Article 1 In order to regulate the behavior of property service charges and safeguard the legitimate rights and interests of owners, property users and property service enterprises, according to the Price Law of People's Republic of China (PRC), the Regulations on Property Management, the Measures for the Administration of Property Service Charges of the National Development and Reform Commission, the Regulations on Property Management of Harbin City and the General Office of Harbin Municipal People's Government on Printing and Distributing.

Article 2 These Measures shall apply to the maintenance, conservation and management of houses, supporting facilities, equipment and related sites, the maintenance of environmental sanitation and order within the property management area, and the collection of fees from owners by the property service enterprises in this city.

Article 3 The charging of property services shall follow the principles of reasonableness, openness and adaptability between fees and service levels.

Advocate construction units and owners to choose property service enterprises through an open, fair and just market competition mechanism; Encourage property service enterprises to carry out legitimate price competition, prohibit price fraud, and promote the formation of property service norms and charging standards through market competition.

Article 4 Property service charges shall be subject to government-guided prices and market-regulated prices respectively according to the nature and characteristics of different properties.

Residential (excluding villas and apartments, the same below), elevators, single garages, indoor parking spaces and parking spaces set in public places shall be charged at government-guided prices.

By the construction unit special planning and construction, residential courtyard for residents to provide business property (excluding street shops), property service charges can refer to the residential property service charges appropriate floating, floating range in principle is not higher than 30%.

Property service charges for villas, apartments, shopping malls, hotels, office buildings, etc. shall be subject to market-adjusted prices.

Unless otherwise stipulated by government departments, the fees for agency services and other special services provided by the owners shall be subject to market-regulated prices.

Article 6 Residential property services are divided into three parts: basic property services, differential property services and unique property services.

Basic property service is the most basic property service project and the service standard that property service must meet. Including basic management, daily maintenance of roof, secondary pressurized water supply, septic tank cleaning and unit electronic door maintenance.

Differentiated property service is to provide graded property service standards according to service items and service quality on the basis of meeting basic property services. Including comprehensive management, maintenance of public order, daily operation and maintenance of facilities and equipment used by * * *, cleaning service, snow removal and greening maintenance. Each service item is divided into one to four levels according to the service level standard from low to high.

Basic property services and differential property services constitute basic property services.

Unique property service is a single property service provided for owners according to the needs of building facilities and property services. Including elevator management, decoration management, vehicle management and public liability insurance.

Seventh property services, standards and service levels shall be formulated and promulgated by the municipal administrative department of property. (See Annex 1 of Harbin Residential Property Service Guidance Standard for details)

The pricing cost of basic property services is calculated and published by the municipal price administrative department (see Annex 2 of Harbin Residential Property Services Pricing Cost Standard for details), and adjusted in time according to factors such as social and economic development level.

Article 9 The charging unit of property services is RMB/month × square meter (construction area), which is charged by month, quarter and year, and the advance payment period shall not exceed 12 months.

Tenth basic residential property service charges for the implementation of government guidance prices are determined in accordance with the following provisions:

I. Upon the decision of the owners' meeting, the owners' committee and the realty service enterprise negotiate to determine the realty service standard and the realty service charging standard.

According to the characteristics and requirements of property services, according to the "Harbin residential property service guiding standards", the property service standards are determined through consultation.

After the property service standard is determined, according to the "Harbin residential property service pricing cost standard" and the provisions of Article 8 of these Measures, the property service charging standard is determined through consultation.

For the property service items not specified in Harbin Residential Property Service Guiding Standard, the content and charging standard of the property service shall be determined by both parties through consultation.

Second, if the owners' meeting has not been established, the local neighborhood offices and community neighborhood committees shall solicit the opinions of the owners whose exclusive parts account for more than half of the total construction area. After the owners who account for more than half of the total units agree, they will negotiate with the property service enterprises on behalf of the owners to determine the property service standards and property service charges that meet the provisions of the preceding paragraph (the same below).

Third, for residential households, the property service enterprise shall report to the district property administrative department to confirm the actual property service standards, and report the confirmation results to the municipal property administrative department for the record; The municipal price administrative department shall, according to the filing documents issued by the municipal property administrative department, verify the property service charges of property service enterprises, indoor parking lots and elevators.

Four, for residential households, the realty service enterprise shall sign a realty service contract with the owner in accordance with the service level confirmed by the district property administrative department and reported to the municipal property administrative department for the record and the charging standard approved by the municipal price administrative department. The content of the implementation period of the charging standard in the property service contract shall be subject to the approval document of the municipal price administrative department.

Article 12 Where the construction area or apartment type registered in registered permanent residence exceeds 50% or the proportion of households who have lived for two years and have registered in registered permanent residence exceeds 25%, the owners' meeting shall be held and the owners' committee shall be elected. In accordance with the provisions of Article 10 of these Measures, the charging standards for property services shall be renegotiated.

Article 14 When the property right is transferred, the property owner or user shall be responsible for settling the property fee, elevator fee, etc. The property service fees incurred in the current month and before the transfer of property rights shall be borne by the transferor of property rights; The property service fee from the next month after the date of transfer of property rights shall be borne by the transferee of property rights; Unless otherwise agreed by both parties, the agreement of both parties shall prevail.

Fifteenth property services supervision to implement the daily assessment system. If the continuous assessment fails, the service level and charging standard of differentiated property services will be reduced.

Article 18 The property service fee for the indoor parking lot used for supporting residential construction includes the comprehensive management, cleaning, security, daily operation and maintenance of facilities and equipment. Nineteenth with the consent of the owners' meeting, the use of parking spaces in public spaces in the property management area and the collection of fees, after deducting the management service fee, shall be owned by all owners and used according to the decision of the owners' meeting. Twentieth for the owners or property users with housing decoration needs, the property service enterprise shall sign a decoration management agreement with them, and urge them to abide by the relevant provisions. Property companies can charge decoration management fees for the construction waste removal, elevator vertical lifting and decoration management fees during the decoration period. The specific charging standard shall be implemented in accordance with Harbin Residential Property Service Pricing Cost Standard (Annex 2 "Government Guidance Price Standard for Decoration Management in Special Services").

Property enterprises shall not charge other expenses related to decoration in any form after collecting decoration management fees.

Before the implementation of these measures, renovation contract has been signed and implemented, which can be implemented according to the contract.

Twenty-first with the consent of the owners' meeting, the realty service enterprise may insure the public liability insurance for the residential realty service area. The required expenses shall be shared according to the service area of the property.

Article 22 A realty service enterprise shall report the realty service items and charging standards to the district property administrative department and the district price administrative department for the record in accordance with the Filing Procedure for Residential Property Service Charging Standards (Annex 4).

Article 23 The daily operation and maintenance fees and elevator foundation fees used in the * * * part of the property service fees shall be accounted for separately as the fees for the owners to purchase property services in advance, which shall be used for special purposes and carried forward to rolling storage.
