Chapter I General Provisions Article 1 In order to strengthen the price management of the real estate market in Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone), these Measures are formulated in accordance with the relevant provisions of the state and the actual situation of the Special Zone. Article 2 The term "real estate" as mentioned in these Measures refers to real estate and real estate; Real estate appraisal refers to the evaluation and determination of real estate value, price and rent. Article 3 The principles of legality, fairness, seeking truth from facts and reasonable valuation shall be followed in conducting real estate appraisal business. Article 4 Shenzhen Municipal Bureau of Planning and Land Resources is the administrative department in charge of real estate appraisal (hereinafter referred to as the competent department). Shenzhen Property Appraisal Institute (hereinafter referred to as the Municipal Appraisal Institute) is the functional institution of property appraisal. Property price appraisal certificate, property valuation report, property price conciliation statement and property price dispute award issued by the firm according to these Measures are the basis for determining the value of relevant property. Chapter II Municipal Assets Appraisal Institutions Article 5 The responsibilities of municipal assets appraisal institutions are:

(a) to carry out the market value evaluation and measurement of all kinds of property transfer, lease and mortgage.

(two) to handle the valuation matters stipulated in the relevant real estate management norms, and to issue a written confirmation of the real estate price or rent.

(three) entrusted to assess the property involved in land acquisition and land use right recovery, and issue a property assessment report.

(four) to carry out the real estate market forecast, study the relationship between market price changes and property prices, publish property valuation index, rent index and construction cost index, and guide the work of other property valuation service agencies.

(six) responsible for the implementation of industry management of property appraisal service institutions.

(7) Providing other property appraisal services. Article 6 The following property appraisal items can only be valid appraisal documents issued or verified by municipal appraisal institutions:

(a) involving the state's expropriation of land, recovery of land use rights and related demolition compensation;

(2) Relevant benchmark prices and published prices of real estate in this Municipality;

(3) Property appraisal of providing mortgage guarantee to national specialized banks. Article 7 The staff of the Municipal Appraisal Institute shall have the right to consult the budget and final accounts, contracts, construction drawings and bank loan agreements of buildings or structures when handling the property appraisal business; Have the right to consult relevant financial and accounting materials and documents and investigate business premises and facilities, and relevant units and individuals shall provide assistance. Article 8 The property price and rent standards determined by the municipal appraisal institute and other property appraisal service institutions after examination and confirmation by the municipal appraisal institute shall serve as the basis for the relevant administrative departments to register, levy taxes and collect relevant administrative fees; According to the Interim Measures, the real estate price and rent determined by mediation or arbitration are binding on the parties. Article 9 The relevant property appraisal documents issued by the municipal appraisal office shall be signed by the director of the appraisal office. Chapter III Property Appraisal Service Organizations Article 10 The Special Zone may set up property appraisal service organizations to provide value appraisal consulting services. Eleventh to apply for the establishment of a property appraisal service institution shall meet the following conditions:

Articles of association of the property appraisal service institution;

(two) there are more than three professionals engaged in property appraisal;

(3) Fixed service places;

(four) its own funds of more than thirty thousand yuan;

(5) Having a sound financial system. Article 12 The articles of association of an asset appraisal service institution shall specify the following items:

(a) the name and address of the institution;

(2) purpose;

(3) economic nature;

(4) The amount of registered capital;

(5) Business scope and mode of operation;

(6) The name and legal representative of the organization;

(7) Distribution method. Thirteenth property appraisal professionals, should have a professional qualification certificate of construction project budget, with more than two years of experience in property appraisal, and after passing the examination by the competent department, issued a professional qualification certificate. Fourteenth the establishment of a real estate appraisal service institution shall be approved by the municipal planning and land department, and apply for registration to the Municipal Administration for Industry and Commerce with the approval documents. The business scope of the property appraisal service institution shall be approved by the competent department according to its technical strength, and its work shall be subject to the supervision and inspection of the municipal appraisal institution. Fifteenth related property appraisal documents issued by the property appraisal service institution shall be signed by the professionals holding the professional qualification certificate of property appraisal and their legal representatives, and stamped with the official seal of the property appraisal service institution. Chapter IV Property Appraisal Procedures Article 16 When entrusting a municipal appraisal agency or a property appraisal service agency to conduct property appraisal, the parties concerned shall sign an entrustment contract. The contents of the contract include: target, evaluation content, fees and remuneration, etc. Seventeenth the client shall submit the relevant documents, drawings or certification materials in accordance with the requirements of the municipal appraisal agency or the property appraisal service agency. If the property entrusted by the client for appraisal is not owned by him, the client shall submit the appraisal certificate approved by the owner. Eighteenth city appraisal institutions or property appraisal service institutions shall, in accordance with the contract, appraise the appraisal object, and issue the property price appraisal certificate or property appraisal report to the client. Article 19 When the client thinks that the property appraiser has an interest with him, he has the right to ask the property appraiser to withdraw.
