Interim Measures for the Administration of CATV System in Urban Communities (revised 20 15)

Article 1 These Measures are formulated in accordance with the Regulations on the Administration of Radio and Television in order to standardize the management of urban community cable television systems, meet the needs of the people to listen to and watch radio and television programs, and promote the construction of socialist spiritual civilization. Article 2 These Measures shall apply to residential quarters, government offices, dormitories of enterprises and institutions and other residential areas (hereinafter referred to as urban communities). Article 3 The State Administration of Radio, Film and Television (hereinafter referred to as the State Administration of Radio, Film and Television) is responsible for the management of urban community cable television systems throughout the country.

Local radio and television administrative departments at or above the county level shall be responsible for the management of urban community cable television systems within their respective administrative areas. Article 4 Where the cable radio and television transmission coverage network in the local administrative area cannot reach the community, it may apply for the establishment of urban community cable television system.

The local administrative area cable radio and television transmission coverage network has reached the community, and its original urban community cable television system must be networked with the local administrative area cable radio and television transmission coverage network and incorporated into the unified maintenance and management of the local administrative area cable radio and television network. Article 5 To apply for the establishment of urban community cable TV system, the following materials shall be submitted:

1. application (the applicant must prove in the application that the local administrative area cable radio and television transmission coverage network does not have the conditions to connect with the community);

2. Relevant documents proving that the start-up unit has independent legal person qualification and property management qualification;

3. Technical scheme and rules and regulations of urban community cable TV system;

4. Having the corresponding site and the necessary number of professional and technical personnel certification documents required to ensure the safe transmission of radio and television program signals. Article 6 To apply for the establishment of urban community cable TV system, the following procedures shall be followed:

1. The competent department of a residential property management institution with independent legal personality or a unit undertaking property management functions shall apply to the county or prefecture (city) level radio and television administrative department where the residential area is located.

2. Those who need to receive and relay satellite TV programs must apply for a license to receive satellite TV programs in accordance with the Regulations on the Administration of Ground Receiving Facilities for Satellite TV Broadcasting (the State Council DecreeNo. 129).

3. The radio and television administrative department at the county level shall conduct preliminary examination in accordance with the time limit and authority stipulated in the Administrative Licensing Law, and submit the examination opinions and application materials to the radio and television administrative department at the prefecture (city) level.

4. After receiving the applicant's application or the application review materials submitted by the county-level radio and television administrative department, the radio and television administrative department at the prefecture (city) level shall make an examination and approval decision in accordance with the time limit and authority stipulated in the Administrative Licensing Law. Article 7 If the applicant meets the requirements, the administrative department of radio and television at the prefecture (city) level shall make a decision to grant the administrative license and issue the urban community cable television system license; Do not meet the conditions, shall not be approved, and explain the reasons in writing. Eighth "urban community cable TV system license" is valid for one year. If the expiration of the validity period requires an extension, an application for extension shall be filed with the original issuing authority 30 days before the expiration according to the above procedures. Article 9 The construction of urban community cable TV system (including its satellite TV receiving facilities) shall be undertaken by the construction unit with corresponding qualifications, and the selected equipment must be approved by radio and television equipment, and the satellite TV receiving facilities must pass the information security assessment and have legal sources. The installation of the above-mentioned equipment must conform to the technical standards, technical safety specifications and requirements of the administrative department of radio and television, and can only be put into operation after the administrative department of radio and television at or above the county level has passed the acceptance. Tenth urban community cable TV system start-up units shall accept the unified management of radio and television administrative departments.

Urban community cable TV system start-up units should establish and improve the relevant management system, to ensure that there is a special person on duty 24 hours a day, and professional and technical personnel should regularly repair and maintain relevant equipment, regularly inspect the lines, prevent illegal reception and broadcasting of overseas satellite TV programs, promptly handle program signals and technical failures that may endanger publicity safety, and ensure the transmission safety of equipment network systems and signals. Major accidents must be reported to the local radio and television administrative department within one hour. Eleventh urban community cable TV system should fully broadcast TV programs that must be transmitted according to the provisions of the State Administration of Radio, Film and Television.

City community cable TV system shall not broadcast TV programs and advertisements on its own, and shall not provide video-on-demand programs. Twelfth without permission, the urban community cable TV system shall not receive or transmit overseas satellite TV programs. Article 13 Within 30 days after the community where the urban community cable TV system is located accesses the cable TV transmission coverage network in its administrative area, the original issuing authority shall cancel its Urban Community Cable TV System License and Satellite TV Program Receiving License, and the radio and television administrative department at the prefecture (city) level shall be responsible for supervising the dismantling of its broadcasting equipment, satellite ground receiving facilities and other related facilities. Fourteenth in violation of these measures, according to the "Regulations" and "Regulations" for the administration of satellite TV broadcasting ground receiving facilities will be punished. Fifteenth these Measures shall come into force as of September 2004. SARFT's Interim Measures for the Administration of Urban Community Cable TV System (SARFT Order No.7) shall be abolished at the same time.
