Liu Keping introduced that the parties to a property service dispute may apply to the People's Mediation Committee of the property management industry for mediation, and the People's Mediation Committee shall accept it. The people's mediation committee may also take the initiative to intervene in mediation according to the needs of units and the masses, but it shall not prevent the parties from bringing a lawsuit to the court because they refuse to mediate or fail to mediate.
At the same time, if the parties reach a mediation agreement on the property service disputes mediated by the People's Mediation Committee of the property management industry, a people's mediation agreement shall be made. The mediation agreement is legally binding on both parties, and both parties shall earnestly perform it.
The people's mediation committee of the property management industry mediates property service disputes, which should generally be completed within 1 month. Under special circumstances, if mediation fails within 1 month, the mediation period may be appropriately extended with the consent of both parties to the dispute, but generally the extension period shall not exceed 30 days.
Liu Keping said: "After reaching an agreement through mediation by the People's Mediation Committee, if both parties think it necessary, they can apply to the people's court for judicial confirmation within 30 days from the effective date of the agreement. The people's court shall timely review the agreement and confirm the validity of the mediation agreement according to law. Upon confirmation by the court, if one party refuses or fails to fully perform, the other party may apply to the people's court for enforcement. "
At the same time, Liu Keping also said that the People's Mediation Committee of the property management industry will act as a third party in accordance with the People's Mediation Law, and through persuasion and persuasion, urge the parties to voluntarily reach a mediation agreement on the basis of equal consultation, so that contradictions and disputes and related issues can be resolved at the grassroots level in a timely and effective manner.
