceptance data; (6) Acceptance data of foundation, underground pipeline and other concealed works; (7) Other relevant drawings.
Eight, due to the fault of the property management company to terminate the property service contract, causing losses to the owners, it should be compensated according to law; If the property service contract is terminated due to the fault of the owner, causing losses to the property management enterprise, the property management enterprise may demand compensation for the losses and compensate its non-transferable upfront investment according to law.
