The agreement you signed with the developer violates the mandatory provisions of the Measures for the Administration of Property Service Charges and the Regulations on Property Management, so it is an invalid agreement.

About the loss of late delivery, it depends on whether there is an agreement in your house purchase contract. If there is an agreement, you can claim compensation from the developer according to the contract.
