Xi elevator safety management measures

Chapter I General Provisions Article 1 In order to strengthen elevator safety management, prevent elevator accidents, and ensure personal and property safety, these Measures are formulated in accordance with the Law of the People's Republic of China on Safety of Special Equipment, the Product Quality Law of People's Republic of China (PRC), the Regulations on Safety Supervision of Special Equipment, the Regulations on Safety Supervision of Special Equipment in Shaanxi Province and the Measures for Supervision and Administration of Elevator Safety in Shaanxi Province, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the production (including manufacture, installation, renovation and maintenance), operation, selection and configuration, use, maintenance, inspection, safety assessment, supervision and management of elevators within the administrative area of this Municipality.

The specific scope of elevators as mentioned in these Measures is determined according to the catalogue of special equipment approved by the State Council. Third city special equipment safety supervision and management department is the competent department of elevator safety in this city, responsible for the supervision and management of elevator safety in this city.

District, county and development zone special equipment safety supervision and management departments shall be responsible for the supervision and management of elevator safety in their respective jurisdictions in accordance with the prescribed division of responsibilities.

Planning, construction, housing management, industry and commerce, public security, safety supervision, urban (shed) reform, price, transportation, municipal administration, education, health, commerce, tourism and other departments shall do a good job in elevator safety management according to their respective responsibilities. Article 4 Elevator safety management shall follow the principles of territorial management and graded responsibility.

The people's governments at the county level and the Administrative Committee of the Development Zone shall strengthen their leadership over elevator safety management, urge and support relevant departments to perform their duties of elevator safety management according to law, establish a coordination mechanism, and coordinate and solve problems existing in elevator safety management in a timely manner.

Town People's Government and sub-district offices shall urge elevator users to investigate elevator safety hazards, implement the main responsibility of safety, assist relevant departments to do a good job in elevator accident investigation and handling, hidden dangers rectification, daily supervision and inspection, and coordinate and solve contradictions and disputes caused by elevator safety.

Community, neighborhood (village) committees shall actively cooperate with the government and its relevant departments to perform their duties of elevator safety supervision and management, and assist in handling contradictions and disputes caused by elevator safety. Fifth elevator production, operation, use, maintenance units shall abide by laws and regulations, safety technical specifications and related standards, establish and improve the elevator safety responsibility system, and be responsible for the safety of elevator production, operation, use and maintenance. Sixth special equipment safety supervision and management departments should strengthen the publicity and education of elevator safety knowledge, and enhance public safety awareness and self-protection ability.

Elevator use and maintenance units shall guide the public to use elevators correctly.

Organs, enterprises, institutions and social organizations shall conduct elevator safety education for their own personnel, so as to improve the level of elevator safety knowledge.

Schools and kindergartens should strengthen elevator safety education and enhance students' and children's awareness of safe and civilized use of elevators.

The news media should strengthen the public welfare propaganda of elevator laws and regulations and safety elevators, and supervise the behavior in violation of elevator safety management regulations by public opinion. Article 7 Trade associations shall strengthen industry self-discipline, promote the construction of industry credit system, and promote the honest operation of elevator production, operation, use and maintenance units. Article 8 Encourage elevator manufacturing, use and maintenance units to adopt advanced technologies and information means such as Internet of Things and big data to improve elevator safety performance and management level.

The Municipal People's Government shall reward the units and individuals that have made outstanding contributions in the research of elevator science and technology, the promotion of advanced technology and advanced management methods. Article 9 This Municipality implements elevator safety liability insurance. Article 10 Any unit or individual has the right to report illegal acts involving elevator safety to the safety supervision and management department of special equipment and relevant departments, and the department that receives the report shall promptly handle them. Chapter II Production and Operation Article 11 Elevator manufacturing units shall abide by the following provisions:

(a) to obtain a license according to law and be responsible for the safety performance of the elevators produced by it;

(2) The manufactured elevators (including complete machines and components) meet the requirements of laws and regulations, safety technical specifications and standards;

(3) The elevator leaves the factory with technical data and documents required by laws, regulations, rules and specifications;

(four) to provide necessary elevator spare parts and technical training and other technical assistance for elevator use and maintenance units, and shall not set up technical barriers;

(five) in the quality guarantee period, the elevator quality problems are repaired and replaced free of charge, and the elevator quality guarantee period is recalculated;

(six) follow-up investigation on the safe operation of the elevator, put forward suggestions for improvement on the existing problems, and inform the elevator users in time and report to the special equipment safety supervision and management department when major accidents are found;

(seven) entrust other units to carry out elevator installation, renovation and maintenance, should be in accordance with the requirements of safety technical specifications for safety guidance and monitoring, inspection and debugging, and be responsible for the results of inspection and debugging;

(8) In case of elevator failure or accident due to design, manufacture and other reasons, measures shall be taken to rectify the elevators of the same model in this city, eliminate hidden dangers, inform the relevant elevator users in time, and report to the local special equipment safety supervision and management department.
